5263 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5364 SECTION 1. NEW LAW A new section of law to be codified
5465 in the Oklahoma Statutes as Section 1-116.4 of Title 70, unless
5566 there is created a duplication in numbering, reads as follows:
5667 A. As used in this section, "menstrual products" means tampons
5768 and sanitary napkins for use in connection with the menstrual cycle
5869 that conform with applicable industry standards.
59-B. Every public school or charter school in th e state with
60-grades below grade six shall make menstrual products available at no
61-cost to students, in at least one neutral location that is easily
62-accessible to all stude nts and does not stigmatize any student

97+B. Every public school or charter school in th e state with
98+grades below grade six shall make menstrual products available at no
99+cost to students, in at least one neutral location that is easily
100+accessible to all stude nts and does not stigmatize any student
89101 seeking the products, such as a school nurse 's office or
90102 administrative office, as appr opriate.
91103 C. Every public school or charter school in the state with
92104 grades six through twelve shall make menstrual products avai lable at
93105 no cost to students, in easily accessible locations that do not
94106 stigmatize any student seeking such products, including in the
95107 school bathrooms. This shall include all f emale, single-use, and
96108 standalone handicapped bathrooms accessed b y students in grades six
97109 through twelve, as well as a neutral location, such as a school
98110 nurse's office or administrative office, as appro priate.
99111 D. Every school district board of education and public charter
100112 school governing board shall adopt policies and procedures:
101113 1. To ensure menstrual products are available and provided at
102114 no cost to all students who need them. The policies shall include a
103115 process by which students can provide grieva nces or other complaints
104116 about lack of access to or quality of m enstrual products; and
105117 2. To inform students of the availability of menstrual products
106118 as provided in this section by including the policies and procedure s
107119 adopted pursuant to this section in any student handbook and posting
108120 the policies and procedures on school websites and locations in the
109-school where notices are commonly posted, including student
110-bathrooms and school nurses' offices.
111-E. No later than thirty (30) days following the end of each
112-fiscal year, every school district and charter school shall submit a

148+school where notices are commonly posted, including student
149+bathrooms and school nurses' offices.
150+E. No later than thirty (30) days following the end of each
151+fiscal year, every school district and charter school shall submit a
139152 report to the State Department of Education containing the number of
140153 menstrual products purchased in the preceding fiscal year, the
141154 number of menstrual products distributed to students in the
142155 preceding year, and any grievances or other complaints about lac k of
143156 access to or quality of menstrual products. The reports shall be
144157 made available for public inspection.
145158 F. The State Board of Education sha ll promulgate rules to
146159 implement the provisions of this section.
147160 SECTION 2. This act shall be come effective November 1, 2024.
