4499 SECTION 1. NEW LAW A new section of law to be codified

48102 A. 1. Service Oklahoma shall permit a driver license or state
49103 identification cardholder to voluntarily designate that the person
50104 has been diagnosed with an autism spectrum disorder by a licensed
51105 primary care physician, licensed psychologist, or lic ensed
52106 psychiatrist. The designation shall be used by a law enforcement
53107 officer or an emergency medical professional to identify and
54108 effectively communicate with a person who has been diagnosed with an
55109 autism spectrum disorder and shall not be used for any oth er purpose
56110 by any other person.

58111 2. The cardholder may choose whether the voluntary designation
59112 indicating that a person has been diagnosed with an autism spectrum
60113 disorder pursuant to paragraph 1 of this subsection shall be
61114 displayed on the driver lic ense or identification card or in the
62115 Oklahoma Law Enforcement Telecommunications System (OLETS) in
63116 accordance with procedures prescribed by Service Oklahoma. A holder
64117 of a driver license or identification card who makes a voluntary
65118 designation pursuant to th is section shall have the opportunity to
66119 remove the designation at any time.

68120 B. 1. Service Oklahoma shall establish and maintain an
69121 automated statewide registry accessible by law enforcement officers
70122 for the purpose of identifying and effectively com municating with a

71150 person who has been diagnosed with an autism spectrum disorder by a
72151 licensed primary care physician, licensed psychologist, or licensed
73152 psychiatrist. Service Oklahoma shall permit a person diagnosed with
74153 an autism spectrum disorder to volunt arily report the diagnosis to
75154 Service Oklahoma for inclusion in the registry. The registry shall
76155 be capable of storing information, which shall include, but not be
77156 limited to:

79157 a. the license plate and registration information of any
80158 motor vehicle that the person intends to regularly
81159 operate,

83160 b. the emergency contact information of a person who can
84161 communicate on behalf of the person who has been
85162 diagnosed with an autism spectrum disorder, and

87163 c. any other information that may assist a law
88164 enforcement officer when communicating with the
89165 person.

91166 2. Service Oklahoma shall develop a standardized autism
92167 diagnosis form that provides a diagnosing or treating licensed
93168 primary care physician, licensed psychologist, or licensed
94169 psychiatrist to certify that an in dividual has been diagnosed with
95170 an autism spectrum disorder. The holder of an Oklahoma driver
96171 license or identification card or a person making application or
97172 renewal for a driver license or identification card issued by
98173 Service Oklahoma may voluntarily subm it the form to the registry

99201 established pursuant to paragraph 1 of this subsection, through
100202 procedures established by Service Oklahoma. A holder of a driver
101203 license or identification card who submits information to the
102204 registry shall have the opportun ity to revise, update the
103205 information, or be removed from the registry at any time.

105206 3. Information submitted pursuant to this section shall only be
106207 available to Service Oklahoma, licensed operators who are designated
107208 to collect and maintain the information, a nd law enforcement
108209 officers when accessing the person's motor vehicle records. The
109210 information shall be exclusively used during a motor vehicle stop or
110211 other law enforcement action to assist law enforcement officers in
111212 identifying and effectively comm unicating with a person who has been
112213 diagnosed with an autism spectrum disorder.

114214 4. Any information submitted to Service Oklahoma or licensed
115215 operators pursuant to this section shall not be considered a
116216 government record pursuant to subparagraph c of paragrap h 1 of
117217 Section 24A.5 of Title 51 of the Oklahoma Statutes and shall not be
118218 discoverable as a government record by any person, entity, or
119219 governmental agency, except upon a subpoena issued by a grand jury
120220 or a court order in a criminal matter.

122221 5. Service Oklahoma, its employees, or licensed operators, for
123222 the purpose of discharging their duties pursuant to this act, shall
124223 not be liable to any person for civil damages or subject to criminal
125224 prosecution resulting from or caused by:

127252 a. any disruption or failur e in Internet service caused
128253 by any accident, malfunction, act of sabotage or
129254 nature, or any other condition or circumstance that
130255 Service Oklahoma has not, directly or indirectly,
131256 caused, and which prevents the holder of an Oklahoma
132257 driver license or identification card from accessing
133258 or inputting information into the registry established
134259 pursuant to this subsection, or which results in, or
135-prevents, Service Oklahoma, licensed operators, ENR. H. B. NO. 3671 Page 4
260+prevents, Service Oklahoma, licensed operators,
136261 designated Service Oklahoma employees, and law
137262 enforcement officers fr om accessing, establishing, or
138263 maintaining the database,

140264 b. any misuse of, or the failure or omission to input
141265 accurate information, or the inputting of inaccurate
142266 or outdated information into the registry by any
143267 holder of an Oklahoma driver license or identification
144268 card, or

146269 c. the inability of any law enforcement officer to make
147270 contact, in good faith, with any designated emergency
148271 contact person. This limitation of liability is
149272 inapplicable if such failure resulted from a malicious
150273 purpose or a wanton a nd willful disregard for the
151274 safety of persons or property.

153302 6. With regard to the issuance of REAL -ID compliant licenses
154303 containing designations pursuant to this section, Service Oklahoma
155304 shall comply with all federal design requirements and shall see k
156305 design approval from all necessary federal agencies, including, but
157306 not limited to, the United States Department of Homeland Security.

159307 7. Service Oklahoma is authorized to promulgate any rules
160308 necessary to effectuate the provisions of this section.

162309 SECTION 2. NEW LAW A new section of law to be codified
163310 in the Oklahoma Statutes as Section 6 -125.1 of Title 47, unless
164311 there is created a duplication in numbering, reads as follows:

166312 The Department of Public Safety, in consultation with Service
167313 Oklahoma, the Council on Law Enforcement Education and Training, the
168314 Oklahoma Department of Mental Health and Substance Abuse Services,
169315 and other entities or individuals with expertise in autism, shall
170316 develop a program to assist and train law enforcem ent officers to
171317 effectively communicate with a person who has been diagnosed with an
172318 autism spectrum disorder by a licensed primary care physician,
173319 licensed psychologist, or licensed psychiatrist. In addition, the
174320 program shall include training in de -escalation methods when
175321 interacting with a person who has been diagnosed with an autism
176322 spectrum disorder, proper utilization of the registry established
177323 pursuant to Section 1 of this act, proper utilization of any
178324 specific information regarding an individual listed in the registry,
