5956 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
6057 SECTION 1. NEW LAW A new section of law to be codified
6158 in the Oklahoma Statutes as Sectio n 1-866.1 of Title 63, unless
6259 there is created a duplication in numbering, reads as follows:
6360 As used in this section:
6461 1. "Consumer" means an individual seeking a referral to a
6562 senior living community on behalf of themselves or someone else as a
6663 representative;
64+2. "Fee" means anything of value and includes money or other
65+valuable consideration or services or the promise of money or other

94-2. "Fee" means anything of value and includes money or other
95-valuable consideration or services or the promise of money or other
9692 valuable consideration or services, received directly or indirectly
9793 by a referral agency;
9894 3. "Referral" means identifying and referring a consumer or
9995 consumer's representative to a senior living community to facilitate
10096 an evaluation, in consultation with the community, of whether the
10197 senior living community is a suitable option for the consumer ;
10298 4. "Referral agency" means an entity that provides referrals to
10399 senior living communities for a fee collected from a consumer, a
104100 consumer's representative, or a senior living community. The term
105101 does not include:
106102 a. a senior living community, its owners, or any of its
107103 employees or contractors in their individual capacity,
108104 or
109105 b. a resident or resident's family member who refers a
110106 consumer to the senior living community regardless of
111107 whether that individual receives a discount or other
112108 remuneration from the senior living community; and
113109 5. "Senior living community" means an adult foster care
114110 facility, life care facility, assisted living facility, retirement
115111 home, memory care facility, retirement village, home for the aging,
116112 or other facility that provides shelter, food, health care, s ocial
117113 activities, or other personal services to residents or patrons.

145140 SECTION 2. NEW LAW A new section of law to be codified
146141 in the Oklahoma Statutes as Section 1-866.2 of Title 63, unless

148143 A. At the time of the referral, a referral agency shall
149144 disclose the following to the consumer or consumer's representative:
150145 1. A description of the referral agency's service;
151146 2. A statement on whether the consumer or the senior living
152147 community to which the consumer is referred is responsible for
153148 paying the referral fee ; and
154149 3. A statement that the consumer may, without cause or penalty,
155150 stop using the referral agency.
156151 B. The referral agency may make the discl osure statement
157152 available to a consumer or consumer's representative by any of the
158153 following methods, which method may be selected at the sole
159154 discretion of the referral agency:
160155 1. A clear and conspicuous written physical or electronic
161156 document;
162157 2. A clear and conspicuous ele ctronic disclosure on their
163158 website; or
164159 3. An oral disclosure by telephone .

196190 1. Refer a consumer to a senior living community in which the
197191 referral agency has an ownership, management, or financial interest
198192 excluding a de minimis interest, such as a direct or indirect
199193 ownership of less than one percent (1%) of a senior living
200194 community;
201195 2. Hold a power of attorney or hold property in any capacity
202196 for a consumer or for whom a referral is made; or
203197 3. Refer a consumer to a senior living community that, to the
204198 referral agency's knowledge, is unlicensed and is not exempt from
205199 licensing under applicable law.
206200 SECTION 4. NEW LAW A new section of law to be codified
207201 in the Oklahoma Statutes as Section 1-866.4 of Title 63, unless
208202 there is created a duplication in numbering, reads as follows:
209203 A referral agency shall:
210204 1. Use a nationally accredited service provider to obtain
211205 criminal history record information, in accord ance with applicable
212206 law, on a referral agency employee who has direct contact with a
213207 consumer or a consumer's representative;
214208 2. Maintain liability insurance coverage for negl igent acts or
215209 omissions by the referral agency or its employees;
216210 3. Audit each senior living community to which the referral
217211 agency provides referrals to ensure that any appl icable license is
218212 in good standing and maintain a recor d of that audit; and

246239 4. Provide all referral agency employees whose job
247240 responsibilities require direct contact with a consumer or a
248241 consumer's representative with introductory train ing, including
249242 training on the referral agency's code of conduct, before the
250243 employee begins performing those responsibilities .
251244 SECTION 5. NEW LAW A new section of law to be codified
252245 in the Oklahoma Statutes as Section 1-866.5 of Title 63, unless
253246 there is created a duplication in numbering, reads as foll ows:
254247 A. A written contract entered into between a referral agency
255248 and a senior living community may provide for the compensation of a
256249 referral agency by a senior living community, without limitation,
257250 in:
258251 1. An amount for all referrals made by the referral agency to
259252 the senior living community in a specified period of time;
260253 2. An amount for each referral to the senior living community
261254 that is based on the cost of rent and care received by the consumer
262255 referred to the senior living community by the referral agency; or
263256 3. A fixed amount for each referral.
264257 B. Compensation paid to a referral agency that complies with
265258 the requirements set forth in this section will not be grounds for
266259 disciplinary action a gainst a long-term care administrator pursuant
267260 to OAC 310:679-10-20 or any other rule or statu te regulating long-
268261 term care administrators.

296288 SECTION 6. NEW LAW A new section of law to be codified
297289 in the Oklahoma Statutes as Section 1-866.6 of Title 63, unless
298290 there is created a duplication in numbering, reads as follows:
299291 A. A referral agency that violates this act is subject to a
300292 civil penalty in an amount equal to Five Hundred Dollars ($500.00)
301293 for each violation.
302294 B. The Attorney General or a district attorney may bring an
303295 action to recover a civil penalty imposed unde r subsection A of this
304296 section and to restrain and enjoin a violation of this act. The
305297 Attorney General or a district attorney may recover attorney fees
306298 and litigation costs incurred in bringing the action.
307299 SECTION 7. AMENDATORY 63 O.S. 2021, Section 1 -742, is
308300 amended to read as follows:
309301 Section 1-742. A. 1. Any person who intentionally or
310302 knowingly pays to or accepts anything of value from any person,
311303 firm, association of persons, partnership or corporation fo r
312304 securing or soliciting patients for any health care professional,
313305 health care provider or o ther entity providing health care services
314306 in this state, upon conviction, shall be guilty o f a misdemeanor and
315307 shall be punished by a fine of not less than Five H undred Dollars
316308 ($500.00) and not more than Two Thousand Dollars ($2,000.00).
317309 2. In addition to any other penalties or remedies provided by
318310 law:

346337 a. a violation of this section by a heal th care
347338 professional or health care provider shall be grounds
348339 for disciplinary action by the state agency licensing,
349340 certifying or registering such professional or
350341 provider, and
351342 b. the state agency licensing, certifying or registering
352343 such professional or provider may institute an action
353344 to enjoin violation or potential viola tion of this
354345 section.
355346 B. This section shall not be construed to prohibit:
356347 1. Advertising, except that advertising which:
357348 a. is false, misleading or deceptive,
358349 b. advertises profession al superiority or the performance
359350 of a professional service in a superior manner, and
360351 c. is not readily subject to verification;
361352 2. Remuneration for advertising, m arketing or other services
362353 that are provided for the purpose of securing or soliciting
363354 patients, provided the remuneration is:
364355 a. set in advance,
365356 b. consistent with the fair market value of the services,
366357 and
367358 c. not based on the volume or value of any patie nt
368359 referrals or business otherwise generated between the
369360 parties; and

397387 3. Any payment, busin ess arrangements or payments practice not
398388 prohibited by 42 U.S.C., Sect ion 1320a-7b(b), or any regulations
399389 promulgated pursuant thereto.
400390 C. This section shall not apply to licensed insurers, including
401391 but not limited to, group hospital service corporation s or health
402392 maintenance organizations which reimburse, provide, offer t o provide
403393 or administer hospital, medical, dental , or other health-related
404394 benefits under a health benefits plan for which it is the payor when
405395 it is providing those services under a he alth benefits plan, or
406396 referral agency as defined in paragraph 4 of Section 1 of this act.
407397 D. For purposes of this section:
408398 1. "Health care professional" means any person who offers or
409399 provides counseling or health or mental health care under a license,
410400 certification or registration issued pursuant to Title 59 of the
411401 Oklahoma Statutes; and
412402 2. "Health care provider" means any hospital or relate d
413403 institution offering or providing health care services licensed
414404 pursuant to Section 1 -702 of this title.
415405 SECTION 8. This act shall become effective November 1, 2024.
