7689 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7790 SECTION 1. NEW LAW A new section of law to b e codified
7891 in the Oklahoma Statutes as Section 10101 of Title 74, unless there
7992 is created a duplication in numbering, reads as follows:
8093 As used in this act:
8194 1. "Artificial intelligence" means:
82-a. an artificial system that:
83-(1) performs tasks under varying and unpredictable
84-circumstances without significant human oversight

146+a. an artificial system that:
147+(1) performs tasks under varying and unpredictable
148+circumstances without significant human oversight
135149 or can learn from experience and improve such
136150 performance when exposed to data sets ,
137151 (2) is developed in any context, including, but not
138152 limited to, software or physical hardware, and
139153 solves tasks requiring human-like perception,
140154 cognition, planning, learning, communication or
141155 physical action, or
142156 (3) is designed to:
143157 (a) think or act like a human, i ncluding, but
144158 not limited to, a cognitive architecture or
145159 neural network, or
146160 (b) act rationally, including, but n ot limited
147161 to, an intelligent software agent or
148162 embodied robot that achieves goals using
149163 perception, planning, reasoning, learning,
150164 communication, decision-making or action, or
151165 b. a set of techniques, including, but not limited to,
152166 machine learning, that i s designed to approximate a
153167 cognitive task; and
154168 2. "State agency" means each department, b oard, council,
155169 commission, institution , or other agency of the executive branch of

221+the state government, provided each board, council, commission ,
222+institution, or other agency included by law within any giv en
208223 department shall be deemed a divi sion of that department. The term
209224 "state agency" shall include:
210225 a. the offices of the Governor, Lieutenant Governor,
211226 Treasurer, Attorney General, Secretary of State and
212227 Comptroller, and
213228 b. all operations of an executive branch agency which are
214229 funded by either the General Revenue Fund or a special
215230 fund.
216231 SECTION 2. NEW LAW A new section o f law to be codified
217232 in the Oklahoma Statutes as Se ction 10102 of Title 74, unless there
218233 is created a duplica tion in numbering, reads as follows:
219234 A. Not later than December 31, 2024, and annually thereafter,
220235 the Office of Management and Enterprise Se rvices (OMES) shall
221236 conduct an inventory of all systems that employ artifici al
222237 intelligence and are in use by any state a gency that uses OMES's
223238 services. Any agency that does not use OMES's services shall
224239 conduct their own inventory. Each such inventory shall include at a
225240 minimum the following information for each such system:
226241 1. The name of such system and the vendor, if any, that
227242 provided such system;
228243 2. A description of the general capabilities and uses of such
229244 system;
230-3. Whether such system was used to independently make, inform,
231-or materially support a conclusion, decision, or judgment; and

296+3. Whether such system was used to independently make, inform,
297+or materially support a conclusion, decision, or judgment; and
282298 4. Whether such system underwent an impact asses sment prior to
283299 implementation.
284300 B. The Office of Management and Enterprise Serv ices or agencies
285301 that do not use OMES 's services shall make each inventory conducted
286302 pursuant to subsection A of this section publicly available on their
287303 website.
288304 SECTION 3. NEW LAW A new section of law to be codified
289305 in the Oklahoma Statutes as Section 10103 of Title 74, unless there
290306 is created a duplication in numbering, reads as follow s:
291307 A. Beginning on February 1, 2025, the Office of Management and
292308 Enterprise Services (OMES) or any agency that does not use OMES's
293309 services shall perform ongoing assessments of system s that employ
294310 artificial intelligence and are in us e by state agencies to ensure
295311 that no such system shall result in any unlawful discrimination or
296312 disparate impact described in subsection B of this section.
297313 B. Not later than February 1, 202 5, the Office of Management
298314 and Enterprise Services shall develop and establish policies and
299315 procedures concerning the development, procurement, implement ation,
300316 utilization, and ongoing assessment of systems that employ
301317 artificial intelligence and are in use by state ag encies. Such
302318 policies and procedures shall, at a m inimum, include poli cies and
303319 procedures that:

371+1. Govern the procurement, implementation , and ongoing
372+assessment of such systems by stat e agencies;
356373 2. Are sufficient to ensure that no such system :
357374 a. results in any unlawful discrimination against any
358375 individual or group of i ndividuals, or
359376 b. has any unlawful disparate impact on any individual or
360377 group of individuals on the basis of any actual or
361378 perceived differentiating characteristics, including,
362379 but not limited to, age, genetic information, color,
363380 ethnicity, race, creed, r eligion, national origin,
364381 ancestry, sex, gender identity or expression, sexual
365382 orientation, marital status, familial status,
366383 pregnancy, veteran status, disability, or lawful
367384 source of income;
368385 3. Require a state agency to assess the lik ely impact of any
369386 such system before implementing such system; and
370387 4. Provide for the Office of Management and Enterprise Services
371388 or any agency that does not use OM ES's services to perform ongoing
372389 assessments of such systems to ensure that no such system results in
373390 any unlawful discrimination or disparate impact described in
374391 paragraph 2 of this subsection.
375392 C. The Office of Management and Enterprise Serv ices may revise
376393 policies and procedures established in this act if such revision is
377394 deemed necessary by the Executive Director.
378-D. The Office of Management and Enterprise Services shall post
379-policies and procedures established pursuant to this act and any

446+D. The Office of Management and Enterprise Services shall post
447+policies and procedures established pursuant to this act and any
430448 revision made to such policies and procedures pursu ant to subsection
431449 C on the agency's website.
432450 E. Beginning on February 1, 2025, no state agency shall
433451 implement any system th at employs artificial intelligence:
434452 1. Unless the state agency has performed an impact assess ment,
435453 in accordance with the policies and procedures established pursuant
436454 to this act, to ensure that such s ystem will not result in any
437455 unlawful discrimination o r disparate impact described herein; or
438-2. If the head of such state agency determines , at his or her

439457 discretion, that such system will result in any unlawful
440458 discrimination or disparate impact described in this act.
441459 SECTION 4. This act shall become effective November 1, 2024.
