149149 Section 27-101. A. A municipality may create a Municipal
150150 Court, as provided in this article, which shall be a court not of
151151 record. This court may be created in addition to a Municipal
152152 Criminal Court of Record. References in Sections 27-101 through 27-
153153 131 of this title to the municipal cou rt shall mean the municipal
154154 court not of record established under the authority of the
155155 provisions of this article.
156156 B. In cities having a population of more than fifteen thousand
157157 (15,000) inhabitants, according to the latest Fe deral Decennial
158158 Census, there is hereby created a "qualified DUI municipal court not
159159 of record", subject to the provisions of subsection C of this
160160 section. References in Sections 27 -101 through 27-131 of this title
161161 to the qualified DUI municipal court not of record shall mean the
162162 courts established by the provisions of this article in cities over
163163 fifteen thousand (15,000) population.
164164 C. For the creation of a qualified DUI municipal court not of
165165 record, the municipal governing body shall determine by resol ution
166166 that the qualified DUI municipal court not of record should be and
167167 is created. The governing body shall cause a certified copy of the
168168 resolution to be filed in the office of the county clerk of each
169169 county in which the municipality is located. The resolution and
170170 filing thereof shall be judicially noticed in all courts of this
171171 state. As a prerequisite to the creation of a qualified DUI
172172 municipal court not of record, the municipality must have a stand-

225225 handling such matters before the court.
226226 SECTION 2. AMENDATORY 47 O.S. 2021, Section 11 -902, is
227227 amended to read as follows:
228228 Section 11-902. A. It is unlawful and punishable as provided
229229 in this section for any perso n to drive, operate, o r be in actual
230230 physical control of a motor vehicle within this state, whether upon
231231 public roads, highways, streets, turnpikes, other public places or
232232 upon any private road, street, alley or lane which provides access
233233 to one or more single or multi-family dwellings, who:
234234 1. Has a blood or breath alcohol concentration, as defined in
235235 Section 756 of this title, of eight -hundredths (0.08) or more at the
236236 time of a test of such person 's blood or breath administered within
237237 two (2) hours after the arrest of such pe rson;
238238 2. Is under the influence of alcohol;
239239 3. Has any amount of a Schedule I chemical or controlled
240240 substance, as defined in Section 2 -204 of Title 63 of the Oklahoma
241241 Statutes, or one of its metabolites or analogs in the person 's
242242 blood, saliva, urine or any other bodily fluid at the time of a test
243243 of such person's blood, saliva, urine or any other bodily fluid
244244 administered within two (2) hours after the arrest of such person;
245245 4. Is under the influence of any intoxicating substance other
246246 than alcohol which may render such person incapable of safely
247247 driving or operating a motor vehicle; or

299299 5. Is under the combined influence of alcohol and any other
300300 intoxicating substance which may render such person incapable of
301301 safely driving or ope rating a motor vehicle .
302302 B. The fact that any person charged with a violation of this
303303 section is or has been lawfully entitled to use alcohol or a
304304 controlled dangerous substance or any other intoxicating substance
305305 shall not constitute a defense against any charge of violating t his
306306 section.
307307 C. 1. Any person who is convicted of a violation of the
308308 provisions of this section shall be guilty of a misdemeanor for the
309309 first offense and shall:
310310 a. participate in an assessment and evaluation pursuant
311311 to subsection G of this section and shall follow all
312312 recommendations made in the assessment and evaluation,
313313 b. be punished by imprisonment in jail for not less than
314314 ten (10) days nor more than one (1) year, and
315315 c. be fined not more than One Thousand Dollars
316316 ($1,000.00).
317317 2. Any person who, h aving been convicted of or having received
318318 deferred judgment for a violation of this section or a violation
319319 pursuant to the provisions of any law of this state or another state
320320 prohibiting the offenses provided in this section, Sectio n 11-904 of
321321 this title or paragraph 4 of subsection A of Section 852.1 of Title
322322 21 of the Oklahoma Statutes, or having a prior conviction in a

374374 municipal criminal court of record for the violation of a municipal
375375 ordinance prohibiting the offense provided fo r in this section
376376 commits a subsequent violation of this section within ten (10) years
377377 of the date following the completion of the execution of said
378378 sentence or deferred judgment shall, upon conviction, be guilty of a
379379 felony and shall participate in an ass essment and evaluation
380380 pursuant to subsection G of this section and shall be sentenced to:
381381 a. follow all recommendations made in the assessment and
382382 evaluation for treatment at the defendant 's expense,
383383 or
384384 b. placement in the custody of the Department of
385385 Corrections for not less than one (1) year and not to
386386 exceed five (5) years and a fine of not more than Two
387387 Thousand Five Hundred Dollars ($2,500.00), or
388388 c. treatment, imprisonment and a fine within the
389389 limitations prescribed in subparagraphs a and b of
390390 this paragraph.
391391 However, if the treatment in subsection G of this section does
392392 not include residential or inpatient treatment for a period of not
393393 less than five (5) days, the person shall serve a term of
394394 imprisonment of at least five (5) days.
395395 3. Any person who commits a violation of this section after
396396 having been convicted of a felony offense pursuant to the provisions
397397 of this section or a violation pursuant to the provisions of any law

450450 in this section, Section 11 -904 of this title or paragraph 4 of
451451 subsection A of Section 852.1 of Title 21 of the Oklahoma Statutes
452452 shall be guilty of a felony and participate in an assessment and
453453 evaluation pursuant to subsection G of this section and shall be
454454 sentenced to:
455455 a. follow all recommendations made in the assessment and
456456 evaluation for treatment at the defendant 's expense,
457457 two hundred forty (240) hours of community service and
458458 use of an ignition interlock device, as provided by
459459 subparagraph n of paragra ph 1 of subsection A o f
460460 Section 991a of Title 22 of the Oklahoma Statutes, or
461461 b. placement in the custody of the Department of
462462 Corrections for not less than one (1) year and not to
463463 exceed ten (10) years and a fine of not more than Five
464464 Thousand Dollars ($5 ,000.00), or
465465 c. treatment, imprisonment and a fine within the
466466 limitations prescribed in subparagraphs a and b of
467467 this paragraph.
468468 However, if the treatment in subsection G of this section does
469469 not include residential or inpatient treatment for a period of n ot
470470 less than ten (10) days, the person shall serve a term of
471471 imprisonment of at least ten (10) days.

523523 4. Any person who commits a violation of this section after
524524 having been twice convicted of a felony offense pursuant to the
525525 provisions of this section or a violation pursuant t o the provisions
526526 of any law of this state or another state prohibiting the offenses
527527 provided for in this section, Section 11 -904 of this title or
528528 paragraph 4 of subsection A of Section 852.1 of Title 21 of the
529529 Oklahoma Statutes shall be guilty of a felony and participate in an
530530 assessment and evaluation pursuant to subsection G of this section
531531 and shall be sentenced to:
532532 a. follow all recommendations made in the assessment and
533533 evaluation for treatment at the defendant 's expense,
534534 followed by not less than one (1) year of supervision
535535 and periodic testing at the defendant 's expense, four
536536 hundred eighty (480) hours of community service, and
537537 use of an ignition interlock device, as provided by
538538 subparagraph n of paragraph 1 of subsection A of
539539 Section 991a of Title 22 of the Oklahoma Statutes, for
540540 a minimum of thirty (30) days, or
541541 b. placement in the custody of the Department of
542542 Corrections for not less than one (1) year and not to
543543 exceed twenty (20) years and a fine of not more than
544544 Five Thousand Dollars ($5,000.00), or

596596 c. treatment, imprisonment and a fine within the
597597 limitations prescribed in subparagraphs a and b of
598598 this paragraph.
599599 However, if the person does not undergo residential or inpatient
600600 treatment pursuant to subsection G of this section the person shall
601601 serve a term of imprisonment of at least ten (10) days.
602602 5. Any person who, after a previous conviction of a violation
603603 of murder in the second degree or manslaughter in the first degree
604604 in which the death was caused as a result of driving under the
605605 influence of alcohol or other intoxicating substance, is convicted
606606 of a violation of this section shall be guilty of a felony and shall
607607 be punished by imprisonment in the custody of the Department of
608608 Corrections for not less than five (5) years and not to exceed
609609 twenty (20) years, and a fine of not more than Ten Thousand Dollars
610610 ($10,000.00).
611611 6. Provided, however, a conviction from another state shall not
612612 be used to enhance punishment pursuant to the provisions of this
613613 subsection if that convict ion is based on a bloo d or breath alcohol
614614 concentration of less than eight -hundredths (0.08).
615615 7. In any case in which a defendant is charged with driving
616616 under the influence of alcohol or other intoxicating substance
617617 offense or operating a motor vehicle while impaired within any
618618 municipality with a municipal court other than a court of record,
619619 the charge shall be presented to the county 's district attorney and

672672 municipality is located , except for any municipality with a
673673 qualified DUI municipal court not of record which may retain
674674 jurisdiction of the case and file such charge against a defendant .
675675 8. The qualified DUI municipal court not of record shall have
676676 jurisdiction to prosecute a defendant for any offenses related to
677677 driving under the influence of alcohol or other intoxicating
678678 substance or operating a motor vehicle while impaired for two
679679 dispositions during a ten -year period from the date of plea of the
680680 first disposition. Any subsequent arrest of a defendant for any
681681 offense related to driving under the influence of alcohol or other
682682 intoxicating substance or operating a motor vehicle while impaired ,
683683 after two dispositions during the ten -year period in the qualified
684684 DUI municipal court not of rec ord, shall be presented to the
685685 county's district attorney and filed with the district court of the
686686 county within which the municipality is located.
687687 a. The qualified DUI municipal court not of record shall
688688 be required to order the defendant, in addition to all
689689 other appropriate orders made by the court, to the
690690 following:
691691 (1) For the first disposition of any of fense related
692692 to driving under the influence of alcohol or
693693 other intoxicating substance or operating a motor
694694 vehicle while impaired , the defendant shal l be

746746 required to obtain a drug and alcohol assessment
747747 by a certified assessment agency or certified
748748 assessor and successfully complete all
749749 recommendations made therein. The defendant also
750750 shall be required to attend a victims impact
751751 panel, as defined in s ubsection H of Section 991a
752752 of Title 22 of the Oklahoma Statutes.
753753 (2) For a second disposition of any offense related
754754 to driving under the influence of alcohol or
755755 other intoxicating substance or operating a motor
756756 vehicle while impaired , the defendant shall be
757757 required to obtain a drug and alcohol assessment
758758 by a certified assessment agency or certified
759759 assessor and successfully complete all
760760 recommendations made therein, which shall include
761761 an intensive outpatient rehabilitation program.
762762 Additionally, the defendant shall be required to
763763 install, at defendant 's expense and on every
764764 motor vehicle operated by defendant, an ignition
765765 interlock device approved by the Board of Tests
766766 for Alcohol and Drug Influence for a period of
767767 six (6) months.
768768 b. Service Oklahoma shall not reinstate the driving
769769 privileges of the defendant from a driver license

821821 suspension pursuant to Sections 753 or 754 of this
822822 title until the defendant fully complies with all
823823 requirements enumerated in subparagraph a of this
824824 paragraph.
825825 9. Any person arrested for driving under the influence of
826826 alcohol or other intoxicating substance or operating a motor vehicle
827827 while impaired that results in bodily injury to anyone other than
828828 the defendant shall not be prosecuted in the qualified municipal
829829 court not of record but shall be presented to the county's district
830830 attorney and filed with the district court of the county within
831831 which the municipality is located.
832832 10. Any person having been convicted of a felony offense
833833 pursuant to the provision of this sectio n or a violation pursuant to
834834 the provisions of any law of this state or another state prohibiting
835835 the offenses provided for in this section or Section 11 -904 of this
836836 title, within the prior ten-year period, shall be prosecuted for any
837837 new offense involving driving under the influence of alcohol or
838838 other intoxicating substance or operating a motor vehicle while
839839 impaired by presenting said charge to the county 's district attorney
840840 and filing the same with the district court of the county within
841841 which the municipality is located.
842842 D. Any person who is convicted of a violation of driving under
843843 the influence with a blood or breath al cohol concentration of
844844 fifteen-hundredths (0.15) or more pursuant to this section shall be

896896 deemed guilty of aggravated driving under the influence. A person
897897 convicted of aggravated driving under the influence shall
898898 participate in an assessment and evaluat ion pursuant to subsection G
899899 of this section and shall comply with all recommendations for
900900 treatment. Such person shall be sentenced as provided in paragraph
901901 1, 2, 3, 4 or 5 of subsection C of this section and to:
902902 1. Not less than one (1) year of supervi sion and periodic
903903 testing at the defendant 's expense; and
904904 2. An ignition interlock device or devices, as provided by
905905 subparagraph n of paragraph 1 of subsection A of Section 991a of
906906 Title 22 of the Oklahoma Statutes, for a minimum of ninety (90)
907907 days.
908908 E. When a person is sentenced to imprisonment in the custody of
909909 the Department of Corrections, the person shall be processed through
910910 the Lexington Assessment and Reception Center or at a place
911911 determined by the Director of the Department of Corrections. The
912912 Department of Corrections shall classify and assign the person to
913913 one or more of the following:
914914 1. The Department of Mental Health and Substance Abuse Services
915915 pursuant to paragraph 1 of subsection A of Section 612 of Title 57
916916 of the Oklahoma Statutes; o r
917917 2. A correctional facility operated by the Department of
918918 Corrections with assignment to substance abuse treatment.

971971 substance abuse treatment program shall satisfy the recommendation
972972 for a ten-hour or twenty-four-hour alcohol and drug substance abuse
973973 course or treatment program or both. Successful completion of an
974974 approved Department of Corrections substance abuse treatment program
975975 may precede or follow the required assessment.
976976 F. The Department of Public Safety is hereby authorized to
977977 reinstate any suspended or revoked driving privilege when the person
978978 meets the statutory requirements which affect the existing driving
979979 privilege.
980980 G. Any person who is found guilty of a violation of the
981981 provisions of this section shall be ordered to participate in an
982982 alcohol and drug substance abuse evaluation and assessment program
983983 offered by a certified assessment agency or certified assessor for
984984 the purpose of evaluating and assessing the receptivity to trea tment
985985 and prognosis of the person and shall follow all recommendations
986986 made in the assessment and evaluation for treatment. The cour t
987987 shall order the person to reimburse the agency or assessor for the
988988 evaluation and assessment. Payment shall be remitted by the
989989 defendant or on behalf of the defendant by any third party;
990990 provided, no state-appropriated funds are utilized. The fee for a n
991991 evaluation and assessment shall be the amount provided in subsection

10471047 within seventy-two (72) hours from the time the pers on is evaluated
10481048 and assessed, submit a written report to the court for the purpose
10491049 of assisting the court in its sentencing determina tion. The court
10501050 shall, as a condition of any sentence imposed, including deferred
10511051 and suspended sentences, require the per son to participate in and
10521052 successfully complete all recommendations from the evaluation, such
10531053 as an alcohol and substance abuse treat ment program pursuant to
10541054 Section 3-452 of Title 43A of the Oklahoma Statutes. If such report
10551055 indicates that the evaluation and assessment shows that the
10561056 defendant would benefit from a ten -hour or twenty-four-hour alcohol
10571057 and drug substance abuse course or a treatment program or both, the
10581058 court shall, as a condition of any sentence imposed, including
10591059 deferred and suspended sen tences, require the person to follow all
10601060 recommendations identified by the evaluation and assessment and
10611061 ordered by the court. No pe rson, agency or facility operating an
10621062 evaluation and assessment program certified by the Department of
10631063 Mental Health and Su bstance Abuse Services shall solicit or refer
10641064 any person evaluated and assessed pursuant to this section for any
10651065 treatment program or substance abuse service in which such person,
10661066 agency or facility has a vested interest; however, this provision
10671067 shall not be construed to prohibit the court from ordering
10681068 participation in or any person from voluntarily utilizing a
10691069 treatment program or sub stance abuse service offered by such person,

11211121 agency or facility. If a person is sentenced to imprisonment in the
11221122 custody of the Department of Corrections and the court has received
11231123 a written evaluation report pursuant to the provisions of this
11241124 subsection, the report shall be furnished to the Department of
11251125 Corrections with the judgment and sentence. Any evaluation and
11261126 assessment report submitted to the court pursuant to the provisions
11271127 of this subsection shall be handled in a manner which will keep such
11281128 report confidential from the general public's review. Nothing
11291129 contained in this subsection shall be construed to prohibit the
11301130 court from ordering judgment and sentence in the event the defendant
11311131 fails or refuses to comply with an order of the court to obtain the
11321132 evaluation and assessment required by this subsection. If the
11331133 defendant fails or refuses to comply with an order of t he court to
11341134 obtain the evaluation and assessment, the Department of Public
11351135 Safety shall not reinstate driving privileges until the de fendant
11361136 has complied in full with such order. Nothing contained in this
11371137 subsection shall be construed to prohibit the cour t from ordering
11381138 judgment and sentence and any other sanction authorized by law for
11391139 failure or refusal to comply with an order of the court.
11401140 H. Any person who is found guilty of a violation of the
11411141 provisions of this section shall be required by the court t o attend
11421142 a victims impact panel program, as defined in subsection H of
11431143 Section 991a of Title 22 of the Oklahoma Statutes, if such a p rogram
11441144 is offered in the county where the judgment is rendered, and to pay

11971197 authority of the program and approved by the court, to the program
11981198 to offset the cost of participation by the defenda nt, if in the
11991199 opinion of the court the defendant has the ability to pay such fee.
12001200 I. Any person who is found guilty of a f elony violation of the
12011201 provisions of this section shall be required to submit to electronic
12021202 monitoring as authorized and defined by S ection 991a of Title 22 of
12031203 the Oklahoma Statutes.
12041204 J. Any person who is found guilty of a violation of the
12051205 provisions of this section who has been sentenced by the court to
12061206 perform any type of community service shall not be permitted to pay
12071207 a fine in lieu of performing the community service.
12081208 K. When a person is found guilty of a violation of the
12091209 provisions of this section, th e court shall order, in addition to
12101210 any other penalty, the defendant to pay a one -hundred-dollar
12111211 assessment to be deposited in the Dr ug Abuse Education and Treatment
12121212 Revolving Fund created in Section 2 -503.2 of Title 63 of the
12131213 Oklahoma Statutes, upon colle ction.
12141214 L. 1. When a person is eighteen (18) years of age or older,
12151215 and is the driver, operator, or person in physical control of a
12161216 vehicle, and is convicted of violating any provision of this section
12171217 while transporting or having in the motor vehicle any child less
12181218 than eighteen (18) years of age, the fine shall be enhanced to
12191219 double the amount of the fine imposed for the underlying dr iving

12721272 any other penalties allowed by this section.
12731273 2. Nothing in this subsection shall prohibit the prosecution of
12741274 a person pursuant to Section 852.1 of Title 21 of the Oklahoma
12751275 Statutes who is in violation of any provision of this section or
12761276 Section 11-904 of this title.
12771277 M. Any plea of guilty, nolo contendere or finding of guilt for
12781278 a violation of this section or a violation pursuant to the
12791279 provisions of any law of this state or another st ate prohibiting the
12801280 offenses provided for in this section, Section 11 -904 of this title,
12811281 or paragraph 4 of subsection A of Section 852.1 of Title 21 of the
12821282 Oklahoma Statutes, shall constitute a conviction of the offense for
12831283 the purpose of this section; pro vided, any deferred judgment shall
12841284 only be considered to constitute a conviction for a period of ten
12851285 (10) years following t he completion of any court -imposed
12861286 probationary term.
12871287 N. If qualified by knowledge, skill, experience, training or
12881288 education, a witness shall be allowed to testify in the form of an
12891289 opinion or otherwise solely on the issue of impairment, but not on
12901290 the issue of specific alcohol concentration level, relating to the
12911291 following:
12921292 1. The results of any standardized field sobriety test
12931293 including, but not limited to, the horizontal gaze nystagmus (HGN)

13461346 standardized field sobriety testing; or
13471347 2. Whether a person was under the influence of one or more
13481348 impairing substances and the categ ory of such impairing substance or
13491349 substances. A witness who has received training and holds a current
13501350 certification as a drug recognition expert shall be qualified to
13511351 give the testimony in any case in which such testimony may be
13521352 relevant.
13531353 SECTION 3. AMENDATORY 47 O.S. 2021, Section 11 -902c, is
13541354 amended to read as follows:
13551355 Section 11-902c. A. The State Legislature hereby occupies and
13561356 preempts the entire field of legislation in thi s state touching in
13571357 any way the prosecution o f offenses relating to driving under the
13581358 influence of alcohol or any other intoxicating substance or
13591359 operating a motor vehicle while impaired to the complete exclusion
13601360 of any order, ordinance, local legislation or regulation by any
13611361 municipality or other po litical subdivision of this state.
13621362 B. No municipality or other political subdivision shall
13631363 prosecute any laws or ordinances relating to the offense of driving
13641364 under the influence of alcohol or any other intoxic ating substance
13651365 or operating a motor vehicle while impaired. Any existing or future
13661366 orders, ordinances, local legislation or regulations in violation of
13671367 this section is void and unenforceable.

14191419 C. The preemption provisions of this section shall not apply to
14201420 prosecutions in municipal criminal courts of record or qualified DUI
14211421 municipal courts not of record for offenses relating to driving
14221422 under the influence of alcohol or any other intoxicating substance
14231423 or operating a motor vehicle while impaired. Nothing in this
14241424 section shall prohibit a municipalit y from establishing a municipal
14251425 criminal court of record pursuant to the provisions of Section 28 -
14261426 101 of Title 11 of the Oklahoma Statutes.
14271427 SECTION 4. This act shall become effective November 1, 2024.
