AS INTRODUCED 
 
An Act relating to crimes and punishments; amending 
21 O.S. 2021, Section s 1716, as amended by Section 1, 
Chapter 32, O.S.L. 2022 and 1720 (21 O.S. Supp. 2023, 
Section 1716), which relate to larceny; modifying 
penalties for theft of implements of hus bandry and 
farm equipment; defining term; and providing an 
effective date. 
 
 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.    AMENDATORY     21 O.S. 2021, Section 1716, as 
amended by Section 1, Chapter 32, O.S.L. 2022 (21 O.S. Supp. 2023, 
Section 1716), is amended to read as follows : 
Section 1716. A.  Any person in this state who shall steal any 
horse, jackass, jennet, m ule, cow, hog, or implement of husbandry as 
defined in Section 1 -125 of Title 47 of the Oklahoma Statut es shall, 
upon conviction, be guilty of a felony punishable by imprisonment in 
the custody of the Department of Corrections for a ter m of not less 
than three (3) five (5) years nor more than ten (10) years, or by a 
fine in an amount that is equal to three times the value of animals

and machinery that were stolen but not more than Five Hundred 
Thousand Dollars ($500,000.00), or by both s uch fine and 
imprisonment.  Each head of cattle stolen may co nstitute a separate 
offense and may be punishable as a separate violati on. 
B.  Any person in this state who shall steal any dog, sheep or 
goat shall, upon conviction, be guilty of a felony punish able by 
imprisonment in the custody of the Department of Cor rections for a 
term of not less than six (6) months nor more than three (3) years, 
or by a fine in an amount that is equal to three times the value of 
the animals that were stolen but not more tha n Five Hundred Thous and 
Dollars ($500,000.00), or by both su ch fine and imprisonment. 
C.  The word "horse" as used in this section i ncludes all 
animals of the equine species, and the word "cow" includes all 
animals of the bovine species. 
D.  Persons convicted of violating the provisions of subsection 
A of this section shall be registered by the Oklahoma Department of 
Agriculture, Food, and Forestry in the Livestock Offender Re gistry 
created in Section 2-16.1 of Title 2 of the Oklahoma Statutes . 
E.  The county in which the offe nder is convicted shall submit a 
certified copy of the judgment and sentence confirming the 
conviction for entry in the Livestock Offender Registry to the 
Oklahoma Department of Agriculture, Food, and Forestry or, if 
designated by the Department, to a stat ewide livestock organization .

required by this subsection, the county may transmit the conviction 
information by using an electronic method authorized by the Oklahoma 
Department of Agriculture, Food, and Forestry. 
SECTION 2.     AMENDATORY     21 O.S. 2021, Section 1720, is 
amended to read as follows: 
Section 1720. A. Any person in this state who shall steal an 
aircraft, automobile or other automotive drive n vehicle, 
construction equipment or farm equipment, sh all be guilty of a 
felony, and upon conviction shall be punished by imprisonment in the 
custody of the Department of Corrections for a term not exceeding 
five (5) years if the value of the vehicle is l ess than Fifty 
Thousand Dollars ($50,000.00) or for a t erm of not less than three 
(3) five (5) years, nor more than ten (10) years if the value of the 
vehicle is Fifty Thousand Dollars ($50,000.00) or greater or by a 
fine in an amount that is equal to thre e times the value of the 
property that was stolen but not more t han Five Hundred Thousand 
Dollars ($500,000.00) or by both such fine and imprisonment and 
shall be ordered to pay restitution pursuant to Section 991f of 
Title 22 of the Oklahoma Statutes. 
B.  As used in this section, "farm equipment" means any self-
propelled devices, tractors, skid steers, any other mobile 
equipment, welders, tools, and any other equipment specifically 
adapted for farming purposes and used for tillin g soil, cultivating, 
harvesting, and transporti ng crops.

SECTION 3.  This act shall become effective November 1, 2024.
