65	65	An Act relating to capital punishment; establishing
66	66	moratorium on capital punishment; making moratorium

75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new section of law to be codified
77	77	in the Oklahoma Statutes as Section 1016.1 of Title 22, unless there
78	78	is created a duplication in numbering, reads as follows:
79	79	A. A moratorium is hereby established on the imposition of
80	80	capital punishment in the state of Oklahoma . Said moratorium shall
81	81	apply to any person who has previously been convicted under the laws
82	82	of this state and received a sentence of deat h.
83	83	B. Said moratorium shall remain in effect until the
84	84	recommendations of the Oklahoma Death Penalty Review Commission have
85	85	been enacted into state law.
86	86	C. All other matters related to sentences of death, including
87	87	the filing and trying capital punishment cases, sent encing

141	141	SECTION 2. It being immediately neces sary for the preservation
142	142	of the public peace, health or safety, an emergency is hereby
143	143	declared to exist, by reason whereof this act shall take effect and
144	144	be in full force from and after its passage and approval.
