1445 An Act relating to schools; amending 70 O.S. 2021,
1546 Sections 1210.196.4 and 1210.196.8, which relate to
1647 the Diabetes Management in Schools Act; authorizing
1748 certain health professionals to download student
1849 glucose monitoring numbers with written permission;
1950 providing an exception from monitoring numbers
2051 outside of school hours and activities ; excluding
2152 disciplinary actions; and declaring an emergency.

2857 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3058 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.196.4,
3159 is amended to read as follows:

3360 Section 1210.196.4 A. The school nurse at each school in which
3461 a student with diabetes is enrolled shall assist the student with
3562 the management of their diabetes care as provided for in the
3663 diabetes medical management plan for the student.

3864 B. If a school does not have a school nurse assigned to the
3965 school, the principal shall make an e ffort to seek school employees

4597 C. Each school in which a student with diabetes is enrolled

98+shall make an effort to ensure that a school nurse or a volunteer
4799 diabetes care assistant is available at the school to assist the

50101 D. A school employee shal l not be subject to any penalty or
51102 disciplinary action for refusing to serve as a volunteer diabetes
52103 care assistant.

54104 E. A school district shall not restrict the assignment of a
55105 student with diabetes to a particular school site based on the
56106 presence of a school nurse, contract school employee, or a volunteer
57107 diabetes care assistant.

59108 F. Each school nurse and volunteer diabetes care assistant
60109 shall at all times have access to a physician.

62110 G. For students with continuous glucose m onitoring with
63111 electronic access to glucose numbers, a school nurse, diabetes care
64112 assistant, or other school staff may download the necessary
65113 electronic applications or software to a school electronic device or
66114 their personal electronic device, in the abs ence of a school-
67115 provided device, with written permission from the student 's parent
68116 or guardian.

70144 SECTION 2. AMENDATORY 70 O.S. 2021, Section 1210.196.8,

73146 Section 1210.196.8 A. A school employee may not be subject to
74147 any disciplinary proceeding resulting from an action taken in
75148 compliance with the Diabetes Management in Schools Act. Any
76149 employee acting in accordance with the provisions of the act shall
77150 be immune from civil liability unless the action s of the employee
78151 rise to a level of reckless or intentional misconduct.

80152 B. A school nurse shall not be responsible for and shall not be
81153 subject to disciplinary action for actions performed by a volunteer
82154 diabetes care assistant.

84155 C. A school nurse, diabe tes care assistant, or other school
85156 staff shall not be responsible for and shall not be subject to
86157 disciplinary action for lack of any monitoring of electronic glucose
87158 numbers outside of school hours or school -sponsored activities.

89159 SECTION 3. It being immediately necessary for the preservation
90-of the public peace, health or safety, an emergency is hereby ENR. H. B. NO. 3327 Page 3
