AS INTRODUCED 
 
An Act relating to capital punishment; establishing 
moratorium on capital punishment; making moratorium 
applicable to certain persons; stating duration of 
moratorium; providing for the continuation of certain 
court proceedings; and declaring an emergency. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 1016.1 of Title 22, unless there 
is created a duplication in numbering, reads as follows: 
A.  A moratorium is hereby established on the imposition of 
capital punishment in the state of Oklahoma .  Said moratorium shall 
apply to any person who has previously been convicted under the laws 
of this state and received a sentence of deat h. 
B.  Said moratorium shall remain in effect until the 
recommendations of the Oklahoma Death Penalty Review Commission have 
been enacted into state law. 
C.  All other matters related to sentences of death, including 
the filing and trying capital punishment cases, sent encing

proceedings, imposing sentences of death, ap peals, and habeas 
reviews, shall not be affected by the provisions of this act. 
SECTION 2.  It being immediately neces sary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its passage and approval.
