8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 24-100.11 of Title 70, unless
8484 there is created a duplication in numbering, reads as follows:
8585 A. This act shall be known and may be cited as the "Students'
8686 Bill of Rights".
8787 B. A student enrolled in and attendin g a public school district
8888 or public charter school in this state shall be afforded the
8989 following rights:

141141 1. The right to a safe learning environment , including the
142142 right to be free from bullying and threatening behavior as defined
143143 in Section 24-100.3 of Title 70 of the Oklahoma Statutes;
144144 2. The right to an unbiased education that does not endorse,
145145 favor, or promote socialism, communism , or Marxism and that is free
146146 from anti-American bias;
147147 3. The right to an unbiased learning environment that includes ,
148148 but is not limited to:
149149 a. the right to a classroom environment that is free from
150150 the display of flags or propaganda of any organization
151151 or symbols of socialism, communism, Marxism , or anti-
152152 American sentiment, and
153153 b. the right to attend or participate in sch ool-sponsored
154154 or school-sanctioned events or activities that are
155155 free from the display of flags or propaganda that are
156156 paid for with public funds and that represent any
157157 organization or symbol of socialism, commun ism,
158158 Marxism, or anti-American sentiment;
159159 4. The right to use self-defense if attacked on school property
160160 or during a school event;
161161 5. The right to public and free expression of religion, speech ,
162162 and peaceable assembly including , but not limited to:
163163 a. the right to participate in or lead prayer,

215215 b. the right to observe one minute of silence each day ,
216216 pursuant to Section 11-101.2 of Title 70 of the
217217 Oklahoma Statutes,
218218 c. the right to study and read the religious texts of his
219219 or her choosing during free time ,
220220 d. the right to an unbiased education that does not
221221 endorse, favor, promote, demean, show hostility
222222 toward, or intentionally undermine any particular
223223 religion or nonreligious faith or religious
224224 perspective;
225225 6. The right to an appropriate relationship wit h teachers and
226226 school employees that is fre e from actions that cons titute a crime
227227 or an attempted crime under state law;
228228 7. The right to be free from the use of vulgar language
229229 directed toward other individuals by other students, teachers,
230230 athletic coaches, or school district employees ; and
231231 8. The right to have a parent or legal counsel present if the
232232 student is being questioned concerning potential i llegal conduct.
233233 C. Students shall not be punished or otherwise penalized at
234234 school or during school-related activities for lawfully exercising
235235 their rights or engaging in l awful conduct outside of school hours
236236 and outside of school property or school events.
237237 D. If any rights listed in the Students ' Bill of Rights are
238238 violated, a parent, legal guardian, or th e student may submit a

290290 written demand for enforcement of the rights provided in the
291291 Students' Bill of Rights. Within seven (7) business days of rece ipt
292292 of the demand, the school shall submit a written response to the
293293 allegation, either admitting or denying the allegation. If the
294294 school continues to deny the student's demand, a parent, legal
295295 guardian, or student may file a civil lawsuit in district court to
296296 enforce the rights outlined in this section . The court shall award
297297 reasonable attorney fees to the prevailing party.
298298 E. A lawsuit shall not be filed pursuant to the bullying or
299299 threatening behavior provisions of paragraph 1 of subsection B of
300300 this section unless a parent, legal guardian, or student has
301301 notified the school of ongoing bullying or threatening behavior and
302302 the school fails to addre ss the bullying or threatening behavior by
303303 allowing the perpetrator to remain in contact with the victim when
304304 the bullying or threatening behavior continues and rises to the
305305 level of harassment. A lawsuit shall not be filed prior to a second
306306 or subsequent incident within twelve (12) calendar months.
307307 SECTION 2. This act shall become effective November 1, 2024.
