48	102		A. 1. Service Oklahoma shall permit a driver license or state
49	103		identification cardholder to voluntarily designate that the person
50	104		has been diagnosed with an autism spectrum disorder by a licensed
51	105		primary care physician, licensed psychologist, or lic ensed
52	106		psychiatrist. The designation shall be used by a law enforcement
53	107		officer or an emergency medical professional to identify and
54	108		effectively communicate with a person who has been diagnosed with an
55	109		autism spectrum disorder and shall not be used for any oth er purpose
56	110		by any other person.

58	111		2. The cardholder may choose whether the voluntary designation
59	112		indicating that a person has been diagnosed with an autism spectrum
60	113		disorder pursuant to paragraph 1 of this subsection shall be
61	114		displayed on the driver lic ense or identification card or in the
62	115		Oklahoma Law Enforcement Telecommunications System (OLETS) in
63	116		accordance with procedures prescribed by Service Oklahoma. A holder
64	117		of a driver license or identification card who makes a voluntary
65	118		designation pursuant to th is section shall have the opportunity to
66	119		remove the designation at any time.

68	120		B. 1. Service Oklahoma shall establish and maintain an
69	121		automated statewide registry accessible by law enforcement officers
70	122		for the purpose of identifying and effectively com municating with a

71	150		person who has been diagnosed with an autism spectrum disorder by a
72	151		licensed primary care physician, licensed psychologist, or licensed
73	152		psychiatrist. Service Oklahoma shall permit a person diagnosed with
74	153		an autism spectrum disorder to volunt arily report the diagnosis to
75	154		Service Oklahoma for inclusion in the registry. The registry shall
76	155		be capable of storing information, which shall include, but not be
77	156		limited to:

79	157		a. the license plate and registration information of any
80	158		motor vehicle that the person intends to regularly
81	159		operate,

83	160		b. the emergency contact information of a person who can
84	161		communicate on behalf of the person who has been
85	162		diagnosed with an autism spectrum disorder, and

87	163		c. any other information that may assist a law
88	164		enforcement officer when communicating with the
89	165		person.

91	166		2. Service Oklahoma shall develop a standardized autism
92	167		diagnosis form that provides a diagnosing or treating licensed
93	168		primary care physician, licensed psychologist, or licensed
94	169		psychiatrist to certify that an in dividual has been diagnosed with
95	170		an autism spectrum disorder. The holder of an Oklahoma driver
96	171		license or identification card or a person making application or
97	172		renewal for a driver license or identification card issued by
98	173		Service Oklahoma may voluntarily subm it the form to the registry

100	202		procedures established by Service Oklahoma. A holder of a driver
101	203		license or identification card who submits information to the
102	204		registry shall have the opportun ity to revise, update the
103	205		information, or be removed from the registry at any time.

105	206		3. Information submitted pursuant to this section shall only be
106	207		available to Service Oklahoma, licensed operators who are designated
107	208		to collect and maintain the information, a nd law enforcement
108	209		officers when accessing the person's motor vehicle records. The
109	210		information shall be exclusively used during a motor vehicle stop or
110	211		other law enforcement action to assist law enforcement officers in
111	212		identifying and effectively comm unicating with a person who has been
112	213		diagnosed with an autism spectrum disorder.

114	214		4. Any information submitted to Service Oklahoma or licensed
115	215		operators pursuant to this section shall not be considered a
116	216		government record pursuant to subparagraph c of paragrap h 1 of
117	217		Section 24A.5 of Title 51 of the Oklahoma Statutes and shall not be
118	218		discoverable as a government record by any person, entity, or
119	219		governmental agency, except upon a subpoena issued by a grand jury
120	220		or a court order in a criminal matter.

122	221		5. Service Oklahoma, its employees, or licensed operators, for
123	222		the purpose of discharging their duties pursuant to this act, shall
124	223		not be liable to any person for civil damages or subject to criminal
125	224		prosecution resulting from or caused by:

128	253		by any accident, malfunction, act of sabotage or
129	254		nature, or any other condition or circumstance that
130	255		Service Oklahoma has not, directly or indirectly,
131	256		caused, and which prevents the holder of an Oklahoma
132	257		driver license or identification card from accessing
133	258		or inputting information into the registry established
134	259		pursuant to this subsection, or which results in, or

136	261		designated Service Oklahoma employees, and law
137	262		enforcement officers fr om accessing, establishing, or
138	263		maintaining the database,

140	264		b. any misuse of, or the failure or omission to input
141	265		accurate information, or the inputting of inaccurate
142	266		or outdated information into the registry by any
143	267		holder of an Oklahoma driver license or identification
144	268		card, or

146	269		c. the inability of any law enforcement officer to make
147	270		contact, in good faith, with any designated emergency
148	271		contact person. This limitation of liability is
149	272		inapplicable if such failure resulted from a malicious
150	273		purpose or a wanton a nd willful disregard for the
151	274		safety of persons or property.

153	302		6. With regard to the issuance of REAL -ID compliant licenses
154	303		containing designations pursuant to this section, Service Oklahoma
155	304		shall comply with all federal design requirements and shall see k
156	305		design approval from all necessary federal agencies, including, but
157	306		not limited to, the United States Department of Homeland Security.

159	307		7. Service Oklahoma is authorized to promulgate any rules
160	308		necessary to effectuate the provisions of this section.

162	309		SECTION 2. NEW LAW A new section of law to be codified
163	310		in the Oklahoma Statutes as Section 6 -125.1 of Title 47, unless
164	311		there is created a duplication in numbering, reads as follows:

166	312		The Department of Public Safety, in consultation with Service
167	313		Oklahoma, the Council on Law Enforcement Education and Training, the
168	314		Oklahoma Department of Mental Health and Substance Abuse Services,
169	315		and other entities or individuals with expertise in autism, shall
170	316		develop a program to assist and train law enforcem ent officers to
171	317		effectively communicate with a person who has been diagnosed with an
172	318		autism spectrum disorder by a licensed primary care physician,
173	319		licensed psychologist, or licensed psychiatrist. In addition, the
174	320		program shall include training in de -escalation methods when
175	321		interacting with a person who has been diagnosed with an autism
176	322		spectrum disorder, proper utilization of the registry established
177	323		pursuant to Section 1 of this act, proper utilization of any
178	324		specific information regarding an individual listed in the registry,
