59	61		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	62		SECTION 1. NEW LAW A new section of law to be codified
61	63		in the Oklahoma Statutes as Section 3234 of Title 70, unless there
62	64		is created a duplication i n numbering, reads as follows:
63		-	A. This act shall be known and may be cited as ~~th e "~~Oklahoma
64		-	Department of Transportation Educational Assistance ~~A ct"~~.
	65	+	A. This act shall be known and may be cited as the “Oklahoma
	66	+	Department of Transportation Educational Assistance Act”.
65	67		B. As used in this act:

92	95		1. "Conditional grant program " means the Oklahoma Department of
93	96		Transportation Educational Assistance Program established pursuant
94	97		to the provisions of this secti on;
95	98		2. "Department" means the Oklahoma Department of
96	99		Transportation;
97	100		3. "Eligible degree" means a baccalaureate degree from an
98	101		institution in a field of study that satisfi es the Department's
99	102		minimum education requirement for an eligible profession;
100	103		4. "Eligible profession" means the profession of engineering or
101	104		another profession as defined by Department rule for which the
102	105		Department determines there is a need in the Department's workforce;
103	106		5. "Eligible Student" means a student who has a high school
104	107		diploma or who has completed General Educational Development (GED)
105	108		requirements and who:
106	109		a. has completed and filed with the Department, on forms
107	110		prescribed by the Department, a conditional grant
108	111		application and a declaration of intent to become a
109	112		member of an eligible profession and work for the
110	113		Department for the five (5) academic years immediately
111	114		following the date of the student's receipt of an
112	115		eligible degree,
113	116		b. has enrolled in an Oklahoma educational inst itution,

115	118		c. is an Oklahoma resident ;

142	146		6. "Graduate program" means a program offered by an Oklahoma
143		-	educational institution that leads to the award of a master 's
	147	+	educational institution that leads to the award of a master’s

145	149		7. "Oklahoma educational institution " means an institution of
146	150		higher education within the Oklahoma State System of Higher
147	151		Education;
148	152		8. "Profession" means a state position for which the minimum
149	153		requirements include a baccalaureate degree ; and
150	154		9. "Undergraduate program " means a program offered by an
151	155		Oklahoma educational institution tha t leads to the award of an
152		-	associate's degree or a baccalaureate degree.

153	157		C. There is hereby created the Oklahoma Department of
154	158		Transportation Educational Assistance Program to provide assistance
155	159		to eligible students who enroll in an Oklahoma educational
156	160		institution and who agree to work for the Department in an eligible
157	161		profession for the five (5) academic years immediately following the
158	162		date of the student's receipt of an eligible degree. The
159	163		Department, by rule, shall prescribe criteria for the selectio n of
160	164		applicants under this act. Subject to the availability of funds,
161	165		the amount of assistance shall be equivalent to the amount of
162	166		resident tuition, mandatory fees, and academic service fees for
163	167		courses in which the eli gible student is enrolled, not to e xceed a
164	168		maximum of eighteen (18) credit hours ea ch semester.

191	196		1. The amount of assistance provided to an eligible student
192	197		enrolled in an undergraduate program shall not exceed a maximum of
193		-	one hundred twenty (120) credit hours in pursuit of an associate 's

194	199		degree and/or a baccalaureate degree;
195	200		2. Subject to the assistance for eligibl e students enrolled in
196	201		undergraduate programs being fully funded, assistance shall be
197	202		provided to an eligible student with a baccalaureate deg ree enrolled
198	203		in a graduate program. The amount of assistance provided to an
199	204		eligible student enrolled in a gradua te program shall not exceed a
200		-	maximum of forty (40) credit hours in pursuit of a master 's degree;

201	206		3. Assistance provided pursuant to this sec tion shall be
202	207		granted without any l imitation other than t he amount of funds
203	208		available for the program and the number of eligible students who
204	209		apply;
205	210		4. Assistance allowed by this section shall not be allowed for
206	211		courses taken in excess of the requirements for completion of an
207	212		undergraduate program or a graduate program, whichever is app licable
208	213		for the eligible studen t;
209	214		D. 1. To be eligible to apply for the conditional grant
210	215		program, an eligible student shall:
211	216		a. complete and file with the Department, on forms
212	217		prescribed by the Department, a conditional grant
213	218		application and a declarati on of intent to become a

244	250		b. be enrolled in an Oklahoma ed ucational institution ,

246	252		c. be an Oklahoma resident;
247	253		2. To retain eligibility for the Program, an eligible student
248	254		shall:
249	255		a. maintain good academic standing and satisfactory
250	256		academic progress accor ding to standards of the
251	257		Oklahoma educational institution in which the member
252	258		is enrolled,
253	259		b. maintain the requirements for retention and degree
254	260		completion as established by the Oklahoma educational
255	261		institution in which the member is enrolled , and
256	262		c. maintain a minimum grade point averag e of 2.0 on a 4.0
257	263		scale;
258	264		3. An eligible student se eking assistance pursuant to the
259	265		provisions of this section shall submit an application on a form
260	266		prescribed by the Department prior to the semester for which
261	267		assistance is sought; and
262	268		4. The eligible student may be denied continu ed assistance if
263	269		he or she fails to comply with the provisions of this act.
264	270		E. Repayment of Conditional Grant:

291	298		1. The Department, by rule, may establish conditions under
292	299		which a student who has r eceived a conditional grant may b e required
293	300		to repay all or part of the grant becau se the student has withdrawn
294		-	from or dropped out of the student 's institution or has other wise
	301	+	from or dropped out of the student’s institution or has other wise
295	302		failed to maintain eligibility for the grant ;
296	303		2. A student who does not beco me a member of an eligible
297	304		profession and work for the Department for the five (5) academic
298		-	years immediately following the date of the student 's receipt of an
	305	+	years immediately following the date of the student’s receipt of an
299	306		eligible degree must repay all conditional grants received by the
300	307		student;
301	308		3. An eligible student who has received assistance purs uant to
302	309		the provisions of this conditional grant program and who fails to
303	310		comply with the provisions of this act due to hardship circumstances
304	311		may request a waiver from repayment ;
305	312		4. Repayments shall be deposited into th e Oklahoma Department
306	313		of Transportation Educational Assistance R evolving Fund created
307	314		pursuant to Section 2 of this act ; and
308	315		5. The Department shall establish a schedule for installment
309	316		payments under this section .
310	317		F. The Department may accept gifts and grants from any public
311	318		or private source for the conditional grant pr ogram under this
312	319		subchapter and may also use for that purpose available money
313	320		credited to the state highway program. All funding received by the

340	348		Department for this purpose shall be tran sferred to the Oklahoma
341	349		Department of Transportation Educational Assi stance Revolving Fund.
342	350		G. The Oklahoma Department of Transportation shall promulgate
343	351		rules to implement the provisions of this act.
344	352		SECTION 2. NEW LAW A new sect ion of law to be codified
345	353		in the Oklahoma Statutes as Section 3235 of Title 70, unless there
346	354		is created a duplication in numbering, reads as follows:
347	355		There is hereby created in the State Treasury a revolving fund
348	356		to be designated the "Oklahoma Department of Transportation
349	357		Educational Assistance Revolving Fund". The fund shall be a
350	358		continuing fund, not subject to fiscal year limitations, and shall
351	359		consist of monies received by the Department and allocated for the
352	360		conditional grant program. All monies accruing to the credit of the
353	361		fund are hereby appropriated and may be bud geted and expended by the
354	362		Oklahoma Department of Transportation for the purpose of providing
355	363		assistance to eligible students pursuant to the provisions of
356	364		Section 1 of this act. Expenditures from the fund shall be made
357	365		upon warrants issued by the State Tr easurer against claims filed as
358	366		prescribed by law with the Director of the Office of Management and
359	367		Enterprise Services for approval and payment.
360	368		SECTION 3. This act shall become effective November 1, 2024.
