6764 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6865 SECTION 1. NEW LAW A new section of law to be codified
6966 in the Oklahoma Statutes as Section 15-133 of Title 47, unless there
7067 is created a duplication in numbering, reads as follows:

9995 1. "Automatic license plate reader system " means a system of
10096 one or more fixed or mobile cameras combined with computer
10197 algorithms to convert images of license plates and vehicles into
10298 computer-readable data; and
10399 2. "Highway rights-of-way" means the state and interstate
104100 highway systems being maintained by the Oklahoma Department of
105101 Transportation.
106102 B. 1. Except as provided in Sections 7 -606.1 and 7-606.2 of
107103 Title 47 of the Oklahoma Statutes, operation of and access to an
108104 automatic license plate reader system by law enforcement shall be
109105 for official law enforcement purposes only, and shall only be used
110106 to scan, detect, and identify vehicles and license plate numbers for
111107 the purpose of identifying:
112108 a. stolen vehicles,
113109 b. vehicles involved in an active investigation,
114110 c. vehicles associated with wanted, missing, or
115111 endangered persons, or
116112 d. vehicles that register as a match within the National
117113 Crime Information Center and any other relevant
118114 federal, state, or local databases.
119115 Other than as provided in Section 7-606.1 and 7-606.2 of Title 47 of
120116 the Oklahoma Statutes, automatic license plate readers shall not be
121117 used to enforce state or local traffic violations or issue citations
122118 for such violations.

150145 2. Prior to using an automatic license plate reader system, the
151146 municipal or state law enforcement agency that intends to use the
152147 technology shall:
153148 a. confirm that the automatic license plate reader system
154149 meets all requirements of this section,
155150 b. establish a policy governing its use in accorda nce
156151 with this section that includes a training process for
157152 the officers that will use it and an auditing schedule
158153 to ensure proper use, and
159154 c. obtain a permit from the Departm ent before installing
160155 an automatic license plate reader system on a state or
161156 interstate highway. The Department shall issue
162157 permits to law enforcement agencies that mee t
163158 standards set by the Department.
164159 3. A positive match by an automatic license plate reader system
165160 alone shall not constitute reasonable suspicion as grounds for a law
166161 enforcement officer to stop the vehicle. Prior to stopping a
167162 vehicle based on identification within the automatic license plate
168163 reader system database, the officer shall immediately visually
169164 confirm that the license plate on the vehicle matches the image of
170165 the license plate displayed on the automatic license plate reader
171166 system and that the stop meets criteria la id out in the law
172167 enforcement agency's policies.

200194 4. Records of license plates and vehicles recorded by an
201195 automatic license plate reader system shall be purged from the
202196 database or system within thirty (30) days of their capture in such
203197 a manner that they are destroyed and not recoverable, unless the
204198 record is a part of an ongoing investigation, in which case the data
205199 may be retained until final disposition of the matter in accordance
206200 with applicable records retention laws.
207201 5. Captured license plate data obtained for the purposes
208202 identified in paragraph 1 of this subsection shall not be sold for
209203 commercial or marketing purposes .
210204 C. A law enforcement agency that installs or uses any automatic
211205 license plate reader system , pursuant to this section, shall make
212206 the following information public:
213207 1. A log of its use, to be updated on a monthly basis,
214208 displaying at least the aggregate number of vehicles on which data
215209 was collected for each month of use and a list of all state and
216210 federal databases with which the data were co mpared, unless the
217211 existence of the database itself is not public; and
218212 2. The law enforcement agency’s automatic license plate reader
219213 system policy.
220214 SECTION 2. AMENDATORY 69 O.S. 2021, Section 1208, as
221215 amended by Section 1, Chapt er 335, O.S.L. 2023 (69 O.S. S upp. 2023,
222216 Section 1208), is amended to read as follows:

250243 Section 1208. (a) A. The rights-of-way acquired by the
251244 Department of Transportation or a county shall be held inviolate for
252245 state highway, departmental, or county purposes, and no physical or
253246 functional encroachments or uses shall be permitted within such
254247 rights-of-way.
255248 (b) B. It shall be unlawful for any person to construct,
256249 maintain or operate any gasoline pu mp, driveway canopy, building,
257250 sign, fence, post, or any thing or structure on or overhanging any
258251 right-of-way, or upon or overhanging any street occupied by a
259252 designated state or federal hig hway, or county roads and the
260253 construction or maintaining of any such thing or structure on or
261254 overhanging any federal or state highway or county roads shall
262255 constitute a public nuisance, which may be summarily abated by the
263256 Commission or board of county commissioners or its officers, agents,
264257 servants and employees in t he manner provided in this article.
265258 (c) C. This section shall not apply to the lawful use of such
266259 rights-of-way for the erection and operation of facilities of a
267260 public utility, or companies engaged in the activities defined in
268261 Section 137.1 of Title 52 of th e Oklahoma Statutes.
269262 D. 1. As used in this subsection :
270263 a. "automatic license plate re ader system" means a system
271264 of one or more fixed or mobile cameras combined with
272265 computer algorithms to convert images of license
273266 plates and vehicles into compu ter-readable data, and

301293 b. "highway rights-of-way" means the state and interstate
302294 highway systems maintained by the Oklahoma Department
303295 of Transportation.
304296 2. In accordance with applicable state an d federal laws
305297 governing the use and management of highway righ ts-of-way, and
306298 subject to the approval of the Federal Highway Administration as
307299 required by federal law, license plate reader systems operate d by
308300 law enforcement agencies shall be allowed on highway rights-of-way
309301 for the purpose of aiding in criminal invest igations or searches for
310302 missing or endangered persons to t he extent that such use is
311303 consistent with the continued use, operations, mainten ance, and
312304 safety of the highway facility and does no t interfere with the free
313305 and safe flow of traffic.
314306 SECTION 3. This act shall become effective November 1, 2024.
