BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. Beginning with the 2014-15 2024-2025 school year, each area of s ubject matter standards, except for standards for career and technology education adopted pursua nt to Section 14-103 of this title, shall be adopted by the State Board of Education and shall be subject to legislative review and approval as provided for in Section 4 11-103.6a-1 of this act title. The subject matter standards provided in Section 11-103.6 of this title shall be implemented statewide by every public school district in this state. The subject matter standards shall be thoroughly reviewed by the State Board every six (6) years according to and in coordination with the existing subject are a textbook adoption cycle . Changes made to subject matter standards shall be appr oved by the Board and subject to legislative review and app roval one (1) year prior to the corresponding subject ar ea textbook adoption cycle to provide textbook vendors time to adjust textbook mater ials which align to subject matter stan dards. The Board may determin e a review of subject matter standards is not necessary if the state textbook cycle for a subject area is conducted in less than a six -year cycle. If subject matter standards are reviewe d fewer than twelve (12) years after substantive changes have been ma de, the Executive Committee, in consultation with the Departme nt, may recommend minor technical changes to the Board and waive the committee requirements outlined in subparagraphs b and c of paragraph 2 of subsection B of this section. Any rev isions adopted by the State Board of Education shall be subject to re view and approval as provided for in Section 4 11-103.6a-1 of this act title. The adoption of subject matter standards or revisions to the standards by the State Board of Education pursuant to this section shall not be promulgated as rules and shall not be subject to Article I of the Administrative Procedures Act. B. 1. In addition to the requirements se t forth in subsection A of this section, on or before Augus t 1, 2016, the The State Board of Education, in consultation with the Oklahoma State Regents for Higher Education, and the State Board of Career and Te chnology Education and the Oklahoma Department of Commerce, shall adopt ensure all subject matter standar ds for English Language A rts and Mathematics which are college- and career-ready and will replace current standards. To be considered college - and career-ready, the standards shall be evaluated by the State Department of Education , the State Regents for Higher Education, the Sta te Board of Career and Technology Education and the Oklahoma Departme nt of Commerce and be determined to be such that the standards will address the goals of reducing the need for remedial coursework at the postsecondary level and increasing successful com pletion of postsecondary education. Upon the effectiv e date of this act, the State Board of Education shall begin the process of adopting the English Langua ge Arts and Mathematics standards and shall provide reasona ble opportunity, review subject matter standards consistent with best practices, for public comment on the revision of the standards, including but not limited to comments from students, parents, educators, organizations representing students with disabili ties and English language learners, higher education representatives, career technology education representatives, subject matter experts, community-based organizations, Native American tribal representatives and business community representatives and inclusive of a variety of stakeholders across the state with expertise in the subject area standards under review. Each standards review pr ocess shall leverage three (3) committees and include a publi c comment period to support the review and possible revision of subject matter standards under review by the State Board of Education : a. an Executive Committee consisting of five (5) to eight (8) members shall be established for each subject matter under review by the State Board of Education. At least one member of the Executive Committee shal l be a public school educator in prekindergarten through twelfth grades and at least one member s hall be a representative of higher education in the state with expertise in the subject area standards under review. The Executive Committee, in coordination with State Department of Education staff, shall guide the subject matter standards review process and select stakeholders to serve on a Writing Committee and Draft Committee for each subject area standards review through an application process made availab le to the public on the Department website and other standard forms of communication. The Executive Committee, in coordination with Department staff, and a Writing Committee shall develop a set of criteria for quality standards for each subject area stand ards under review. The criteria used to guide the standards review process shall be evidence-based and may include, but shall not be limited to, the following: HB3275 HFLR Page 6 BOLD FACE denotes Committee Amendments. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 (1) effective preparation for active citizenship and postsecondary education or the workforce, (2) subject matter content, (3) sequencing of subject matter content and relationship to measurem ent of student performance and the application of subject matter standards, (4) developmental appropriateness of grade -level expectations, academic content , and instructional rigor, (5) clarity for educator s and families, (6) measurability of student profi ciency in the subject matter, (7) evidence-based pedagogy, (8) development of critical thinking skills, and (9) demonstration of appli cation of acquired knowledge and skills, b. a Writing Committee shall be established for each subject area standards revie w and shall be tasked with reviewing and, if necessary, revising the subject matter standards utilizing criteria for quality subject matter standards establish ed by the Executive Committee and Department staff. Members of the Writing Committee shall includ e representatives with expertise in the subject matter standards under review from prekindergarten through twelfth grad e education, higher education, informal education, technology center schools, and the community. Members shall be residents of this state and selected by the Execut ive Committee members and Department staff through an application process, ensuring representa tion from a variety of characteristics, including geogra phy, grade level experience, ethnic and cultura l backgrounds, and experience in public education. Educator expertise shall be prioritized in the application selection process for Writing Committee me mbers with special consideration for inclusion given to educators with experience implementing the subj ect matter standards under review, and c. a Draft Review Committee shall be establis hed for each subject area standards review and shall be responsible for reviewing and providing feedback on draft versions of subject area standards produced by the Writing Committee during each subject matter standards review process. Members of the Draft Review Committee shall be residents of this state and include representatives from prekindergarten through twelfth grade education, higher education, informal education, career technology , and the community and are selected by Executive Comm ittee members and Department staff through an application process, ensuring representation from a vari ety of characteristics, including geography, grade level experience, ethnic and cultural backgrounds , and experience. 3. The State Board of Education shall actively seek public comments from diverse stakeholders including , but not limited to, students, families of public school students, public school educators, organizations representing students with disabilities and English language learners, higher educa tion representatives, career technology education representatives, subject matter experts, community-based organizations, Native American tribal representatives, and business community representatives for a draft version of subject matters standards produc ed by the Executive Committee and Writing Committee. The State Board of Ed ucation shall provide a public comment period of not less than thirty (30) days for subject matter draft standards. Public comments shall be HB3275 HFLR Page 9 BOLD FACE denotes Committee Amendments. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 reviewed by the Executive Committee and Writing Committee to determine if additional modifications to the subject area standards are needed. 4. Until the statewide student assessments for English Language Arts and Mathematics subject matter standards are implemented as provided for in paragrap h 1 of subsection C of this section operational, the State Board of Educati on shall implement the subject matter standards for English Language Arts and Mathematics which were in place prior to the revisions adopted by the Board in June 2010 review process provided for in this subsection. 4. Upon the effective date of this act, the State Board of Education shall seek certification from the State Regents for Higher Education that the subject matter standards for English Language Arts and Mathematics which w ere in place prior to the revisions adopted by the Board in June 2010 are c ollege- and career-ready as defined in the Federal Elementary and Secondary Education Act (ESEA) Flexibility document issued by the United States Department of Education and referen ced in Option B of Principle 1: College and Career-Ready Expectations for All Students. The State Regents shall provide the Board a detailed description of the certification process and results, including a list of deficiencies if the State Regents conclude that the standards are not college- and career- ready. C. 1. On or before the 2017 -18 school year, the State Board of Education, in consultation with the State Regents for Higher Education, the State Board of Career and Technology Education and the Oklahoma Department of Comm erce, shall direct the process of the development of annual high -quality statewide student assessmen ts for English Language Arts and Mathematics as provided for in Section 1210.508 of this title that align with the college- and career-ready subject matter standards developed pursuant to subsection B of this section. 2. The statewide student assessments for English Language Arts and Mathematics shall continue to assess standards a nd objectives found in the subject matter standards for English Language Arts and Mathematics which were in place prior to the revisions adopted by the Board in June 2010 and the test blueprints shall continue to align to the standards and objectives found in such subject matter standards for English Language Arts and Mathematics un til the new assessments are implemented as provided for in paragraph 1 of this subsection. D. 1. The State Board of Education shall not enter into any agreement, memorandum of understanding or contract with any federal agency or private entity which in a ny way cedes or limits state discretion or control over the process of deve lopment, adoption or HB3275 HFLR Page 11 BOLD FACE denotes Committee Amendments. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 revision of subject matter standards and corresponding student assessments in the public school system, including, but not limited to, agreements, memoranda of understanding and contracts in exchange for funding for public schools and programs. If the State B oard of Education is a party to such an agreement, memorandum of understanding or contract on the effective date of this act, the State Board of Education s hall initiate necessary efforts to amend the agreement, memorandum of under standing or contract to c omply with the requirements of this subsection. 2. Nothing in this section sh all be construed to prohibit the State Board of Education from seeking and bei ng granted a waiver from federal law, provided that the conditions for the waiver do not require the state to cede or limit its discretion or control over the process of developm ent, adoption or revision of subject matter standards and corresponding statew ide student assessments. 3. The State Department of Education may particip ate in a multistate or multigovernmental cooperative pursuant to the requirements of the Oklahoma Centr al Purchasing Act, but shall not bind the state, contractually or otherwise, t o the authority of any other state, organization or entity which may supers ede the authority of the State Board of Education. E. D. The content of all subject matter standards and corresponding student assessments shall be solely approved and controlled by the state through the State Board of Education and HB3275 HFLR Page 12 BOLD FACE denotes Committee Amendments. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 subject to legislative review and approval. The State Board of Education shall maintain independence of all subject matter standards referenced in Section 11-103.6 of this title and corresponding statew ide student assessments and shall not relinquish authority over Oklahoma su bject matter standards an d corresponding statewide student assessments. Nothing in this section shall prohibit benchmarking the state subject matter standards and corresponding student assessments with those of other states or nations to allow comparison of Oklahoma subject matte r standards and corresponding student assessments with those of other states a nd nations. F. E. School districts shall exclusively determine the instruction, curriculum, reading lists and instructional materials and textbooks, subject to any applicable pr ovisions or requirements as set forth in law, to be used in meeting the subjec t matter standards. School districts may, at their discretion, adopt supplementary student assessments which are in addition to the statewide student as sessments. G. 1. Upon completion of the adoption of English Language Arts and Mathematics subject mat ter standards pursuant to subsection B of this section, the State Board of Edu cation shall compare such English Language Arts and Mathematics standards w ith the English Language Arts and Mathematics standards that were adopted by the State Board of Educati on prior to implementation of this act. The State Board of Education shall compare the standards in the areas of: a. effective preparation for active citizenship and postsecondary education or the workforce, b. subject matter content, c. sequencing of subject matter content an d relationship to measurement of student performance and the application of subject matter standards, d. developmental appropriateness of grade -level expectations, academic content and instructional rigor, e. clarity for educators and parents, f. exemplars tied to the standards, g. measurability of student proficiency in the subject matter, h. pedagogy, i. development of critical thinking skills, and j. demonstration of application of acquired knowledge and skills. 2. Upon completion of the comparison of t he English Language Arts and Mathematics subject matter standards, the State B oard of Education shall submit to the Governor, the Speaker of the House of HB3275 HFLR Page 14 BOLD FACE denotes Committee Amendments. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 Representatives, the President Pro Tempore of the Senate, the Minority Leader of the House of Represen tatives and the Minority Leader of the Senate a report outlining the results o f the comparison of the standards. H. F. All subject matter standards and cor responding statewide student assessments adopted by the State Board of Educ ation shall be carefully circumscribed to reflect direct application to subject matter proficiency and statewide assessments shall not include standards or assessment questions that are designed to collect or measure noncognitive, emotional or psychologica l characteristics, or attributes or skills of students. G. Upon approval of changes to subject area stand ards by the State Board of Education, and subject to the availability of fu nds, the Department shall update subject matter cur riculum frameworks with resources to support public school districts with the implementation of subject area standards. I. H. Any rule, including but not limited to Rules 210:15 -4-1 through 210:15-4-3 of the Oklahoma Administrative Code, which conflicts with the requirements of this section, shall be am ended or repealed by the State Board of Education as necessary to comply with the requirements of this section. SECTION 2. This act shall become effective July 1, 2024. SECTION 3.
