216 | 231 | SECTION 2. NEW LAW A new section o f law to be codified | |
217 | 232 | in the Oklahoma Statutes as Se ction 10102 of Title 74, unless there | |
218 | 233 | is created a duplica tion in numbering, reads as follows: | |
219 | 234 | A. Not later than December 31, 2024, and annually thereafter, | |
220 | 235 | the Office of Management and Enterprise Se rvices (OMES) shall | |
221 | 236 | conduct an inventory of all systems that employ artifici al | |
222 | 237 | intelligence and are in use by any state a gency that uses OMES's | |
223 | 238 | services. Any agency that does not use OMES's services shall | |
224 | 239 | conduct their own inventory. Each such inventory shall include at a | |
225 | 240 | minimum the following information for each such system: | |
226 | 241 | 1. The name of such system and the vendor, if any, that | |
227 | 242 | provided such system; | |
228 | 243 | 2. A description of the general capabilities and uses of such | |
229 | 244 | system; | |
230 | - | 3. Whether such system was used to independently make, inform, | |
231 | - | or materially support a conclusion, decision, or judgment; and | |

291 | 307 | A. Beginning on February 1, 2025, the Office of Management and | |
292 | 308 | Enterprise Services (OMES) or any agency that does not use OMES's | |
293 | 309 | services shall perform ongoing assessments of system s that employ | |
294 | 310 | artificial intelligence and are in us e by state agencies to ensure | |
295 | 311 | that no such system shall result in any unlawful discrimination or | |
296 | 312 | disparate impact described in subsection B of this section. | |
297 | 313 | B. Not later than February 1, 202 5, the Office of Management | |
298 | 314 | and Enterprise Services shall develop and establish policies and | |
299 | 315 | procedures concerning the development, procurement, implement ation, | |
300 | 316 | utilization, and ongoing assessment of systems that employ | |
301 | 317 | artificial intelligence and are in use by state ag encies. Such | |
302 | 318 | policies and procedures shall, at a m inimum, include poli cies and | |
303 | 319 | procedures that: | |

366 | 383 | pregnancy, veteran status, disability, or lawful | |

368 | 385 | 3. Require a state agency to assess the lik ely impact of any | |
369 | 386 | such system before implementing such system; and | |
370 | 387 | 4. Provide for the Office of Management and Enterprise Services | |
371 | 388 | or any agency that does not use OM ES's services to perform ongoing | |
372 | 389 | assessments of such systems to ensure that no such system results in | |
373 | 390 | any unlawful discrimination or disparate impact described in | |
374 | 391 | paragraph 2 of this subsection. | |
375 | 392 | C. The Office of Management and Enterprise Serv ices may revise | |
376 | 393 | policies and procedures established in this act if such revision is | |
377 | 394 | deemed necessary by the Executive Director. | |
