7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1716, as
8181 amended by Section 1, Chapter 32, O.S.L. 2022 (21 O.S. Supp. 2023,
8282 Section 1716), is amended to read as follows :
8383 Section 1716. A. Any person in this state who shall steal any
8484 horse, jackass, jennet, m ule, cow, hog, or implement of husbandry as
8585 defined in Section 1 -125 of Title 47 of the Oklahoma Statut es shall,
8686 upon conviction, be guilty of a felony punishable by imprisonment in
8787 the custody of the Department of Corrections for a ter m of not less
8888 than three (3) five (5) years nor more than ten (10) years, or by a
8989 fine in an amount that is equal to three times the value of animals

141141 and machinery that were stolen but not more than Five Hundred
142142 Thousand Dollars ($500,000.00), or by both s uch fine and
143143 imprisonment. Each head of cattle stolen may co nstitute a separate
144144 offense and may be punishable as a separate violati on.
145145 B. Any person in this state who shall steal any dog, sheep or
146146 goat shall, upon conviction, be guilty of a felony punish able by
147147 imprisonment in the custody of the Department of Cor rections for a
148148 term of not less than six (6) months nor more than three (3) years,
149149 or by a fine in an amount that is equal to three times the value of
150150 the animals that were stolen but not more tha n Five Hundred Thous and
151151 Dollars ($500,000.00), or by both su ch fine and imprisonment.
152152 C. The word "horse" as used in this section i ncludes all
153153 animals of the equine species, and the word "cow" includes all
154154 animals of the bovine species.
155155 D. Persons convicted of violating the provisions of subsection
156156 A of this section shall be registered by the Oklahoma Department of
157157 Agriculture, Food, and Forestry in the Livestock Offender Re gistry
158158 created in Section 2-16.1 of Title 2 of the Oklahoma Statutes .
159159 E. The county in which the offe nder is convicted shall submit a
160160 certified copy of the judgment and sentence confirming the
161161 conviction for entry in the Livestock Offender Registry to the
162162 Oklahoma Department of Agriculture, Food, and Forestry or, if
163163 designated by the Department, to a stat ewide livestock organization .

216216 required by this subsection, the county may transmit the conviction
217217 information by using an electronic method authorized by the Oklahoma
218218 Department of Agriculture, Food, and Forestry.
219219 SECTION 2. AMENDATORY 21 O.S. 2021, Section 1720, is
220220 amended to read as follows:
221221 Section 1720. A. Any person in this state who shall steal an
222222 aircraft, automobile or other automotive drive n vehicle,
223223 construction equipment or farm equipment, sh all be guilty of a
224224 felony, and upon conviction shall be punished by imprisonment in the
225225 custody of the Department of Corrections for a term not exceeding
226226 five (5) years if the value of the vehicle is l ess than Fifty
227227 Thousand Dollars ($50,000.00) or for a t erm of not less than three
228228 (3) five (5) years, nor more than ten (10) years if the value of the
229229 vehicle is Fifty Thousand Dollars ($50,000.00) or greater or by a
230230 fine in an amount that is equal to thre e times the value of the
231231 property that was stolen but not more t han Five Hundred Thousand
232232 Dollars ($500,000.00) or by both such fine and imprisonment and
233233 shall be ordered to pay restitution pursuant to Section 991f of
234234 Title 22 of the Oklahoma Statutes.
235235 B. As used in this section, "farm equipment" means any self-
236236 propelled devices, tractors, skid steers, any other mobile
237237 equipment, welders, tools, and any other equipment specifically
238238 adapted for farming purposes and used for tillin g soil, cultivating,
239239 harvesting, and transporti ng crops.
