8181 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 10 O.S. 2021, Section 404, is
8383 amended to read as follows:
8484 Section 404. A. 1. The Department of Human Services, in
8585 consultation with the Oklahoma Commission on Children and Youth,
8686 shall appoint advisory committees of representatives of licensed
8787 child care facilities and others to recommend:
8888 a. recommend and prepare minimum requirements and
8989 desirable standards for promulgation by the

142142 b. provide advice, recommendations , and guidance
143143 regarding concerns brough t by child care facilities or
144144 referred by the Department to assist facilities in
145145 meeting minimum requirements .
146146 2. Committee members shall be appointed for a three-year term,
147147 with a two-consecutive-term limit terms per the advisory co mmittee
148148 bylaws. A majority of any committee appointed to prepare
149149 requirements and standards for child care faciliti es shall be
150150 representatives of the type of licensed child care programs that are
151151 the subject of the requirements and standards . The committees shall
152152 include representation for all categories of facilities licensed by
153153 the Department and shall be comprised as follows:
154154 a. the Residential Children's Services subcommittee shall
155155 include at a minimum:
156156 (1) a representative of a statewide organization
157157 representing children in care arrangements
158158 outside their own home,
159159 (2) a representative of a statewide organization
160160 providing residential services to youth in state
161161 custody,
162162 (3) a recipient or former rec ipient of youth services
163163 for children in state custo dy,
164164 (4) a representative of a statewide organizatio n

441441 d. the Quality Rating and Improvement System s ubcommittee
442442 shall include representatives of child care centers
443443 and child care homes currently licensed by the State
444444 and other members as determined by the Department of
445445 Human Services and the Commission on Children and
446446 Youth.
447447 3. The Department shall crea te a Child Care Facility Peer
448448 Review Board whose purpose shall be to p articipate in the
449449 Department's grievance process. A majority of the Board shall be
450450 representatives of child care facilities. The Department shall
451451 promulgate rules specifying the duties of the Child Care Facility
452452 Peer Review Board in the grievance process .
453453 4. The child care advisory committee shall design ate two people
454454 three advisory committee members to serve on the Department 's Stars
455455 Administrative Review Panel. At least one designee two designees
456456 shall be the owner owners or operator operators of a licensed child
457457 care center.
458458 B. Child care facilities shall not allow children to be left
459459 alone in the care of any person under eighteen (18) years of age
460460 without supervision or si xteen (16) years of age with supervision as
461461 delineated by the Department 's rules. Child care c enters and family
462462 child care homes shall not:

514514 1. Use soft or loose bedding, including, but not limited to,
515515 blankets, in sleeping equipment or in sleeping areas used only for
516516 infants;
517517 2. Allow toys or educational devices in sleeping equipment or
518518 in a sleeping area used only for infants; or
519519 3. Place a child in sleeping equipment or in a sleeping area
520520 which has not been previously approved for use as such by the
521521 Department.
522522 C. The Department shall promulgate rules establishing minimum
523523 requirements and desi rable standards as may be deemed ne cessary or
524524 advisable to carry out the provisions of the Oklahoma Child Care
525525 Facilities Licensing Act.
526526 D. Such rules shall not be promulgated until after consultation
527527 with the State Department of Health, the State Departm ent of
528528 Education, the Oklahoma Stat e Bureau of Investigation, the State
529529 Fire Marshal, the Commission on Children and Youth, the Oklahoma
530530 Department of Mental Hea lth and Substance Abuse Services, the Office
531531 of Juvenile Affairs, the Governor -appointed State Advisory Council,
532532 and any other agency deemed necessary by the Department. Not less
533533 than sixty (60) days ' notice, by regular mail, shall be given to all
534534 current licensees before any changes are made in such rules.
535535 E. In order to improve th e standards of child care, the
536536 Department shall advise and cooperate with licensees, the governing
537537 bodies and staff of licensed child care facilities and assist the

590590 suggestions for the improve ment of services.
591591 F. The Department may participa te in federal programs for child
592592 care services, and enter into agreements or plans on behalf of the
593593 state for that purpose, in accorda nce with federal laws and
594594 regulations.
595595 SECTION 2. It being immediate ly necessary for the preservation
596596 of the public peace, health or safety, an emergency is hereby
597597 declared to exist, by reason whereof this act shall take effect and
598598 be in full force from and after its passage an d approval.
