10197 Section 11-103.6a A. Beginning with the 2014-15 2024-2025
10298 school year, each area of s ubject matter standards, except for
10399 standards for career and technology education adopted pursuant to
104100 Section 14-103 of this title, shall be adopted by the State Board of
105101 Education and shall be subject to legislative review and approval as
106102 provided for in Section 4 11-103.6a-1 of this act title. The
107103 subject matter standards provided in Section 11-103.6 of this title
108104 shall be implemented statewide by every public school district in
109105 this state. The subject matter standards shall be thoroughly
110106 reviewed by the State Board every six (6) years according to and in
111107 coordination with the existing subject area te xtbook adoption cycle .
112108 Changes made to subject matter standards shall be appr oved by the
113109 Board and subject to legislative review and app roval one (1) year
114110 prior to the corresponding subject ar ea textbook adoption cycle to
115111 provide textbook vendors time to adjust textbook mater ials which
116112 align to subject matter stan dards. The Board may determin e a review
117113 of subject matter standards is not necessary if the state textbook
118114 cycle for a subject area is conducted in less than a six -year cycle.
119115 If subject matter standards are reviewe d fewer than twelve (12)
120116 years after substantive changes have been ma de, the Executive
121117 Committee, in consultation with the Departme nt, may recommend minor
122118 technical changes to the Board and waive the committee requirements
123119 outlined in subparagraphs b and c of paragraph 2 of subsection B of
124120 this section. After review, the State Board shall adopt any

152147 revisions in such subject matter standards deemed necessary to
153148 achieve further improvements in the quality of education for the
154149 students of this state. Any rev isions adopted by the State Board of
155150 Education shall be subject to re view and approval as provided for in
156151 Section 4 11-103.6a-1 of this act title. The adoption of subject
157152 matter standards or revisions to the standards by the State Board of
158153 Education pursuant to this section shall not be promulgated as rules
159154 and shall not be subject to Article I of the Administrative
160155 Procedures Act.
161156 B. 1. In addition to the requirements se t forth in subsection
162157 A of this section, on or before August 1, 2016, the The State Board
163158 of Education, in consultation with the Oklahoma State Regents for
164159 Higher Education, and the State Board of Career and Te chnology
165160 Education and the Oklahoma Department of Commerce, shall adopt
166161 ensure all subject matter standards for English Language A rts and
167162 Mathematics which are college- and career-ready and will replace
168163 current standards. To be considered college - and career-ready, the
169164 standards shall be evaluated by the State Department of Education ,
170165 the State Regents for Higher Education, the Sta te Board of Career
171166 and Technology Education and the Oklahoma Departme nt of Commerce and
172167 be determined to be such that the standards will address the goals
173168 of reducing the need for remedial coursework at the postsecondary
174169 level and increasing successful com pletion of postsecondary
175170 education. The subject matter standards and corresponding student

203197 assessments for English Language Arts and Mathematics shall be
204198 solely approved and controlled by the state through the State Board
205199 of Education through a review and revision process as provided in
206200 this section.
207201 2. Upon the effectiv e date of this act, the State Board of
208202 Education shall begin the process of adopting the English Langua ge
209203 Arts and Mathematics standards and shall provide reasonable
210204 opportunity, review subject matter standards consistent with best
211205 practices, for public comment on the revision of the standards,
212206 including but not limited to comments from students, parents,
213207 educators, organizations representing students with disabilities and
214208 English language learners, higher education representatives, career
215209 technology education representatives, subject matter experts,
216210 community-based organizations, Native American tribal
217211 representatives and business community representatives and inclusive
218212 of a variety of stakeholders across the state with expertise in the
219213 subject area standards under review. Each standards review pr ocess
220214 shall leverage three (3) committees and include a publi c comment
221215 period to support the review and possible revision of subject matter
222216 standards under review by the State Board of Education :
223217 a. an Executive Committee consisting of five (5) to eight
224218 (8) members shall be established for each subject
225219 matter under review by the State Board of Education.

256249 level expertise, ethnic a nd cultural backgrounds, and
257250 experience in public education. At least one member
258251 of the Executive Committee shal l be a public school
259252 educator in prekindergarten through twelfth grades and
260253 at least one member s hall be a representative of
261254 higher education in the state with expertise in the
262255 subject area standards under review. The Executive
263256 Committee, in coordination with State Department of
264257 Education staff, shall guide the subject matter
265258 standards review process and select stakeholders to
266259 serve on a Writing Committee and Draft Committee for
267260 each subject area standards review through an
268261 application process made availab le to the public on
269262 the Department website and other standard forms of
270263 communication. The Executive Committee, in
271264 coordination with Department staff, and a Writing
272265 Committee shall develop a set of criteria for quality
273266 standards for each subject area stand ards under
274267 review. The criteria used to guide the standards
275268 review process shall be evidence-based and may
276269 include, but shall not be limited to, the following:

321313 b. a Writing Committee shall be established for each
322314 subject area standards revie w and shall be tasked with
323315 reviewing and, if necessary, revising the subject
324316 matter standards utilizing criteria for quality
325317 subject matter standards establish ed by the Executive
326318 Committee and Department staff. The Writing Committee
327319 may recommend modifica tions to the criteria for

356347 Writing Committee shall includ e representatives with
357348 expertise in the subject matter standards under review
358349 from prekindergarten through twelfth grad e education,
359350 higher education, informal education, technology
360351 center schools, and the community. Members shall be
361352 residents of this state and selected by the Executive
362353 Committee members and Department staff through an
363354 application process, ensuring representa tion from a
364355 variety of characteristics, including geogra phy, grade
365356 level experience, ethnic and cultura l backgrounds, and
366357 experience in public education. Educator expertise
367358 shall be prioritized in the application selection
368359 process for Writing Committee me mbers with special
369360 consideration for inclusion given to educators with
370361 experience implementing the subj ect matter standards
371362 under review, and
372363 c. a Draft Review Committee shall be establis hed for each
373364 subject area standards review and shall be responsible
374365 for reviewing and providing feedback on draft versions
375366 of subject area standards produced by the Writing
376367 Committee during each subject matter standards review
377368 process. Feedback shall be consistent with the
378369 quality criterion established by the Executive

407397 provided for in this section. Members of the Draft
408398 Review Committee shall be residents of this state and
409399 include representatives from prekindergarten through
410400 twelfth grade education, higher education, informal
411401 education, career technology , and the community and
412402 are selected by Executive Comm ittee members and
413403 Department staff through an application process,
414404 ensuring representation from a vari ety of
415405 characteristics, including geography, grade level
416406 experience, ethnic and cultural backgrounds , and
417407 experience.
418408 3. The State Board of Education shall actively seek public
419409 comments from diverse stakeholders including , but not limited to,
420410 students, families of public school students, public school
421411 educators, organizations representing students with disabilities and
422412 English language learners, higher educa tion representatives, career
423413 technology education representatives, subject matter experts,
424414 community-based organizations, Native American tribal
425415 representatives, and business community representatives for a draft
426416 version of subject matters standards produc ed by the Executive
427417 Committee and Writing Committee. The State Board of Education shall
428418 provide a public comment period of not less than thirty (30) days
429419 for subject matter draft standards. Public comments shall be

458447 determine if additional modifications to the subject area standards
459448 are needed.
460449 4. Until the statewide student assessments for English Language
461450 Arts and Mathematics subject matter standards are implemented as
462451 provided for in paragrap h 1 of subsection C of this section
463452 operational, the State Board of Education shall imp lement the
464453 subject matter standards for English Language Arts and Mathematics
465454 which were in place prior to the revisions adopted by the Board in
466455 June 2010 review process provided for in this subsection.
467456 4. Upon the effective date of this act, the State Board of
468457 Education shall seek certification from the State Regents for Higher
469458 Education that the subject matter standards for English Language
470459 Arts and Mathematics which w ere in place prior to the revisions
471460 adopted by the Board in June 2010 are college - and career-ready as
472461 defined in the Federal Elementary and Secondary Education Act (ESEA)
473462 Flexibility document issued by the United States Department of
474463 Education and referen ced in Option B of Principle 1: College and
475464 Career-Ready Expectations for All Students. The State Regents shall
476465 provide the Board a detailed description of the certification
477466 process and results, including a list of deficiencies if the State
478467 Regents conclude that the standards are not college- and career-
479468 ready. The Board shall post all documents, mater ials, reports,
480469 descriptions and correspondence produced by the State Regents o r

510498 C. 1. On or before the 2017 -18 school year, the State Board of
511499 Education, in consultation with the State Regents for Higher
512500 Education, the State Board of Career and Technology Education and
513501 the Oklahoma Department of Comm erce, shall direct the process of the
514502 development of annual high -quality statewide student assessmen ts for
515503 English Language Arts and Mathematics as provided for in Section
516504 1210.508 of this title that align with the college- and career-ready
517505 subject matter standards developed pursuant to subsection B of this
518506 section.
519507 2. The statewide student assessments for English Language Arts
520508 and Mathematics shall continue to assess standards a nd objectives
521509 found in the subject matter standards for English Language Arts and
522510 Mathematics which were in place prior to the revisions adopted by
523511 the Board in June 2010 and the test blueprints shall continue to
524512 align to the standards and objectives found in such subject matter
525513 standards for English Language Arts and Mathematics un til the new
526514 assessments are implemented as provided for in paragraph 1 of this
527515 subsection.
528516 D. 1. The State Board of Education shall not enter into any
529517 agreement, memorandum of understanding or contract with any federal
530518 agency or private entity which in a ny way cedes or limits state
531519 discretion or control over the process of development, adoption or

560547 assessments in the public school system, including, but not limited
561548 to, agreements, memoranda of understanding and contracts in exchange
562549 for funding for public schools and programs. If the State B oard of
563550 Education is a party to such an agreement, memorandum of
564551 understanding or contract on the effective date of this act, the
565552 State Board of Education s hall initiate necessary efforts to amend
566553 the agreement, memorandum of understanding or contract to c omply
567554 with the requirements of this subsection.
568555 2. Nothing in this section sh all be construed to prohibit the
569556 State Board of Education from seeking and bei ng granted a waiver
570557 from federal law, provided that the conditions for the waiver do not
571558 require the state to cede or limit its discretion or control over
572559 the process of developm ent, adoption or revision of subject matter
573560 standards and corresponding statew ide student assessments.
574561 3. The State Department of Education may participate in a
575562 multistate or multigovernmental cooperative pursuant to the
576563 requirements of the Oklahoma Centr al Purchasing Act, but shall not
577564 bind the state, contractually or otherwise, t o the authority of any
578565 other state, organization or entity which may supersede the
579566 authority of the State Board of Education.
580567 E. D. The content of all subject matter standards and
581568 corresponding student assessments shall be solely approved and
582569 controlled by the state through the State Board of Education and

611597 Education shall maintain independence of all subject matter
612598 standards referenced in Section 11-103.6 of this title and
613599 corresponding statew ide student assessments and shall not relinquish
614600 authority over Oklahoma subject matter standards an d corresponding
615601 statewide student assessments. Nothing in this section shall
616602 prohibit benchmarking the state subject matter standards and
617603 corresponding student assessments with those of other states or
618604 nations to allow comparison of Oklahoma subject matte r standards and
619605 corresponding student assessments with those of other states a nd
620606 nations.
621607 F. E. School districts shall exclusively determine the
622608 instruction, curriculum, reading lists and instructional materials
623609 and textbooks, subject to any applicable pr ovisions or requirements
624610 as set forth in law, to be used in meeting the subjec t matter
625611 standards. School districts may, at their discretion, adopt
626612 supplementary student assessments which are in addition to the
627613 statewide student assessments.
628614 G. 1. Upon completion of the adoption of English Language Arts
629615 and Mathematics subject mat ter standards pursuant to subsection B of
630616 this section, the State Board of Edu cation shall compare such
631617 English Language Arts and Mathematics standards with the English
632618 Language Arts and Mathematics standards that were adopted by the
633619 State Board of Educati on prior to implementation of this act. The

663648 of standards. The State Board of Education shall compare the
664649 standards in the areas of:
665650 a. effective preparation for active citizenship and
666651 postsecondary education or the workforce,
667652 b. subject matter content,
668653 c. sequencing of subject matter content an d relationship
669654 to measurement of student performance and the
670655 application of subject matter standards,
671656 d. developmental appropriateness of grade -level
672657 expectations, academic content and instructional
673658 rigor,
674659 e. clarity for educators and parents,
675660 f. exemplars tied to the standards,
676661 g. measurability of student proficiency in the subject
677662 matter,
678663 h. pedagogy,
679664 i. development of critical thinking skills, and
680665 j. demonstration of application of acquired knowledge and
681666 skills.
682667 2. Upon completion of the comparison of t he English Language
683668 Arts and Mathematics subject matter standards, the State B oard of
684669 Education shall submit to the Governor, the Speaker of the House of

716700 H. F. All subject matter standards and cor responding statewide
717701 student assessments adopted by the State Board of Education shall be
718702 carefully circumscribed to reflect direct application to subject
719703 matter proficiency and statewide assessments shall not include
720704 standards or assessment questions that are designed to collect or
721705 measure noncognitive, emotional or psychological characteristics, or
722706 attributes or skills of students.
723707 G. Upon approval of changes to subject area stand ards by the
724708 State Board of Education, and subject to the availability of fu nds,
725709 the Department shall update subject matter cur riculum frameworks
726710 with resources to support public school districts with the
727711 implementation of subject area standards.
728712 I. H. Any rule, including but not limited to Rules 210:15 -4-1
729713 through 210:15-4-3 of the Oklahoma Administrative Code, which
730714 conflicts with the requirements of this section, shall be am ended or
731715 repealed by the State Board of Education as necessary to comply with
732716 the requirements of this section.
733717 SECTION 2. This act shall become effective July 1, 2024.
734718 SECTION 3. It being immediately necessary for the pre servation
735719 of the public peace, health or safety, an emergency is hereby
