5958 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6059 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3-151.1, is
6160 amended to read as follows:
6261 Section 3-151.1 A. For purposes of establishing a uniform and
6362 accurate definition of high school graduation rate f or school
6463 districts and secondary schools in the state, the State Board of
6564 Education shall adopt and implement a four -year adjusted cohort
6665 graduation rate and an extended-year adjusted cohort graduation
6766 rate. The Board shall utilize and report the four -year adjusted

9694 graduation rate at the secondary school site, the school district
9795 and the state level, and the graduation rates shall be reported in
9896 the aggregate as well as disaggregated by subgroup s as required in
9997 the Elementary and Secondary Education Act of 2001 (ESEA), P .L. No.
10098 107-110, also known as the No Child Left Behind Act of 2001.
10199 B. The Board shall use the four -year adjusted cohort graduation
102100 rate for purposes of determining the high sch ool graduation rate
103101 indicator for the academic performance data calculation b eginning
104102 with state and district report cards providing results of
105103 assessments administered in the 2011 -2012 school year. The Board
106104 shall use the four-year adjusted cohort gradua tion rate for
107105 establishing the high school graduation rate for measuring alte rnate
108106 year percentage growth targets as set forth in Section 3 -151.2 of
109107 this title beginning with the 2012 -2013 school year.
110108 C. The four-year adjusted cohort graduation rate shal l be
111109 defined as the numbe r of students who graduate in four (4) years
112110 with a standard high school diploma divided by the number of
113111 students who entered high school four (4) years earlier , adjusted
114112 for transfers. Students who transfer in and out of the sch ool,
115113 émigrés emigrate to another country, and deceased students shall not
116114 be included in the adjusted cohort graduation rate . Students who
117115 graduate in four (4) years shall include students who earn a
118116 standard high school diploma at the end of their fourth year, before

147144 immediately following their fourth year. To remove a student from a
148145 cohort, a school district shall confirm in writing or by electronic
149146 means that a student has transferred out of the school site or
150147 school district, has emigrated to another country , or is deceased.
151148 For a student who transfers out of a school site or school dis trict,
152149 the written or electronic confirmation sha ll be official and
153150 document that the student has enrolled in another school site or
154151 school district or in an educational program that culm inates in a
155152 high school diploma recognized by a state or private high er
156153 educational institution accredited or recogniz ed by the Oklahoma
157154 State Regents for Higher Education for pur poses of admission to the
158155 institution. Students who are not enrolled in a pr ogram which
159156 culminates in the award of a credential recognized by a state or
160157 private higher educational institution for purpos es of admissions
161158 shall not be included in the graduat ion rate calculation as s et
162159 forth in this subsection as a student who graduat ed in four (4)
163160 years with a standard high school diploma but shall be included in
164161 the number of students who entered high scho ol four (4) years
165162 earlier.
166163 D. The extended-year adjusted cohort graduation ra te shall be
167164 defined as the number of students who gr aduate in four (4) years or
168165 five (5) years with a high school diploma divided by the number of
169166 students who form the adjusted cohort for the four-year graduation

202198 extended-year adjusted cohort graduation rate shall be reported
203199 separately from the four -year adjusted cohort graduation rate.
204200 SECTION 2. AMENDATORY 70 O.S. 2021, Section 1210.5 45, is
205201 amended to read as follows:
206202 Section 1210.545 A. Except as otherwise provided, as part of
207203 the accountability system developed as provided for in Section
208204 1210.541 of this title, the State Board of Education shall prepare
209205 annual reports of the results of the Oklahoma School Testing Program
210206 which describe student achievement i n the state, and each school
211207 site, pursuant to the Elementary and Sec ondary Education Act of 1965
212208 (ESEA) as reauthorized by P.L. No. 114 -95, also known as the Every
213209 Student Succeeds Act (ESSA), and any r elated federal regulations.
214210 B. The annual report as required pursuant to subsection A of
215211 this section shall identify scho ol sites as having one of the
216212 following grades for each indicator, separately, and by a single
217213 overview grade of all indicators, defin ed according to rules of the
218214 State Board of Education :
219215 1. "A" means schools making excellent progress;
220216 2. "B" means schools making above average progress;

248243 3. "C" means schools making satisfactory progress;
249244 4. "D" means schools making less than satisfac tory progress;

252247 C. Each school that has students who are test ed and included in
253248 the school grading system as provided for in this section shall
254249 receive a school grade, except as follows:
255250 1. A school shall not receive a school grade if the number o f
256251 students tested and included in the school grading system is less
257252 than the minimum sample size necessary for statistical reliability
258253 and prevention of the unlawful re lease of personally identifiable
259254 student data. The State Board of Education is directed to establish
260255 the lowest minimum sample size necessary to meet the re quirements of
261256 this paragraph; and
262257 2. The academic performance of students who are enrolled full -
263258 time in an online program that is off ered by a school district or
264259 charter school that is n ot the district of residence or is not
265260 located in the district of res idence of the student shall be
266261 reported separately by the school district or charter school and
267262 shall not be included when determining the grade of the school site
268263 or charter school.
269264 D. The State Board of Education may adopt alternate systems of
270265 accountability for statewide virtual charter schools, alternative
271266 education programs as defined in Section 1 210.568 of this title, and

301295 E. The grade of a school shall be based on a multimeasur es
302296 approach to accountability in accordance with the Elementary and
303297 Secondary Education Act of 1965 (ESEA) as reauthorized by P.L. No.
304298 114-95, also known as the Every Student Succeeds Act (ESSA) and any
305299 federal regulations that include, but are not limited to, the
306300 following indicators:
307301 1. Statewide assessments, including the establishment of
308302 student performance bands;
309303 2. Graduation rates for high schools;
310304 3. Statewide academic measures for elementary and middle
311305 schools;
312306 4. English language proficiency f or English learners; and
313307 5. At least one additional statewide measure of school quality
314-or student success, including, but not limited to, school climate ,
315-school safety, student engagement, educator engagement, and/or
316-advanced coursework and postsecondary readiness. Chronic
317-absenteeism shall not be included as any statewide measure of school
318-quality or student success.

372363 shall adopt a time line for moving from completion of such
373364 opportunities to crediting achievement of such opportunities.

401-I. The annual report shall identify the performance of each
402-school as having improve d, remained the same, or declined. This
403393 school improvement rating shall be based on a comparison of th e
404394 student and school performance data of the current year to the
405395 previous year data.
406396 J. The State Department of Education shall annually develop a
407397 school site report card to be del ivered to parents throug hout each
408398 school district. The report card shall b e in accordance with the
409399 requirements of the Elementary and Secondary E ducation Act of 1965
410400 (ESEA), as reauthorized and amended by P.L. No. 114 -95, also known
411401 as the Every Student S ucceeds Act (ESSA) and i ncludes the grade for
412402 the school, information regar ding school improvement, an explanation
413403 of school performance, and indi cators of return on investment. The
414404 report card for each school site shall be published annually by the
415405 Department on its website, an d every school district shall provide
416406 the school site report card to the parent or guardian of each
417407 student enrolled in th e school site. In order to provide
418408 information regarding school performance for school r eport cards
419409 issued during the 2016-2017 and 2017-2018 school year, the
420410 Department shall include an explanation of the changes to the
421411 statewide system of student assess ments as required in Section
422412 1210.508 of this title and how the transition in assessments may
423413 impact school performance. The Departme nt shall issue school report
414+cards using the 2016 -2017 school year assessment data that is
415+available.

453442 K. The Legislature may factor in the performance of schools in
454443 calculating any performance -based funding policy that is provided to
455444 public school distric ts.
456445 L. The State Board of Education shall promulga te rules to
457446 implement the provisions of this section.
