114 | 152 | | 3. "Pharmacy" means a pharmacy licensed by the Oklahoma State |

115 | 153 | | Board of Pharmacy, except that patients who are provided pharmacy |

116 | 154 | | care shall be physically located in the state; and |

117 | 155 | | 4. "Pharmacy benefit manager " means a person that performs |
---|
118 | 156 | | pharmacy benefits management and any other person acting for such |
---|
119 | 157 | | person under a contractual or employment relationship in the |

120 | 158 | | performance of pharmacy benefits m anagement for a managed care |

321 | 455 | | to contract with a 340B entity for reasons other than |

322 | 456 | | those that apply equally to non -340B entities. |

357 | 515 | | A. A manufacturer or distributor shall not deny, re strict, |

358 | 516 | | prohibit, or otherwise interfere with, either direc tly or |
---|
359 | 517 | | indirectly, the acquisition of a 340B drug by, or delivery of a 340B |

360 | 518 | | drug to, a pharmacy that is under contract with a 340B entity and is |

361 | 519 | | authorized under such contract to receive and dispen se 340B drugs on |

362 | 520 | | behalf of the covered entity unless such r eceipt is prohibited by |

364 | 522 | | B. A manufacturer or distributor shall not interfere with a |

---|
366 | 524 | | SECTION 5. NEW LAW A new section of law to be co dified |
---|
367 | 525 | | in the Oklahoma Statutes as Section 5404 of Title 36, unless there |

368 | 526 | | is created a duplication in numbering, reads as follows: |
