105 | 97 | | 3. Self-harm and suicide prevention, which shall deploy |

106 | 98 | | monitoring features that identify online content related to self- |

107 | 99 | | harm or suicide, and enable timely intervention and support for at - |

108 | 100 | | risk students; |

109 | 101 | | 4. Threat alerts, which shall identify potentially dangerous |

110 | 102 | | activities or discussions online, and help to prevent school |
---|
111 | 103 | | violence and harm to stude nts; and |
---|
112 | 104 | | 5. Monitoring student online behavior, which shall employ |

113 | 105 | | digital safety solutions to monitor an d report online behavior of |

114 | 106 | | students while safeguarding their privacy. The monitoring shall |

145 | 136 | | C. The digital safety policies adopted and implemented pursuant |

147 | 138 | | 1. Ensure there is strict data privacy and protecti on measures |

148 | 139 | | in compliance with all applicable laws and regulations. Personally |

149 | 140 | | identifiable information of students shall be safeguarded; |

150 | 141 | | 2. Incorporate transparent processes for collecting and using |
---|
151 | 142 | | data with informed consent from parents or guardians of students. |

152 | 143 | | The school shall clearly communicate how data is collected and |
---|
153 | 144 | | utilized for digital safety pu rposes; and |
---|
154 | 145 | | 3. Provide parents with the option to manage their student 's |
---|
155 | 146 | | online activity while using school -issued devices at home. |
---|
156 | 147 | | D. Public school districts shall annually report to the |
---|
157 | 148 | | Department of Mental Health and Substance Abuse Services on the |
---|
158 | 149 | | effectiveness of digital safety solutions in enha ncing digital |
---|
159 | 150 | | safety, including data on incidents prevented, interventions made, |
---|
160 | 151 | | and the impact on student well-being. Each school district's annual |
---|
161 | 152 | | report shall be published on the Departme nt's website for public |
---|
162 | 153 | | access. |
---|
163 | 154 | | E. Subject to the availability of funds, the Department shall |
---|
164 | 155 | | issue a request for proposal to select a vendor which will develop |
---|
165 | 156 | | and implement the digital platform to be used by all public schools |
---|
196 | 186 | | Digital Safety and Awareness Act, the request for proposal |
---|
197 | 187 | | application, and any Department poli cies established to implement |
---|
198 | 188 | | the Act, including all data components, digital safety , and privacy |

199 | 189 | | standards. The Department shall ensure all public schools comply |

200 | 190 | | with the Student Digital Safety and Awareness Act, including |

201 | 191 | | reviewing the schools' adopted policies and procedures and ensuring |
---|
202 | 192 | | adherence to digital safety and privacy standards and utilization of |
---|
203 | 193 | | the selected vendor. |

204 | 194 | | SECTION 2. This act shall become effective July 1, 2024. |

205 | 195 | | SECTION 3. It being immediately necessary for the preservation |
---|
206 | 196 | | of the public peace, health or safety, an emergency i s hereby |
---|
207 | 197 | | declared to exist, by reason whereof thi s act shall take effect and |
---|
208 | 198 | | be in full force from and after its pas sage and approval. |
