53	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
54	53		SECTION 1. AMENDATORY 59 O.S. 2021, Section 1151.15, is
55	54		amended to read as follows:
56	55		Section 1151.15 A. The Board is authorized to investigate any
57	56		written complaint received pursuant to t he Roofing Contractor
58	57		Registration Act, including any person to the extent necessary to
59	58		determine if the person is engaged in violations of the provisions
60	59		of the Roofing Contrac tor Registration Act, including unlawful
61	60		activity of the practice of contractin g for roofing work without a
62	61		valid registration, whether the matter is prosecuted
63	62		administratively through the Roofing Hearin g Board or referred for
64	63		criminal prosecution. The B oard may refer the matter for

92	90		prosecution whether or not the person ceases the unlawful practice
93	91		of contracting for roofing work without a valid registration.
94	92		B. Service of the notice of violation or cit ation may be in
95	93		person or by certified mail at the l ast-known business address or
96	94		residence address of the person cited.
97	95		C. A notice of violation and citation may contain a cease and
98	96		desist order for residential roofing contractor work if the
99	97		homeowner has been provided the required disclosure and has
100	98		exercised the homeowner's option to cancel the contract as provided
101	99		in subsection I of Section 1151.5 of this title, or at any time
102	100		during commercial roofing contractor work.
103	101		D. The registrar shall read each complaint received and shall
104	102		enter a notation in th e individual roofing contractor 's record
105	103		showing record the date that the verif ied complaint was received and
106	104		the nature of process the complaint as provided by law. The
107	105		registrar shall notify the roofing contractor against whom the
108	106		complaint is made, in writing, within five (5) days of the receipt
109	107		of the written complaint. The roo fing contractor shall have ten
110	108		(10) days to respond, in writing, to the registrar. If a response
111	109		to the complaint is received by the registrar, whether admitt ing or
112	110		denying the basis of the complaint, a copy of both the complaint and
113	111		the response shall be sent to the district attorney along with the
114	112		results of any investigati on by the Board, if the Board does not
115	113		retain the matter and refers the complaint to th e district attorney.

143	140		If no response is received, the complaint may still be referred to
144	141		the district attorney, along with the results of any investigation
145	142		by the Board. The Board or a Committee member is authorized to
146	143		assist in any investigation of a roo fing complaint referred to the
147	144		district attorney, if requested by the district attorney. In
148	145		addition, the registrar shall enter a notation in the individual
149	146		roofing contractor's record showing the date that the roofing
150	147		contractor's response was received, if any, and whether the response
151	148		admitted or denied the basis of the complaint.
152	149		E. Following referral of a complaint to the district attorney,
153	150		if the roofing contractor is adjudicated by the court for an act or
154	151		omission specified in subsection A of Sectio n 1151.14 of this title,
155	152		or upon a conviction for any violation of the provisions of the
156	153		Roofing Contractor Registration Act, the registrar, when ordered by
157	154		the court, shall suspend, revoke or deny the roofing contractor 's
158	155		registration for the period of ti me specified by the court, and if
159	156		the court orders the registration suspended, revoked or denied, and
160	157		yet fails to set the term of such suspension, revocation or denial,
161	158		the period shall be six (6) months.
162	159		F. The registrar shall not renew, reinstate, or i ssue a new
163	160		roofing contractor registration to any person subject to any term of
164	161		denial, suspension or revocation until such term has been completed,
165	162		and thereafter, the person makes application and pays required fees
166	163		pursuant to Sections 1151.8 and 1151.12 of this title.

194	190		G. It shall be unlawful for a person to obtain or attempt to
195	191		obtain a roofing contractor registration certificate under any other
196	192		name during any period when the roofing contractor 's registration is
197	193		suspended or revoked. Upon conviction o f a violation of this
198	194		subsection, the person shall be guilty of a misdemeanor as provided
199	195		in Section 1151.3 of this title. A business firm, partnership,
200	196		association, corporation, limited liability company, or other group
201	197		or combination thereof acting as a unit whose registration
202	198		certificate is suspended or revoked includes all of the members,
203	199		partners, officers, and agents acting under that roofing contractor
204	200		registration certificate when such persons are specified on and did
205	201		sign the application or renewa l form.
206	202		SECTION 2. AMENDATORY 59 O.S. 2021, Section 1151.18, is
207	203		amended to read as follows:
208	204		Section 1151.18 Upon request, the registrar shall verify a
209	205		roofing contractor registration number to city, county and state
210	206		enforcement officials and to th e public. The registrar shall
211	207		establish through the Internet or other technolo gy a verification
212	208		system or direct access system for confirming roofing contractor
213	209		registration certificates and status of registration maintained by
214	210		the Construction Industries Board. The system shall include the
215	211		notation of each complaint received again st an individual roofing
216	212		contractor, his or her response to each complaint by noting whether
217	213		the roofing contractor admits or denies the allegation, any court

245	240		disposition of a complaint, if known, and any conviction for a
246	241		violation of the provisions of thi s act. In addition, the system
247	242		may include a notation for any conviction of a criminal violation in
248	243		this state, another state, or the United States when disclosed by a
249	244		criminal history records search on the individual roofing
250	245		contractor. Disclosure of any information through use of the
251	246		roofing contractor registration system or information maintained by
252	247		the registrar shall not be deemed to be an endorsement of any
253	248		roofing contractor or determination of any facts, qualifications,
254	249		information or reputation o f any roofing contractor by the
255	250		registrar, the state, the Construction Industries Board, or any of
256	251		their respective agents, officers, employees or assigns.
257	252		SECTION 3. This act shall become effective November 1, 2024.
