5961 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6062 SECTION 1. NEW LAW A new section of law to be codified
6163 in the Oklahoma Statutes as Section 3234 of Title 70, unless there
6264 is created a duplication i n numbering, reads as follows:
63-A. This act shall be known and may be cited as th e "Oklahoma
64-Department of Transportation Educational Assistance A ct".
65+A. This act shall be known and may be cited as the “Oklahoma
66+Department of Transportation Educational Assistance Act”.

9295 1. "Conditional grant program " means the Oklahoma Department of
9396 Transportation Educational Assistance Program established pursuant
9497 to the provisions of this secti on;
9598 2. "Department" means the Oklahoma Department of
9699 Transportation;
97100 3. "Eligible degree" means a baccalaureate degree from an
98101 institution in a field of study that satisfi es the Department's
99102 minimum education requirement for an eligible profession;
100103 4. "Eligible profession" means the profession of engineering or
101104 another profession as defined by Department rule for which the
102105 Department determines there is a need in the Department's workforce;
103106 5. "Eligible Student" means a student who has a high school
104107 diploma or who has completed General Educational Development (GED)
105108 requirements and who:
106109 a. has completed and filed with the Department, on forms
107110 prescribed by the Department, a conditional grant
108111 application and a declaration of intent to become a
109112 member of an eligible profession and work for the
110113 Department for the five (5) academic years immediately
111114 following the date of the student's receipt of an
112115 eligible degree,
113116 b. has enrolled in an Oklahoma educational inst itution,
114117 and
115118 c. is an Oklahoma resident ;

142146 6. "Graduate program" means a program offered by an Oklahoma
143-educational institution that leads to the award of a master 's
147+educational institution that leads to the award of a masters
144148 degree;
145149 7. "Oklahoma educational institution " means an institution of
146150 higher education within the Oklahoma State System of Higher
147151 Education;
148152 8. "Profession" means a state position for which the minimum
149153 requirements include a baccalaureate degree ; and
150154 9. "Undergraduate program " means a program offered by an
151155 Oklahoma educational institution tha t leads to the award of an
152-associate's degree or a baccalaureate degree.

153157 C. There is hereby created the Oklahoma Department of
154158 Transportation Educational Assistance Program to provide assistance
155159 to eligible students who enroll in an Oklahoma educational
156160 institution and who agree to work for the Department in an eligible
157161 profession for the five (5) academic years immediately following the
158162 date of the student's receipt of an eligible degree. The
159163 Department, by rule, shall prescribe criteria for the selectio n of
160164 applicants under this act. Subject to the availability of funds,
161165 the amount of assistance shall be equivalent to the amount of
162166 resident tuition, mandatory fees, and academic service fees for
163167 courses in which the eli gible student is enrolled, not to e xceed a
164168 maximum of eighteen (18) credit hours ea ch semester.

191196 1. The amount of assistance provided to an eligible student
192197 enrolled in an undergraduate program shall not exceed a maximum of
193-one hundred twenty (120) credit hours in pursuit of an associate 's
198+one hundred twenty (120) credit hours in pursuit of an associates
194199 degree and/or a baccalaureate degree;
195200 2. Subject to the assistance for eligibl e students enrolled in
196201 undergraduate programs being fully funded, assistance shall be
197202 provided to an eligible student with a baccalaureate deg ree enrolled
198203 in a graduate program. The amount of assistance provided to an
199204 eligible student enrolled in a gradua te program shall not exceed a
200-maximum of forty (40) credit hours in pursuit of a master 's degree;
205+maximum of forty (40) credit hours in pursuit of a masters degree ;
201206 3. Assistance provided pursuant to this sec tion shall be
202207 granted without any l imitation other than t he amount of funds
203208 available for the program and the number of eligible students who
204209 apply;
205210 4. Assistance allowed by this section shall not be allowed for
206211 courses taken in excess of the requirements for completion of an
207212 undergraduate program or a graduate program, whichever is app licable
208213 for the eligible studen t;
209214 D. 1. To be eligible to apply for the conditional grant
210215 program, an eligible student shall:
211216 a. complete and file with the Department, on forms
212217 prescribed by the Department, a conditional grant
213218 application and a declarati on of intent to become a

241247 Department for the five (5) academic years immediately
242248 following the date of the student's receipt of an
243249 eligible degree,
244250 b. be enrolled in an Oklahoma ed ucational institution ,
245251 and
246252 c. be an Oklahoma resident;
247253 2. To retain eligibility for the Program, an eligible student
248254 shall:
249255 a. maintain good academic standing and satisfactory
250256 academic progress accor ding to standards of the
251257 Oklahoma educational institution in which the member
252258 is enrolled,
253259 b. maintain the requirements for retention and degree
254260 completion as established by the Oklahoma educational
255261 institution in which the member is enrolled , and
256262 c. maintain a minimum grade point averag e of 2.0 on a 4.0
257263 scale;
258264 3. An eligible student se eking assistance pursuant to the
259265 provisions of this section shall submit an application on a form
260266 prescribed by the Department prior to the semester for which
261267 assistance is sought; and
262268 4. The eligible student may be denied continu ed assistance if
263269 he or she fails to comply with the provisions of this act.
264270 E. Repayment of Conditional Grant:

291298 1. The Department, by rule, may establish conditions under
292299 which a student who has r eceived a conditional grant may b e required
293300 to repay all or part of the grant becau se the student has withdrawn
294-from or dropped out of the student 's institution or has other wise
301+from or dropped out of the students institution or has other wise
295302 failed to maintain eligibility for the grant ;
296303 2. A student who does not beco me a member of an eligible
297304 profession and work for the Department for the five (5) academic
298-years immediately following the date of the student 's receipt of an
305+years immediately following the date of the students receipt of an
299306 eligible degree must repay all conditional grants received by the
300307 student;
301308 3. An eligible student who has received assistance purs uant to
302309 the provisions of this conditional grant program and who fails to
303310 comply with the provisions of this act due to hardship circumstances
304311 may request a waiver from repayment ;
305312 4. Repayments shall be deposited into th e Oklahoma Department
306313 of Transportation Educational Assistance R evolving Fund created
307314 pursuant to Section 2 of this act ; and
308315 5. The Department shall establish a schedule for installment
309316 payments under this section .
310317 F. The Department may accept gifts and grants from any public
311318 or private source for the conditional grant pr ogram under this
312319 subchapter and may also use for that purpose available money
313320 credited to the state highway program. All funding received by the

340348 Department for this purpose shall be tran sferred to the Oklahoma
341349 Department of Transportation Educational Assi stance Revolving Fund.
342350 G. The Oklahoma Department of Transportation shall promulgate
343351 rules to implement the provisions of this act.
344352 SECTION 2. NEW LAW A new sect ion of law to be codified
345353 in the Oklahoma Statutes as Section 3235 of Title 70, unless there
346354 is created a duplication in numbering, reads as follows:
347355 There is hereby created in the State Treasury a revolving fund
348356 to be designated the "Oklahoma Department of Transportation
349357 Educational Assistance Revolving Fund". The fund shall be a
350358 continuing fund, not subject to fiscal year limitations, and shall
351359 consist of monies received by the Department and allocated for the
352360 conditional grant program. All monies accruing to the credit of the
353361 fund are hereby appropriated and may be bud geted and expended by the
354362 Oklahoma Department of Transportation for the purpose of providing
355363 assistance to eligible students pursuant to the provisions of
356364 Section 1 of this act. Expenditures from the fund shall be made
357365 upon warrants issued by the State Tr easurer against claims filed as
358366 prescribed by law with the Director of the Office of Management and
359367 Enterprise Services for approval and payment.
360368 SECTION 3. This act shall become effective November 1, 2024.
