10799 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
108100 SECTION 1. NEW LAW A new section of law to be codified
109101 in the Oklahoma Statutes as Section 696.1 of Title 63, unless there
110102 is created a duplication in numbering, reads as follows:
111103 This act shall be known and may be cited as the "Oklahoma
112104 Natural Disaster Protection and Preparedness Act ".
113105 SECTION 2. AMENDATORY 63 O.S. 2021, Section 683.6, is
114106 amended to read as follows:
115107 Section 683.6 A. There is hereby created the State Hazard
116108 Mitigation Team Interagency Resilience Coordination Council,
117109 composed of the administrative heads of the following agencies or
118110 their designees and led by the Oklahoma Department of Emergency
119111 Management:
120112 1. Oklahoma Department of Emergency Management, who shall serve
121113 as the Team Coordinator ;
122114 2. Oklahoma Water Resources Board;
123115 3. Oklahoma Climatological Survey;
124116 4. Oklahoma Conservation Commission;

207-2. Each presiding officer of the Legislature shall designate at
208-least one person to serve as the Legislature's resilience officer
209199 and shall transmit the name and contact information of each designee
210200 to the Oklahoma Department of Emergency Management and shall notify
211201 Oklahoma Department of Emergency Management of any change in the
212202 name or contact information of a desi gnee within ten (10) days;
213203 3. The Chief Justice of the Oklahoma Supreme Court shall
214204 designate at least one person to serve as the judiciary's resilience
215205 officer and shall transmit the name and contact information of each
216206 designee to the Oklahoma Department of Emergency Management and
217207 shall notify the Oklahoma Department of Emergency Managem ent of any
218208 change in the name or contact information of a designee within ten
219209 (10) days;
220210 4. The agency resilience officers shall coordinate activities
221211 with the Oklahoma Department of Emergency Management as necessary
222212 and shall serve on the Interagency Res ilience Coordination Council
223213 as provided in this section of this act.
224214 B. Depending on the circumstances, the Team Coordinator may
225215 request participation of the heads of any other state agencies as
226216 deemed appropriate.
227217 C. The Team Coordinator shall also req uest that a
228218 representative of the United States Army Corps of Engineer s be
229219 appointed by the administrative head of the Tulsa District to
230220 participate on the Team.
221+D. The Team Coordinator shall also request a representative of
222+the U.S. Department of Housing and Urban Development be appointed by

258-D. The Team Coordinator shall also request a representative of
259-the U.S. Department of Housing and Urban Development be appointed by
260249 the administrative head of the Oklahoma City office to participate
261250 on the team.
262251 E. The State Hazard Mitigation Team will meet as determined by
263252 the Team Coordinator to review and recommend updates to the State
264253 Comprehensive All-hazard Mitigation Plan, and shall have those
265254 additional responsibilities as provided by t he Team Coordinator,
266255 including, but not limited to, the review and r ecommendation for
267256 loan and grant application under the Oklahoma Flood Hazard
268257 Mitigation Program.
269258 B. The Interagency Resilience Coordination Council is
270259 established to maintain awareness, communication, and alignment with
271260 regard to the state's resilience and risk mitigation needs,
272261 progress, and priorities, and to oversee development of the
273262 statewide resilience report.
274263 C. The Council shall be comprised of the resilience officers
275264 from each state agency. The Oklahoma Department of Emergency
276265 Management shall serve as the chair.
277266 D. The Council shall meet upon the call of the chair, with a
278267 minimum of four meetings annually.
279268 E. The Council shall make recommendations to and render
280269 assistance and guidance to agenci es in the development o f strategic
281270 plans for resilience.

309-F. The Council will meet annually to:
310298 1. Review and recommend updates to state mitigation and
311299 resilience planning efforts;
312300 2. Provide support and assistance in the preparation and
313301 maintenance of the State Hazard Mitigation Pla n as required by the
314302 federal Disaster Mitigation Act of 2000, U.S.C 5121 , et seq., which
315303 requires all states to adopt and maintain a Federal Emergency
316304 Management Agency-approved State Hazard Mitigation Plan as a
317305 prerequisite for receiving federal disaster assistance under the
318306 Stafford Act; provided, however, the Oklahoma Department of
319307 Emergency Management shall be responsible for day to day execution
320308 of the Plan.
321309 SECTION 3. NEW LAW A new section of law to be codified
322310 in the Oklahoma Statutes as S ection 696.2 of Title 63, unless there
323311 is created a duplication in numbering, reads as follows:
324312 A. This act hereby instructs the Oklahoma Department of
325313 Emergency Management to serve as the lead resilience office fo r the
326314 state and to perform the functions and duties provided in this act.
327315 B. For purposes of this ac t, the term "resilience" shall mean a
328316 capability to anticipate, prepare for, respond to, and recover from
329317 significant multi-hazard threats with minimal damage to social wel l-
330318 being, the economy, infrastructure, and the environment.

361348 The Oklahoma Department of Emergency Management shall :
362349 1. Coordinate and provide strategic direction f or government
363350 resilience initiatives in order to build long-term resilience for a
364351 robust, vibrant economic activity and a sustainable natural
365352 environment for Oklahoma residents ;
366353 2. Designate a resilience officer within the agency;
367354 3. Provide technical guidance to agencies, as well as local and
368355 regional jurisdictions, to integrate statewide resilience goals into
369356 future projects, plans, and programs ;
370357 4. Review and reconcile sta te agency comments on federally
371358 sponsored resilience and risk mitigation activities to establish and
372359 present an official state position;
373360 5. Pursue all available federal and private funds consistent
374361 with the purposes of this act ; and
375362 6. Appraise the adequacy of statutory and administr ative
376363 mechanisms for coordinati ng the state's policies and programs at
377364 both the intrastate and interstate levels with respect to resilience
378365 and risk mitigation;
379366 7. Appraise the adequacy of federal, re gional, state, and local
380367 programs to achieve the policies and meet the goals of the st ate
381368 with respect to resilience and risk mitigation;
369+8. Coordinate and focus federal involvement in Oklahoma with
370+respect to resilience and risk mitigation;

409-8. Coordinate and focus federal involvement in Oklahoma with
410-respect to resilienc e and risk mitigation;
411397 9. Provide official state recommendations to the Legislature
412398 and United States Congress with respect to policies, programs, and
413399 coordinating mechanisms relative to resilience and risk mitigation;
414400 10. Assist with the state 's planning efforts to ensure the
415401 incorporation and alignment of the state's resilience goals and
416402 objectives into a unified, proactive, pre-disaster approach to
417403 adaptation and long-term resilience;
418404 11. Represent the resilience and risk mitigation poli cy of the
419405 state at the federal, regional, state, and local levels; and.
420406 12. Integrate resilience into pre -disaster planning and post-
421407 disaster recovery.
422408 SECTION 5. NEW LAW A new section of law to be codified
423409 in the Oklahoma Statu tes as Section 696.4 of Title 63, unless there
424410 is created a duplication in numbering, reads as fol lows:
425411 A. To coordinate and strengthen efforts to reduce losses from
426412 future disasters across the state, the Oklahoma Department of
427413 Emergency Management shall contribute to all statewide planning
428414 efforts related to resilience and risk mitigation and shall develop
429415 a strategic statewide resilience report to p rotect the state from
430416 multiple threats. The report shall include, but is not limited to,
431417 the following:
432418 1. Articulation of the state's resilience goals and objectives;
419+2. Utilization of best available science, including a range of
420+future projections, to identify and implement policies, projects,

465450 on a vulnerability assessment of risks to agency mission areas,
466451 assets, services, and populations serve d from multiple environmental
467452 threats;
468453 4. Descriptions of agency strategic actions; and
469454 5. Progress on activities identified in th e State Hazard
470455 Mitigation Plan.
471456 B. The statewide resilience report shall be updated every year
472457 with the latest available science and updated conditions.
473458 C. The Oklahoma Department of Emergency Management shall submit
474459 the annual statewide resilie nce report to the Legislature by
475460 November 15 every year.
476461 SECTION 6. NEW LAW A new section of law to be codified
477462 in the Oklahoma Statutes as Section 696.5 of Title 63, unless there
478463 is created a duplication in numbering, reads as follows:
479464 A. There is hereby established the Oklahoma R esilience Task
480465 Force to provide strategic direction to resilience efforts across
481466 the state.
482467 B. The task force shall be composed of the following members:
468+1. The Director of the Oklah oma Department of Emergency
469+Management, who shall serve as chair and shall represent the views
470+of the Interagency Resilience Coordination Council;

530514 organizations, and advisors from Federal agencies to serve on the
531515 task force and shall incorporate State, local, and tribal government
532516 and private sector input in the development and revision of the
533517 State Hazard Mitigation Plan and other related plans and strategies.

571554 SECTION 8. This act shall become effective July 1, 2024.
572555 SECTION 9. It being immediately necessary for the preservation
573556 of the public peace, health or safety, an emergency is hereby
574557 declared to exist, by reason whereof this act shall take effect and
575558 be in full force from and after its passage and approval.
