	46	+	time limitation for the filing of an indictment or
	47	+	information; providing an exception; allowing for
	48	+	extensions of time limitation upon a showing of good

	51	+	circumstances; providing for codification; and

49	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:
50	60		SECTION 1. NEW LAW A new section of law to be codified
51	61		in the Oklahoma Statutes as Section 388.1 of Title 22, unless there
52	62		is created a duplication in numbering, reads as follows:
53		-	A~~. 1~~. When an arrested person is held in custody subsequent to
54		-	an arrest, an indictment or information shall be filed by the state

87		-	hundred thousand (500,000) as determined by th e latest Federal

89	94		B. The State may move the court to extend the five-day period
90	95		to file an information or indictment upon a showing of good cause.
91	96		C. If the information or indictment has not been filed up on the
92	97		expiration of the five-day period to file an infor mation or
93	98		indictment, the arrested person may move the court for release from
94	99		custody subject to an own recognizance bond , as provided for in
95	100		Section 1108.1 of Title 22 of the Oklahoma Statutes. The expiration
96	101		of the time limit to file an information or indictment shall be
97	102		prima facie grounds for the release of an arrested person on an own
98	103		recognizance bond, subject to the limitations o n release set forth
99	104		in subsection E of Section 1108.1 of Title 22 of the Oklahoma
100	105		Statutes or as otherwise provided by law .
101	106		D. An arrested person may move the court for release on his or
102	107		her own recognizance upon the expiration of the period to file an
103	108		information or indictment even if the arrested person has already
104	109		had bail set by the c ourt, as provided for in Section 1105.2 of
105	110		Title 22 of the Oklahoma Statutes.
106	111		SECTION 2. This act shall become effective November 1, 2024.
