103 | 99 | | 2. "Highway rights-of-way" means the state and interstate |

104 | 100 | | highway systems being maintained by the Oklahoma Department of |
---|
105 | 101 | | Transportation. |
---|
106 | 102 | | B. 1. Except as provided in Sections 7 -606.1 and 7-606.2 of |
---|
107 | 103 | | Title 47 of the Oklahoma Statutes, operation of and access to an |
---|
108 | 104 | | automatic license plate reader system by law enforcement shall be |
---|
109 | 105 | | for official law enforcement purposes only, and shall only be used |
---|
110 | 106 | | to scan, detect, and identify vehicles and license plate numbers for |
---|
111 | 107 | | the purpose of identifying: |
---|
112 | 108 | | a. stolen vehicles, |
---|
113 | 109 | | b. vehicles involved in an active investigation, |
---|
114 | 110 | | c. vehicles associated with wanted, missing, or |
---|
115 | 111 | | endangered persons, or |
---|
116 | 112 | | d. vehicles that register as a match within the National |
---|
117 | 113 | | Crime Information Center and any other relevant |
---|
118 | 114 | | federal, state, or local databases. |
---|
119 | 115 | | Other than as provided in Section 7-606.1 and 7-606.2 of Title 47 of |
---|
120 | 116 | | the Oklahoma Statutes, automatic license plate readers shall not be |
---|
121 | 117 | | used to enforce state or local traffic violations or issue citations |
---|

150 | 145 | | 2. Prior to using an automatic license plate reader system, the |
---|
151 | 146 | | municipal or state law enforcement agency that intends to use the |
---|
152 | 147 | | technology shall: |
---|
153 | 148 | | a. confirm that the automatic license plate reader system |
---|
154 | 149 | | meets all requirements of this section, |
---|
155 | 150 | | b. establish a policy governing its use in accorda nce |
---|
156 | 151 | | with this section that includes a training process for |
---|
157 | 152 | | the officers that will use it and an auditing schedule |
---|
158 | 153 | | to ensure proper use, and |
---|
159 | 154 | | c. obtain a permit from the Departm ent before installing |
---|
160 | 155 | | an automatic license plate reader system on a state or |
---|
161 | 156 | | interstate highway. The Department shall issue |
---|
162 | 157 | | permits to law enforcement agencies that mee t |
---|
163 | 158 | | standards set by the Department. |
---|
164 | 159 | | 3. A positive match by an automatic license plate reader system |
---|
165 | 160 | | alone shall not constitute reasonable suspicion as grounds for a law |
---|
166 | 161 | | enforcement officer to stop the vehicle. Prior to stopping a |
---|
167 | 162 | | vehicle based on identification within the automatic license plate |
---|
168 | 163 | | reader system database, the officer shall immediately visually |
---|
169 | 164 | | confirm that the license plate on the vehicle matches the image of |
---|
170 | 165 | | the license plate displayed on the automatic license plate reader |
---|
171 | 166 | | system and that the stop meets criteria la id out in the law |
---|
172 | 167 | | enforcement agency's policies. |

204 | 198 | | record is a part of an ongoing investigation, in which case the data |

205 | 199 | | may be retained until final disposition of the matter in accordance |
---|
206 | 200 | | with applicable records retention laws. |
---|
207 | 201 | | 5. Captured license plate data obtained for the purposes |
---|
208 | 202 | | identified in paragraph 1 of this subsection shall not be sold for |
---|
209 | 203 | | commercial or marketing purposes . |
---|
210 | 204 | | C. A law enforcement agency that installs or uses any automatic |
---|
211 | 205 | | license plate reader system , pursuant to this section, shall make |
---|
212 | 206 | | the following information public: |
---|
213 | 207 | | 1. A log of its use, to be updated on a monthly basis, |
---|
214 | 208 | | displaying at least the aggregate number of vehicles on which data |
---|
215 | 209 | | was collected for each month of use and a list of all state and |
---|
216 | 210 | | federal databases with which the data were co mpared, unless the |
---|
217 | 211 | | existence of the database itself is not public; and |
---|
218 | 212 | | 2. The law enforcement agency’s automatic license plate reader |
---|
219 | 213 | | system policy. |
---|

252 | 245 | | state highway, departmental, or county purposes, and no physical or |

253 | 246 | | functional encroachments or uses shall be permitted within such |
---|
254 | 247 | | rights-of-way. |

255 | 248 | | (b) B. It shall be unlawful for any person to construct, |
---|
256 | 249 | | maintain or operate any gasoline pu mp, driveway canopy, building, |
---|
257 | 250 | | sign, fence, post, or any thing or structure on or overhanging any |
---|
258 | 251 | | right-of-way, or upon or overhanging any street occupied by a |
---|
259 | 252 | | designated state or federal hig hway, or county roads and the |
---|
260 | 253 | | construction or maintaining of any such thing or structure on or |
---|
261 | 254 | | overhanging any federal or state highway or county roads shall |
---|
262 | 255 | | constitute a public nuisance, which may be summarily abated by the |
---|
263 | 256 | | Commission or board of county commissioners or its officers, agents, |
---|
264 | 257 | | servants and employees in t he manner provided in this article. |
---|
265 | 258 | | (c) C. This section shall not apply to the lawful use of such |
---|
266 | 259 | | rights-of-way for the erection and operation of facilities of a |
---|
267 | 260 | | public utility, or companies engaged in the activities defined in |
---|
268 | 261 | | Section 137.1 of Title 52 of th e Oklahoma Statutes. |
---|
269 | 262 | | D. 1. As used in this subsection : |

270 | 263 | | a. "automatic license plate re ader system" means a system |
---|

308 | 300 | | law enforcement agencies shall be allowed on highway rights-of-way |
---|
309 | 301 | | for the purpose of aiding in criminal invest igations or searches for |
---|
310 | 302 | | missing or endangered persons to t he extent that such use is |
---|
311 | 303 | | consistent with the continued use, operations, mainten ance, and |
---|
312 | 304 | | safety of the highway facility and does no t interfere with the free |
---|
313 | 305 | | and safe flow of traffic. |
---|
314 | 306 | | SECTION 3. This act shall become effective November 1, 2024. |
