2655 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2856 SECTION 1. AMENDATORY 47 O.S. 2021, Section 6 -105.3, as
2957 last amended by Section 6, Chapter 47, 1st Extraordinary Session,
3058 O.S.L. 2023 (47 O.S. Supp. 2023, Section 6 -105.3), is amended to
3159 read as follows:

3360 Section 6-105.3 A. In addition to the licenses to operate
3461 motor vehicles, the Department of Public Safety Service Oklahoma may
3562 issue cards to Oklahoma residents for purposes of identification
3663 only. The identification cards shall be issued, renewed, replaced,
3764 canceled and denied in the same manner as driver licenses in this
3865 state. A licensee whose record reflects a notation of the person 's

3993 proof of legal presence, verified by the U.S. Department of Homeland
4094 Security, or proof of U.S. citizenship, may obtain a REAL ID
4195 Compliant Identification Card or a Noncompliant Identification Card
4296 from a motor license agent licensed operator or the Department of
4397 Public Safety Service Oklahoma, regardless of the status of the
4498 license held by the licensee. Provided, the licensee must comply
4599 with all REAL ID documentation requirements to obtain a REAL ID
46-Compliant Identification Card. A person shall not ap ply for or ENR. H. B. NO. 3599 Page 2
100+Compliant Identification Card. A person shall not apply for or
47101 possess more than one state -issued or territory-issued REAL ID
48102 Compliant Identification Card pursuant to the provisions of Section
49103 6-101 of this title.

51104 The application for an identification card by any person under
52105 the age of eighteen (18) years shall be signed and verified by a
53106 custodial legal parent or legal guardian, eit her in person before a
54107 person authorized to administer oaths or electronically if
55108 completing an online application, or a notarized affidavit signed by
56109 a custodial legal parent or legal guardian submitted before a person
57110 authorized to administer oaths by th e person under the age of
58111 eighteen (18) years with the application. Except as otherwise
59112 provided in this section, the identification cards shall be valid
60113 for a period of either four (4) years from the month of issuance or
61114 eight (8) years from the month of issuance; however, the
62115 identification cards issued to persons sixty -five (65) years of age
63116 or older shall be valid indefinitely from the month of issuance.

65144 B. 1. The Department of Corrections shall coordinate with the
66145 Department of Public Safety Service Oklahoma to provide REAL ID
67146 Noncompliant Identification Cards to all inmates who do not have a
68147 current state-issued identification card or driver license upon
69148 their release from custody. The identification cards shall be
70149 issued, replaced, canceled and de nied in the same manner as driver
71150 licenses in this state.

73151 2. The Department of Public Safety Service Oklahoma shall allow
74152 the use of a certified copy of a birth certificate coupled with a
75153 Department of Corrections -issued consolidated record card to serve
76154 as a valid form of photo identification documentation to obtain a
77155 REAL ID Noncompliant Identification Card.

79156 3. REAL ID Noncompliant Identification Cards issued with a
80157 consolidated record card from the Department of Corrections for
81158 inmates shall be valid f or a period of four (4) years from the month
82159 of issuance for an allowable fee to be determined by the Department
83160 of Public Safety Service Oklahoma and are nonrenewable and
84161 nontransferable.

86162 4. The fee charged for the issuance or replacement of a REAL ID
87163 Noncompliant Identification Card pursuant to this subsection shall
88164 be deposited in the Department of Public Safety Revolving Fund .
89165 Provided, however, REAL ID Noncompliant Identification Cards issued
90166 to individuals required to register pursuant to the Sex Of fenders
91-Registration Act shall only be valid for a period of on e (1) year. ENR. H. B. NO. 3599 Page 3

92195 No person sixty-five (65) years of age or older shall be charged a
93196 fee for a REAL ID Noncompliant Identification Card.

95197 5. The Department of Public Safety Service Oklahoma is
96198 authorized to promulgate rules and procedures to implement the
97199 provisions of this subsection.

99200 C. No person shall hold more than one state -issued or
100201 territory-issued REAL ID Compliant Driver License or REAL ID
101202 Compliant Identification Card, as defined in subsec tion G of Section
102203 6-101 of this title. The Department Service Oklahoma shall not
103204 issue a REAL ID Compliant Identification Card to any applicant who
104205 has been previously issued a REAL ID Compliant Driver License or
105206 REAL ID Compliant Identification Card unle ss such license or
106207 identification card has been surrendered to the Department Service
107208 Oklahoma by the applicant. The Department Service Oklahoma may
108209 promulgate rules related to the issuance of replacement REAL ID
109210 Compliant Identification Cards in the even t of loss or theft.

111211 D. The fee charged for the issuance or renewal of a REAL ID
112212 Compliant Identification Card shall be Twenty -five Dollars ($25.00)
113213 for a 4-year card and Fifty Dollars ($50.00) for an 8 -year card.
114214 The fee charged for the issuance or renew al of a REAL ID
115215 Noncompliant Identification Card pursuant to this section shall be
116216 Twenty-five Dollars ($25.00) for a 4 -year card and Fifty Dollars
117217 ($50.00) for an 8-year card; however, no person sixty -five (65)
118218 years of age or older, or one hundred percen t (100%) disabled

119246 veteran described in subsection P of Section 6 -101 of this title
120247 shall be charged a fee for an identification card. Of each fee
121248 charged pursuant to the provisions of this subsection:

123249 1. Seven Dollars ($7.00) of a 4 -year card and Fourtee n Dollars
124250 ($14.00) of an 8-year card shall be apportioned as provided in
125251 Section 1104 of this title;

128253 ($6.00) of an 8-year card shall be credited to the Department of
129254 Public Safety Computer Imaging System Revolving Fund to be used
130255 solely for the purpose of the administration and maintenance of the
131256 computerized imaging system of the Department;

133257 3. Ten Dollars ($10.00) of a 4 -year card and Twenty Dollars
134258 ($20.00) of an 8-year card shall be deposited i n the Department of
135259 Public Safety Revolving Fund ;

142264 ($4.00) for an 8-year card of the fee authorized by this subsection
143265 related to the issuance or renewal of an identification card by a
144266 motor license agent licensed operator that does process approved
145267 applications or renewals for REAL ID Compliant and REAL ID Non-
146268 Compliant Noncompliant Driver Licenses or Identification Cards shall
147269 be retained by the licensed operator through June 30, 2023.

148297 Beginning July 1, 2023, these monies shall be retained by the
149298 licensed operator pursuan t to subsection E of Section 1141.1 of this

152300 E. The fee charged for replacement of a REAL ID Compliant
153301 Identification Card, or REAL ID Non-Compliant Noncompliant
154302 Identification Card, shall be Twenty -five Dollars ($25.00); however,
155303 no person sixty-five (65) years of age or older shall be charged a
156304 fee for an identification card replacement. Of each fee charged
157305 pursuant to the provisions of this subsection:

179349 Beginning July 1, 2023, these monies shall be retained by the
180350 licensed operator pursuant to subsection E of Section 1141.1 of this

183352 F. The Oklahoma Tax Commission is hereby authorize d to
184353 reimburse, from funds available to that agency, each motor license
185354 agent licensed operator issuing an identification card to a person
186355 sixty-five (65) years of age or older, an amount not to exceed One
187356 Dollar ($1.00) for each card or driver license so issued through
188357 June 30, 2023. The Tax Commission shall develop procedures for
189358 claims for reimbursement.

191359 G. Notwithstanding any other provision of law, when a person
192360 makes application for a new identification card, or makes
193361 application to renew an identif ication card, and the person has been
194362 convicted of, or received a deferred judgment for, any offense
195363 required to register pursuant to the Sex Offenders Registration Act,
196364 the identification card shall be valid for a period of one (1) year
197365 from the month of issuance, but may be renewed yearly during the
198366 time the person is subject to registration on the Sex Offender
199367 Registry. The cost for such identification card shall be the same
200368 as for other identification cards and renewals.

202369 H. Nothing in this section req uires or authorizes the
203370 Department of Public Safety Service Oklahoma to issue a REAL ID
204371 Noncompliant Identification Card without the documentation required
