2857 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3058 SECTION 1. AMENDATORY Section 2, Chapter 123, O.S.L.
3159 2022 (43A O.S. Supp. 2023, Section 10-115), is amended to read as
3260 follows:

3461 Section 10-115. A. In coordination with the District Attorneys
3562 Council, each district attorney may develop a multidisciplinary team
3663 for the investigation and prosecution of crimes committed against
3764 the elderly or vulnerable adults in each county of the district
3865 attorney or in a contiguous group of counties. The lead agency for
3966 the team shall be chosen by the members of the team. The team shall

4094 intervene in reports involving sexual abuse, abuse, neglect, or
4195 exploitation of an elderly person or vulnerable adult as defined in
4296 Section 10-103 of Title 43A of the Oklahoma Statutes this title.

4497 B. The multidisciplinary elderly and vulnerable adult abuse
4598 team members shall include, but not be limited to:

4799 1. Mental health professionals licensed pursuant to the laws of
48100 this state or licensed professional c ounselors;

50101 2. Police officers or other law enforcement agents whose duties
51102 include, or who have experience or training in, elder and vulnerable
52103 adult abuse and neglect investigation;

54104 3. Medical personnel with experience in elder and vulnerable
55105 adult abuse and neglect identification;
56-
57106 4. Adult Protective Services, Office of Client Advocacy, and
58107 long-term care workers within the Department of Human Services;
59-
60108 5. Multidisciplinary elder and vulnerable adult abuse team
61109 coordinators; and
62-
63110 6. The district attor ney or assistant district attorney.

65111 C. 1. Subject to the availability of funds and resources, the
66112 functions of the team shall include, but not be limited to:

68113 a. whenever feasible, joint investigations by law
69114 enforcement and Adult Protective Services, Office of
70115 Client Advocacy, or long -term care staff to
71116 effectively respond to reports of abuse against
72117 elderly or vulnerable adult victims,

74145 b. the development of a written protocol for
75146 investigation of sexual abuse, abuse, neglect, or
76147 exploitation cases of eld erly or vulnerable adults and
77148 for the interview of victims to ensure coordination
78149 and cooperation between all agencies involved. Such
79150 protocol shall include confidentiality statements and
80151 interagency agreements signed by member agencies that
81152 specify the cooperative effort of the member agencies
82153 to the team,

84154 c. communication and collaboration among the
85155 professionals responsible for the reporting,
86156 investigation, prosecution, and treatment of elderly
87157 and vulnerable adult abuse and neglect cases,
88-
89158 d. elimination of duplicative efforts in the
90-investigation and the prosecut ion of abuse and neglect ENR. H. B. NO. 3317 Page 3
159+investigation and the prosecution of abuse and neglect
91160 cases committed against elderly or vulnerable adult
92161 victims,

94162 e. identification of gaps in service or untapped
95163 resources within the community to improve the delivery
96164 of services to the victim and family,

98165 f. development of expertise through training. Each team
99166 member and those conducting investigations and
100167 interviews of elder or vulnerable adult abuse victims
101168 shall be trained in the multidisciplinary team

102196 approach, conduction of legally sound developmentally
103197 and age-appropriate interviews, effective
104198 investigation techniques and joint investigations as
105199 provided through the State Department of Health, the
106200 District Attorneys Council, the Department of Human
107201 Services, or other resources . At least one team
108202 member or those conducting investigations and
109203 interviews of elder or vulnerable adult abuse victims
110204 shall complete dementia -specific training on
111205 Alzheimer's disease and related dementia that includes
112206 one or more of the followi ng:

114207 (1) communication skills ,
115-
116208 (2) problem-solving with challen ging behaviors, or
117-
118209 (3) explanation of Alzheimer 's disease and other
119210 dementia,

121211 g. formalization of a case review process and provision
122212 of data as requested, and
123-
124213 h. standardization of investigative procedures for the
125214 handling of elderly and vulnerable adult abuse and
126215 neglect cases.

128216 2. Any investigation or interview related to sexual abuse,
129217 abuse, or neglect of elderly or vulnerable adults shall be conducted
130218 by appropriate personnel using the proto cols and procedures
131219 specified in this se ction.

133247 3. If trained personnel are not available in a timely manner
134248 and if a law enforcement officer or the Department of Human Services
135-determines that there is reasonable cause to believe a delay in ENR. H. B. NO. 3317 Page 4
249+determines that there is reasonable cause to believe a delay in
136250 investigation or interview of a victim could place the victim's
137251 health or welfare in danger of harm or threatened harm, the
138252 investigation may proceed without full participation of all
139253 personnel, but only for as long as the danger to the victim exists.
140254 The Department of Human Services shall make a reasonable effort to
141255 find and provide a trained investigator or interviewer.

143256 D. A multidisciplinary elder or vulnerable adult abuse team
144257 shall have full access to any service or treatment plan and any
145258 personal data known to the Department of Human Services that is
146259 directly related to the implementation of the requirements of this
147260 section.

149261 E. Each member of the team shall protect the confidentiality of
150262 the elderly or vulnerable adult and any information made available
151263 to the team member. The multidisciplinary team a nd any information
152264 received by the team shall be exempt from the Oklahoma Open Meeting
153265 Act and the Oklahoma Open Records Act.
