77	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78		SECTION 1. AMENDATORY 70 O.S. 2021, Section 13 -101.2, is
79	79		amended to read as follows:
80	80		Section 13-101.2 A. There is hereby created the Lindsey Nicole
81	81		Henry Scholarships for Students with Disabilities Pr ogram. The
82	82		Lindsey Nicole Henry Scholarships for Students with Disabilities
83	83		Program is established to provide a scholarship to a private school
84	84		of choice for students with disabilities for whom an individualized
85	85		education program (IEP) in accordance with the Individuals with
86	86		Disabilities Education Act (IDEA) or an individualized service p lan
87	87		(ISP) pursuant to Section 1 -4-704 of Title 10A of the Oklahoma
88	88		Statutes has been developed at any time prior to notifying the State

140	140		Department of Education of the inte nt to participate in the Program
141	141		and the IEP or ISP is in effect at the time the request for a
142	142		scholarship is received by the State Department of Education , or for
143	143		students who have at least one incarcerated parent at the time the
144	144		request for a scholarship is received by the Department .
145	145		Scholarships shall be awarded beginning with the 2010 -2011 school
146	146		year.
147	147		B. The parent or legal guardian of a public school student with
148	148		a disability, on an individualized service plan, or with at least
149	149		one incarcerated par ent may exercise their parental option and
150	150		request to have a Lindsey Nicole Henry Scholarship awarded for the
151	151		child to enroll in and attend a private school in accordance with
152	152		this section and the scholar ship shall be awarded if:
153	153		1. The student has spent the prior school year in attendance at
154	154		a public school in this state. For purposes of this section, "prior
155	155		school year in attendance " means that the student was enrolled in
156	156		and reported by a school distr ict for funding purposes during the
157	157		preceding school year regardless of whether or not the student had
158	158		an IEP at the time the student was counted for funding purposes. A
159	159		student who is a child of a member of the United States Armed Forces
160	160		who transfers to a school in this state from out of state or from a
161	161		foreign country pursuant to a permanent change of station orders of
162	162		the parent shall be exempt from the requirements of this paragraph
163	163		but shall be required to meet all other eligibility requirements to

215	215		participate as provided for in this section. A stude nt who has been
216	216		provided services under an Individ ual Family Service Plan through
217	217		the SoonerStart program and during transition was evaluated and
218	218		determined to be eligible for school district services sha ll be
219	219		exempt from the requirements of this paragraph but shall be required
220	220		to meet all other eligibili ty requirements to participate as
221	221		provided for in this section. A student who was in out -of-home
222	222		placement with the Department of Human Services, who was adopted
223	223		while in the permanent custody of the Depar tment of Human Services
224	224		or, who was in out-of-home placement with the Office of Juvenile
225	225		Affairs, or who has at least one incarcerated parent shall be exempt
226	226		from the requirements of this paragraph but sh all be required to
227	227		meet all other eligibility requir ements to participate as provided
228	228		for in this section; and
229	229		2. The parent or legal guardian has obtained acceptance for
230	230		admission of the student to a private school that is eligible for
231	231		the program as provided in subsection H of this section and has
232	232		notified the State Department of Education of the request for a
233	233		scholarship. Requests to participate in the program made after
234	234		December 1 shall be granted, but funding for scholarships requested
235	235		after December 1 shall not be available until the beginning of the
236	236		next school year. The request shall be through a communication
237	237		directly to the Department in a manner that creates a written or
238	238		electronic record of the request and the date of receipt of the

290	290		request. The Department shall notify the school district upon
291	291		receipt of the request. For purposes of continuity of educational
292	292		choice, the scholarship shal l remain in force until the student
293	293		returns to a public school, graduates from high school or reaches
294	294		the age of twenty-two (22), whichever occurs first. At an y time,
295	295		the parent or legal guardian of the student may remove the student
296	296		from the private scho ol and place the student in another private
297	297		school that is eligible for the program as provided in subsectio n H
298	298		of this section or place the student in a public school.
299	299		C. A student shall be eligible for a scholarship if the parent
300	300		or legal guardian of th e student made a request for a scholarship
301	301		for the 2010-2011 school year and the student transferred to an
302	302		eligible private school but was subsequently denied a scholarship
303	303		because the student did not have an IEP or ISP in effect on October
304	304		1, 2009, but did meet all other eligibility requirements as set
305	305		forth in the Lindsey Nicole Henry Scholarships for Students with
306	306		Disabilities Program Act.
307	307		D. A student shall not be eligible for a Lindsey Nicole Henry
308	308		Scholarship if the student is not having regular and direct contact
309	309		with the private school teachers at the physical location of the
310	310		private school.
311	311		E. School districts shall notify the parent or legal guardian
312	312		of a public school student with a disability or a student who has at
313	313		least one incarcerated parent of all options available pursuant to

365	365		this section and infor m the parent or legal guardian of the
366	366		availability of information about the program from the State
367	367		Department of Education through the toll -free telephone number or
368	368		website. The notification shall be provided with or included in the
369	369		copy of the "Parents Rights in Special Education: Notice of
370	370		Procedural Safeguards" document given to parents at least ann ually
371	371		or as otherwise required by law.
372	372		F. 1. Acceptance of a Lindsey Nicole Henry Scholarship shall
373	373		have the same effect as a parental revocation of consen t to service
374	374		pursuant to 20 U.S.C., Sections 1414(a)(1 )(D) and 1414(C) of the
375	375		IDEA.
376	376		2. Upon acceptance of a Lindsey Nicole Henry Scholarship, the
377	377		parent or legal guardian shall assume full financial responsibility
378	378		for the education of the student, includi ng but not limited to
379	379		transportation to and from the p rivate school.
380	380		G. If the parent or legal gua rdian requests a Lindsey Nicole
381	381		Henry Scholarship and the student is accepted by the private school
382	382		pending the availability of a space for the student, the parent or
383	383		legal guardian of the student shall notify t he State Department of
384	384		Education before enter ing the private school and before December 1
385	385		in order to be eligible for the scholarship during the school year
386	386		when a space becomes available for the studen t in the private
387	387		school. If notification is made afte r December 1, payment of the
388	388		scholarship shall not begin until the next school year.

440	440		H. 1. To be eligible to participate in the Lindsey Nicole
441	441		Henry Scholarships for Students with Disabilities Program , a private
442	442		school shall notify the State Department o f Education of its intent
443	443		to participate. The notice shall specify the grade levels and
444	444		services that the private school has available for students with
445	445		disabilities who are participating in the schola rship program. The
446	446		State Department of Education shal l approve a private school as
447	447		eligible to participate in the scholarship program upon
448	448		determination that the private school:
449	449		a. meets the accreditation requirements set by the State
450	450		Board of Education o r another accrediting association
451	451		approved by the Stat e Board of Education. The State
452	452		Department of Education shall list on its website all
453	453		accrediting associations approved by the Board,
454	454		b. demonstrates fiscal soundness by having been in
455	455		operation for one (1) school year or providing the
456	456		State Department of Education with a statement by a
457	457		certified public accountant confirming that the
458	458		private school desiring to participate is insured and
459	459		the owner or owners have sufficient capital or credit
460	460		to operate the school for the upcoming year by serving
461	461		the number of students anticipated with expected
462	462		revenues from tuition and other sources that may be
463	463		reasonably expected. In lieu of a statement, a surety

515	515		bond or letter of credit for the amount equal to the
516	516		scholarship funds for any quarter may be filed with
517	517		the Department,
518	518		c. complies with the antidiscriminat ion provisions of 42
519	519		U.S.C., Section 2000d,
520	520		d. meets state and local health and safety laws and
521	521		codes,
522	522		e. will be academically accountable to the parent or
523	523		legal guardian for meeting the educational needs of
524	524		the student,
525	525		f. employs or contracts with teache rs who hold
526	526		baccalaureate or higher degrees, or have at least
527	527		three (3) years of teaching experience in public or
528	528		private schools, or have special skills, kn owledge, or
529	529		expertise that qualifies them to provide i nstruction
530	530		in subjects taught,
531	531		g. complies with all state laws relating to general
532	532		regulation of private schools, and
533	533		h. adheres to the tenets of its published disciplinary
534	534		procedures prior to the expul sion of a scholarship
535	535		student.
536	536		2. Upon approval of a private school, the State Department of
537	537		Education shall provide on its website all information and material
538	538		submitted by the private school with its application.

590	590		I. 1. Lindsey Nicole Henry Scholarship Program participants
591	591		shall comply with the following:
592	592		a. the parent or legal guardian shall select the private
593	593		school from the schools approved for eligibility
594	594		pursuant to subsection H of this section and apply for
595	595		the admission of the child,
596	596		b. the parent or legal guardian shall request the
597	597		scholarship no later than December 1 of the school
598	598		year during which the scholarship is requested,
599	599		c. any student participating in the scholarship program
600	600		shall attend throughout the school year, unless
601	601		excused by the school for illness or other good cause,
602	602		and shall comply fully with the code of conduct for
603	603		the school,
604	604		d. the parent or legal guardian shall fully comply with
605	605		the parental involvement requirements of the private
606	606		school, unless excused by the school for il lness or
607	607		other good cause, and
608	608		e. upon issuance of a s cholarship warrant, the parent or
609	609		legal guardian to whom the warrant is made shall
610	610		restrictively endorse the warrant to the private
611	611		school for deposit into the account of the private
612	612		school. The parent or legal guardian may not
613	613		designate any entity or ind ividual associated with the

666	666		or legal guardian to endorse a warrant. A parent or
667	667		legal guardian who fails to comply with this
668	668		subparagraph shall for feit the scholarship.
669	669		2. A participant who fails to c omply with this subsection
670	670		forfeits the scholarship.
671	671		J. Provisions governing payment of a Lindsey Nicole Henry
672	672		Scholarship shall be as follows:
673	673		1. The State Department of Education shall calculate the total
674	674		cost of all scholarships for all eligible stude nts in the state.
675	675		The State Department of Ed ucation shall then reserve or retain from
676	676		the total amount appropriated to the State Board of Education for
677	677		State Aid purposes and any other revenue availabl e for allocation
678	678		for State Aid purposes the total cost for all scholarship payments;
679	679		2. The maximum scholarship granted for an eligible student with
680	680		disabilities shall be a calculated amount equivalent to the total
681	681		State Aid factors for the applicable sch ool year multiplied by the
682	682		grade and disability weight s generated by that student for the
683	683		applicable school year. The disability weights used in calculating
684	684		the scholarship amount shall include all disability weights which
685	685		correspond to the disabilities i ncluded in the multidisciplinary
686	686		evaluation and eligib ility group summary for the student at the ti me
687	687		the request for a scholarship is made by the parent or legal
688	688		guardian. The maximum scholarship amount shall be calculated by the

741	741		in the scholarship program;
742	742		3. The amount of the schol arship shall be the amount calculated
743	743		in paragraph 2 of this subsection or the amount of tuition and fees
744	744		for the private school, whichever is less, minus up to two and one-
745	745		half percent (2 1/2%) of the scholarsh ip amount which may be
746	746		retained by the State Department of Education as a fee for
747	747		administrative services rendered. The amount of any assessment fee
748	748		required by the private school and the amount associ ated with
749	749		providing services and therapies to address the disabilities of the
750	750		student may be paid f rom the total amount of the scholarship. The
751	751		amount of the scholarship shall be prorated to reflect the number of
752	752		days remaining in the current school year, if the scholarship
753	753		request is granted after the begin ning of the school year;
754	754		4. The State Depart ment of Education shall notify the private
755	755		school of the amount of the scholarship within ten (10) days after
756	756		receiving the request for a scholarship, when t he total State Aid
757	757		factors have been determined for th e current fiscal year. The
758	758		initial payment shall be made after the Department verifies
759	759		admission acceptance and enrollment. Quarterly payments shall be
760	760		made upon verification of continued enrollment a nd attendance at the
761	761		private school. Payment shall be made by the Department with an
762	762		individual warrant made payable to the parent or legal guardian of
763	763		the student and mailed by the Department to the private school that

815	815		the parent or legal guardian choose s. The parent or legal guardian
816	816		shall restrictively e ndorse the warrant to the private school for
817	817		deposit into the account of the private school;
818	818		5. The State Department of Education shall not be responsible
819	819		for any additional costs associated with speci al education and
820	820		related services incurred by the priv ate school for the student
821	821		including the cost of teachers, equipment, material, and special
822	822		costs associated with the special education class;
823	823		6. The State Department of Education shall establish a tol l-
824	824		free telephone number or website that provides paren ts or legal
825	825		guardians and private schools wit h information about the program;
826	826		7. The State Department of Education shall require an annual,
827	827		notarized, sworn compliance statement by participating privat e
828	828		schools certifying compliance with state laws and sh all retain all
829	829		records received from a partic ipating private school. The State
830	830		Department of Education shall post on its website the annual
831	831		compliance statement for each participating private school; a nd
832	832		8. The State Department of Education shall cross -check the list
833	833		of participating scholarship st udents with the public school
834	834		enrollments prior to each scholarship payment to avoid duplication.
835	835		K. 1. The State Superintendent of Public Instruction shal l
836	836		deny, suspend, or revoke the participation of a priv ate school in
837	837		the scholarship program if it i s determined that the private school
838	838		has failed to comply with the provisions of this section. However,

890	890		in instances in which the noncompliance is correctab le within a
891	891		reasonable amount of time and in which the health, safety, or
892	892		welfare of the students i s not threatened, the Superintendent may
893	893		issue a notice of noncompliance which shall provide the private
894	894		school with a time frame within which to provide evi dence of
895	895		compliance prior to taking action to suspend or revoke participation
896	896		in the scholarship pr ogram.
897	897		2. If the Superintendent intends to deny, suspend, or revoke
898	898		the participation of a private school in the scholarship program,
899	899		the Department shall n otify the private school of the proposed
900	900		action in writing by certified mail and regular mail to th e private
901	901		school's address of record with the Department. The Department
902	902		shall also notify any parents or legal guardians of scholarship
903	903		students attending the private school. The notification shall
904	904		include the reasons for the proposed action and notice of the
905	905		timelines and procedures set forth in this subsection.
906	906		3. The private school that is adversely affected by the
907	907		proposed action shall have fifteen (15 ) days from receipt of the
908	908		notice of proposed action t o file with the Department a request for

966	966		5. The Board may immediately suspend payment of scholarship
967	967		funds if it is determined that there is probable cause to believe
968	968		that there is an imminent th reat to the health, safety, or welfare
969	969		of the students or fraudulent activity on the part of the private
970	970		school.
971	971		L. A parent or legal guardian who applies for a Lindsey Nicole
972	972		Henry Scholarship for a public school student who has at least one
973	973		incarcerated parent shall, in support of the application, provide
974	974		documentation verifying a parent is incarcerated and in the custody
975	975		of the Department of Corrections, another out -of-state prison
976	976		system, or the Federal Bureau of Prisons. The documentation shal l
977	977		include, but not be limited to, the active Departm ent of Corrections
978	978		inmate number for the incarcerated parent.
979	979		M. No liability shall arise on the part of the state, the State
980	980		Board of Education, the State Department of Education or a school
981	981		district based on the award or use of any scholarship provided
982	982		through the Lindsey Nicole Henry Scholarships for Students with
983	983		Disabilities Program.
984	984		M. N. The inclusion of private schools within options available
985	985		to public school students in Oklahoma shall not expand the
986	986		regulatory authority of the state or any schoo l district to impose
987	987		any additional regulation of private schools beyond those reasonably

1040	1040		section.
1041	1041		N. O. If the State Department of Education de termines that a
1042	1042		school district prior to the effective date of this act has failed
1043	1043		to comply with the provisions of the Lindsey Nicole Henry
1044	1044		Scholarships for Students with Disabilities Program Act and h as
1045	1045		failed to make full or partial scholarship payments for eligible
1046	1046		students, the Department shall have authority to reduce the amount
1047	1047		of State Aid allocated to the school district or require the school
1048	1048		district to make repayment to the Department of State Aid
1049	1049		allocations in an amount equal to the amount of s cholarship payments
1050	1050		the school district faile d to make. The Department shall make
1051	1051		payment to the parent or legal guardian in the amount the school
1052	1052		district failed to make in the manner as provided for in subsection
1053	1053		J of this section.
1054	1054		O. P. The State Department of Education shall annually prepare
1055	1055		and post on its website a report of Lindsey Nicole Henry
1056	1056		Scholarships for Students with Disabilities Program. The annual
1057	1057		report shall include, but not be limited to, the following
1058	1058		information:
1059	1059		1. The total number and amount of scholarships awarded and
1060	1060		reported for each participating private school;
1061	1061		2. The total number of scholarships denied;

1119	1119		SECTION 2. This act shall become effective November 1, 2024.
