28	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

30	58		SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.196.4,
31	59		is amended to read as follows:
32		-
33	60		Section 1210.196.4 A. The school nurse at each school in which
34	61		a student with diabetes is enrolled shall assist the student with
35	62		the management of their diabetes care as provided for in the
36	63		diabetes medical management plan for the student.

38	64		B. If a school does not have a school nurse assigned to the
39	65		school, the principal shall make an e ffort to seek school employees
40	66		who may or may not be health care professionals to serve as

45	97		C. Each school in which a student with diabetes is enrolled

47	99		diabetes care assistant is available at the school to assist the
48	100		diabetic student when needed .

50	101		D. A school employee shal l not be subject to any penalty or
51	102		disciplinary action for refusing to serve as a volunteer diabetes
52	103		care assistant.

54	104		E. A school district shall not restrict the assignment of a
55	105		student with diabetes to a particular school site based on the
56	106		presence of a school nurse, contract school employee, or a volunteer
57	107		diabetes care assistant.

59	108		F. Each school nurse and volunteer diabetes care assistant
60	109		shall at all times have access to a physician.

62	110		G. For students with continuous glucose m onitoring with
63	111		electronic access to glucose numbers, a school nurse, diabetes care
64	112		assistant, or other school staff may download the necessary
65	113		electronic applications or software to a school electronic device or
66	114		their personal electronic device, in the abs ence of a school-
67	115		provided device, with written permission from the student 's parent
68	116		or guardian.

70	144		SECTION 2. AMENDATORY 70 O.S. 2021, Section 1210.196.8,
71	145		is amended to read as follows:

73	146		Section 1210.196.8 A. A school employee may not be subject to
74	147		any disciplinary proceeding resulting from an action taken in
75	148		compliance with the Diabetes Management in Schools Act. Any
76	149		employee acting in accordance with the provisions of the act shall
77	150		be immune from civil liability unless the action s of the employee
78	151		rise to a level of reckless or intentional misconduct.

80	152		B. A school nurse shall not be responsible for and shall not be
81	153		subject to disciplinary action for actions performed by a volunteer
82	154		diabetes care assistant.

84	155		C. A school nurse, diabe tes care assistant, or other school
85	156		staff shall not be responsible for and shall not be subject to
86	157		disciplinary action for lack of any monitoring of electronic glucose
87	158		numbers outside of school hours or school -sponsored activities.

89	159		SECTION 3. It being immediately necessary for the preservation
