81	81	BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
82	82	SECTION 1. AMENDATORY 10 O.S. 2021, Section 404, is
83	83	amended to read as follows:
84	84	Section 404. A. 1. The Department of Human Services, in
85	85	consultation with the Oklahoma Commission on Children and Youth,
86	86	shall appoint advisory committees of representatives of licensed
87	87	child care facilities and others to recommend:
88	88	a. recommend and prepare minimum requirements and
89	89	desirable standards for promulgation by the

143	143	regarding concerns brough t by child care facilities or
144	144	referred by the Department to assist facilities in
145	145	meeting minimum requirements .
146	146	2. Committee members shall be appointed for a three-year term,
147	147	with a two-consecutive-term limit terms per the advisory co mmittee
148	148	bylaws. A majority of any committee appointed to prepare
149	149	requirements and standards for child care faciliti es shall be
150	150	representatives of the type of licensed child care programs that are
151	151	the subject of the requirements and standards . The committees shall
152	152	include representation for all categories of facilities licensed by
153	153	the Department and shall be comprised as follows:
154	154	a. the Residential Children's Services subcommittee shall
155	155	include at a minimum:
156	156	(1) a representative of a statewide organization
157	157	representing children in care arrangements
158	158	outside their own home,
159	159	(2) a representative of a statewide organization
160	160	providing residential services to youth in state
161	161	custody,
162	162	(3) a recipient or former rec ipient of youth services
163	163	for children in state custo dy,
164	164	(4) a representative of a statewide organizatio n
165	165	promoting adoption services,

232	232	b. the Child Care Centers subcommittee shall include at a
233	233	minimum:
234	234	(1) a representative of a statewide organization
235	235	advocating for children in care arrangements
236	236	outside their own home,
237	237	(2) a representative of a statewide organization
238	238	conducting programs for school -age children,
239	239	(3) a parent or guardian with a child attending a
240	240	licensed child care facility,

441	441	d. the Quality Rating and Improvement System s ubcommittee
442	442	shall include representatives of child care centers
443	443	and child care homes currently licensed by the State
444	444	and other members as determined by the Department of
445	445	Human Services and the Commission on Children and
446	446	Youth.
447	447	3. The Department shall crea te a Child Care Facility Peer
448	448	Review Board whose purpose shall be to p articipate in the
449	449	Department's grievance process. A majority of the Board shall be
450	450	representatives of child care facilities. The Department shall
451	451	promulgate rules specifying the duties of the Child Care Facility
452	452	Peer Review Board in the grievance process .
453	453	4. The child care advisory committee shall design ate two people
454	454	three advisory committee members to serve on the Department 's Stars
455	455	Administrative Review Panel. At least one designee two designees
456	456	shall be the owner owners or operator operators of a licensed child
457	457	care center.
458	458	B. Child care facilities shall not allow children to be left
459	459	alone in the care of any person under eighteen (18) years of age
460	460	without supervision or si xteen (16) years of age with supervision as
461	461	delineated by the Department 's rules. Child care c enters and family
462	462	child care homes shall not:

514	514	1. Use soft or loose bedding, including, but not limited to,
515	515	blankets, in sleeping equipment or in sleeping areas used only for
516	516	infants;
517	517	2. Allow toys or educational devices in sleeping equipment or
518	518	in a sleeping area used only for infants; or
519	519	3. Place a child in sleeping equipment or in a sleeping area
520	520	which has not been previously approved for use as such by the
521	521	Department.
522	522	C. The Department shall promulgate rules establishing minimum
523	523	requirements and desi rable standards as may be deemed ne cessary or
524	524	advisable to carry out the provisions of the Oklahoma Child Care
525	525	Facilities Licensing Act.
526	526	D. Such rules shall not be promulgated until after consultation
527	527	with the State Department of Health, the State Departm ent of
528	528	Education, the Oklahoma Stat e Bureau of Investigation, the State
529	529	Fire Marshal, the Commission on Children and Youth, the Oklahoma
530	530	Department of Mental Hea lth and Substance Abuse Services, the Office
531	531	of Juvenile Affairs, the Governor -appointed State Advisory Council,
532	532	and any other agency deemed necessary by the Department. Not less
533	533	than sixty (60) days ' notice, by regular mail, shall be given to all
534	534	current licensees before any changes are made in such rules.
535	535	E. In order to improve th e standards of child care, the
536	536	Department shall advise and cooperate with licensees, the governing
537	537	bodies and staff of licensed child care facilities and assist the

591	591	F. The Department may participa te in federal programs for child
592	592	care services, and enter into agreements or plans on behalf of the
593	593	state for that purpose, in accorda nce with federal laws and
594	594	regulations.
595	595	SECTION 2. It being immediate ly necessary for the preservation
596	596	of the public peace, health or safety, an emergency is hereby
597	597	declared to exist, by reason whereof this act shall take effect and
598	598	be in full force from and after its passage an d approval.
