27160 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29161 SECTION 1. AMENDATORY 26 O.S. 2021, Section 12 -108, is
30162 amended to read as follows:

32163 Section 12-108. A. Such proclamation shall contain the
33164 following facts:

35165 1. A filing period of three (3) days, on a Monday, Tuesday and
36166 Wednesday not less than ten (10) days from the date of such
37167 proclamation;

39168 2. The date of the Special Primary Election, not less than
40169 twenty (20) thirty (30) days after the close of the filing period;

43221 3. The date of the Special Runoff Primary Election, not less

73294 Section 12-109. Said elections shall be conducted un der the
74295 laws applicable to regular Primary , Runoff Primary, and General
75296 Elections, except that the candidate receiving the highest number of
76297 votes in said Primary Election shall be deemed the nominee of his
77298 political party, provided that the dates of the e lections do not
78299 coincide with the dates for the regular Primary, Runoff Primary a nd
79300 General Elections. If the nominee of a political party is unopposed
80301 in the Special Election, he shall be issued a certificate of
81302 election after the expiration of the conte st period following the
82303 Primary or Runoff Primary Election, if no contest is file d, and.
83304 Unless otherwise provided by law, the candidate elected to the
84305 office shall immediately assume the duties of said office upon the
85306 certification of the election by the State Election Board.

87307 SECTION 3. AMENDATORY 26 O.S. 20 21, Section 14-118, is

90309 Section 14-118. A. 1. When an application for an absentee

93312 county election board, it shall be the duty of the secretary to
94313 transmit by United States mail, by facsimile device as defined in
95314 Section 1862 of Title 21 of the Oklahoma Statutes, or a s provided in

99367 2. When an application f or an absentee ballot is received at
100368 least forty-five (45) days before an a regular election involving
101369 state offices or a regular or special election involving federal
102370 offices, the absentee ballot shall be transmitted by mail, by
103371 electronic mail, or by oth er means of electronic communication, as
104372 provided in this section, or by facsimile device as provided in
105373 Section 14-118.1 of this title, not less than forty -five (45) days
106374 preceding the election.

108375 3. When an application for an absentee ballot for an a regular
109376 election involving state offices or a regular or special election
110377 involving federal offices is received less tha n forty-five (45) days
111378 preceding the election, the absentee ballot shall be trans mitted by
112379 mail, by electronic mail, or by other means of electronic
113380 communication, as provided in this section, or by facsimile device
114381 as provided in Section 14 -118.1 of this title, within forty-eight
115382 (48) hours of receipt of the application.

117383 4. When an application for an absentee ballot is received for a
118384 special election involving state offices, the absentee ballot shall
119385 be transmitted by mail, by electronic mail, or by other means of
120386 electronic communication, as provided in this section, or by
121387 facsimile device as provided in Section 14-118.1 of this title, as

124440 B. The secretary of the county election board may transmit
125441 balloting materials for any state or federal election, or for any
126442 other election as designated by the Secretary of the State Election
127443 Board as provided in subsection D of this section, by electronic
128444 mail or by other means of electronic communication in a fo rm and
129445 manner prescribed by the Secretary of the State Election Board, if
130446 the voter:

132447 1. Is a Federal Post Card Application registrant and is
133448 eligible to receive an absentee ballot as provided by law;

135449 2. Provides an electronic mail address; and

137450 3. Requests that balloting materials be sent by electronic
138451 mail.

140452 If the secretary of the c ounty election board transmits a ballot
141453 to a voter by electronic mail or by other means of electronic
142454 communication as provided in this subsection, the secretary shall
143455 amend the voter's federal postcard application for future elections
144456 to include the voter 's electronic mail address.

146457 C. An electronic mail address provided under this section is
147458 confidential and does no t constitute public information for purposes
148459 of the Oklahoma Open Records Act. The secretary of the county
149460 election board shall ensure that a n electronic mail address provided
150461 under this section is excluded from disclosure.

152462 D. The Secretary of the State Election Board shall determine if
153463 balloting materials for any election other than a state or federal

154514 election may be produced in a form which would allow them to be
155515 transmitted by electronic mail or b y other means of electronic
156516 communication. If so, the S ecretary shall so designate them. If
157517 such designation is not made, the balloting materials may be
158518 transmitted to the voter as provided in sub section A of this
159519 section.

161520 E. All other provisions of this title that would normally apply
162521 to a ballot voted under this title apply to a ballot provided
163522 pursuant to the provi sions of subsection B of this section.

165523 F. The Secretary of the State Election Bo ard may suspend the
166524 provisions of subsection B of this sec tion if the Secretary
167525 determines that electronic transmi ssion of balloting materials is
168526 not in the best interest of t he people of this state due to a
169527 potential problem with the security of the ballo ting materials.

171528 SECTION 4. This act shall become effecti ve November 1, 2024.
