81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. NEW LAW A new section of law to be codified
83	83	in the Oklahoma Statutes as Section 24-100.11 of Title 70, unless
84	84	there is created a duplication in numbering, reads as follows:
85	85	A. This act shall be known and may be cited as the "Students'
86	86	Bill of Rights".
87	87	B. A student enrolled in and attendin g a public school district
88	88	or public charter school in this state shall be afforded the

141	141	1. The right to a safe learning environment , including the
142	142	right to be free from bullying and threatening behavior as defined
143	143	in Section 24-100.3 of Title 70 of the Oklahoma Statutes;
144	144	2. The right to an unbiased education that does not endorse,
145	145	favor, or promote socialism, communism , or Marxism and that is free
146	146	from anti-American bias;
147	147	3. The right to an unbiased learning environment that includes ,
148	148	but is not limited to:
149	149	a. the right to a classroom environment that is free from
150	150	the display of flags or propaganda of any organization
151	151	or symbols of socialism, communism, Marxism , or anti-
152	152	American sentiment, and
153	153	b. the right to attend or participate in sch ool-sponsored
154	154	or school-sanctioned events or activities that are
155	155	free from the display of flags or propaganda that are
156	156	paid for with public funds and that represent any
157	157	organization or symbol of socialism, commun ism,
158	158	Marxism, or anti-American sentiment;
159	159	4. The right to use self-defense if attacked on school property
160	160	or during a school event;
161	161	5. The right to public and free expression of religion, speech ,
162	162	and peaceable assembly including , but not limited to:
163	163	a. the right to participate in or lead prayer,

215	215	b. the right to observe one minute of silence each day ,
216	216	pursuant to Section 11-101.2 of Title 70 of the
217	217	Oklahoma Statutes,
218	218	c. the right to study and read the religious texts of his
219	219	or her choosing during free time ,
220	220	d. the right to an unbiased education that does not
221	221	endorse, favor, promote, demean, show hostility
222	222	toward, or intentionally undermine any particular
223	223	religion or nonreligious faith or religious
224	224	perspective;
225	225	6. The right to an appropriate relationship wit h teachers and
226	226	school employees that is fre e from actions that cons titute a crime
227	227	or an attempted crime under state law;
228	228	7. The right to be free from the use of vulgar language
229	229	directed toward other individuals by other students, teachers,
230	230	athletic coaches, or school district employees ; and
231	231	8. The right to have a parent or legal counsel present if the
232	232	student is being questioned concerning potential i llegal conduct.
233	233	C. Students shall not be punished or otherwise penalized at
234	234	school or during school-related activities for lawfully exercising
235	235	their rights or engaging in l awful conduct outside of school hours
236	236	and outside of school property or school events.
237	237	D. If any rights listed in the Students ' Bill of Rights are
238	238	violated, a parent, legal guardian, or th e student may submit a

290	290	written demand for enforcement of the rights provided in the
291	291	Students' Bill of Rights. Within seven (7) business days of rece ipt
292	292	of the demand, the school shall submit a written response to the
293	293	allegation, either admitting or denying the allegation. If the
294	294	school continues to deny the student's demand, a parent, legal
295	295	guardian, or student may file a civil lawsuit in district court to
296	296	enforce the rights outlined in this section . The court shall award
297	297	reasonable attorney fees to the prevailing party.
298	298	E. A lawsuit shall not be filed pursuant to the bullying or
299	299	threatening behavior provisions of paragraph 1 of subsection B of
300	300	this section unless a parent, legal guardian, or student has
301	301	notified the school of ongoing bullying or threatening behavior and
302	302	the school fails to addre ss the bullying or threatening behavior by
303	303	allowing the perpetrator to remain in contact with the victim when
304	304	the bullying or threatening behavior continues and rises to the
305	305	level of harassment. A lawsuit shall not be filed prior to a second
306	306	or subsequent incident within twelve (12) calendar months.
307	307	SECTION 2. This act shall become effective November 1, 2024.
