5851 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5952 SECTION 1. NEW LAW A new section of law to be codified
6053 in the Oklahoma Statutes as Section 24-100.9 of Title 70, unless
6154 there is created a duplication in numbering, reads as follows:
6255 A. This act shall be known and may be cited as the "Student
6356 Digital Safety and A wareness Act".
57+B. Subject to the availability of funds , public school boards
58+of education shall adopt and implement di gital safety policies to

60+selected pursuant to subsection E of this section to provide a

91-B. Subject to the availability of funds , public school boards
92-of education shall adopt and implement di gital safety policies to
93-enhance digital safet y measures at school and utilize the vendor
94-selected pursuant to subsection E of this section to provide a
9587 digital monitoring platform to ensure complian ce. The policies
9688 shall address the following key components:
9789 1. Filtering and monitoring, which shall include implementation
9890 of real-time filtering and monitoring of internet content accessed
9991 by students to block harmful and inappropriate m aterial, as well as
10092 to identify potential safety threats;
10193 2. Cyberbullying detection, which shall utilize digital safety
10294 solutions to detect and prevent cyberbullying incidents by
10395 monitoring digital communications and onli ne interactions for signs
10496 of bullying or harassment;
10597 3. Self-harm and suicide prevention, which shall deploy
10698 monitoring features that identify online content related to self-
10799 harm or suicide, and enable timely intervention and support for at -
108100 risk students;
109101 4. Threat alerts, which shall identify potentially dangerous
110102 activities or discussions online, and help to prevent school
111103 violence and harm to stude nts; and
112104 5. Monitoring student online behavior, which shall employ
113105 digital safety solutions to monitor an d report online behavior of
114106 students while safeguarding their privacy. The monitoring shall
107+focus on identifying potential risks, cyberbullying, self -harm
108+content, and dangerous activities. The monitoring shall be
109+conducted in English and Spanish.

142-focus on identifying potential risks, cyberbullying, self -harm
143-content, and dangerous activities. The monitoring shall be
144-conducted in English and Spanish.
145136 C. The digital safety policies adopted and implemented pursuant
146137 to subsection B of this section shall:
147138 1. Ensure there is strict data privacy and protecti on measures
148139 in compliance with all applicable laws and regulations. Personally
149140 identifiable information of students shall be safeguarded;
150141 2. Incorporate transparent processes for collecting and using
151142 data with informed consent from parents or guardians of students.
152143 The school shall clearly communicate how data is collected and
153144 utilized for digital safety pu rposes; and
154145 3. Provide parents with the option to manage their student 's
155146 online activity while using school -issued devices at home.
156147 D. Public school districts shall annually report to the
157148 Department of Mental Health and Substance Abuse Services on the
158149 effectiveness of digital safety solutions in enha ncing digital
159150 safety, including data on incidents prevented, interventions made,
160151 and the impact on student well-being. Each school district's annual
161152 report shall be published on the Departme nt's website for public
162153 access.
163154 E. Subject to the availability of funds, the Department shall
164155 issue a request for proposal to select a vendor which will develop
165156 and implement the digital platform to be used by all public schools
157+to adhere to the requirements of the Student Digital Safet y and
158+Awareness Act. The Department shall oversee the selected vendor to
159+ensure it is capable of meeting the requirements of th e Student

193-to adhere to the requirements of the Student Digital Safet y and
194-Awareness Act. The Department shall oversee the selected vendor to
195-ensure it is capable of meeting the requirements of th e Student
196186 Digital Safety and Awareness Act, the request for proposal
197187 application, and any Department poli cies established to implement
198188 the Act, including all data components, digital safety , and privacy
199189 standards. The Department shall ensure all public schools comply
200190 with the Student Digital Safety and Awareness Act, including
201191 reviewing the schools' adopted policies and procedures and ensuring
202192 adherence to digital safety and privacy standards and utilization of
203193 the selected vendor.
204194 SECTION 2. This act shall become effective July 1, 2024.
205195 SECTION 3. It being immediately necessary for the preservation
206196 of the public peace, health or safety, an emergency i s hereby
207197 declared to exist, by reason whereof thi s act shall take effect and
208198 be in full force from and after its pas sage and approval.
