7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 70 O.S. 2021, Section 13 -101.2, is
7979 amended to read as follows:
8080 Section 13-101.2 A. There is hereby created the Lindsey Nicole
8181 Henry Scholarships for Students with Disabilities Pr ogram. The
8282 Lindsey Nicole Henry Scholarships for Students with Disabilities
8383 Program is established to provide a scholarship to a private school
8484 of choice for students with disabilities for whom an individualized
8585 education program (IEP) in accordance with the Individuals with
8686 Disabilities Education Act (IDEA) or an individualized service p lan
8787 (ISP) pursuant to Section 1 -4-704 of Title 10A of the Oklahoma
8888 Statutes has been developed at any time prior to notifying the State

141141 and the IEP or ISP is in effect at the time the request for a
142142 scholarship is received by the State Department of Education , or for
143143 students who have at least one incarcerated parent at the time the
144144 request for a scholarship is received by the Department .
145145 Scholarships shall be awarded beginning with the 2010 -2011 school
146146 year.
147147 B. The parent or legal guardian of a public school student with
148148 a disability, on an individualized service plan, or with at least
149149 one incarcerated par ent may exercise their parental option and
150150 request to have a Lindsey Nicole Henry Scholarship awarded for the
151151 child to enroll in and attend a private school in accordance with
152152 this section and the scholar ship shall be awarded if:
153153 1. The student has spent the prior school year in attendance at
154154 a public school in this state. For purposes of this section, "prior
155155 school year in attendance " means that the student was enrolled in
156156 and reported by a school distr ict for funding purposes during the
157157 preceding school year regardless of whether or not the student had
158158 an IEP at the time the student was counted for funding purposes. A
159159 student who is a child of a member of the United States Armed Forces
160160 who transfers to a school in this state from out of state or from a
161161 foreign country pursuant to a permanent change of station orders of
162162 the parent shall be exempt from the requirements of this paragraph
163163 but shall be required to meet all other eligibility requirements to

215215 participate as provided for in this section. A stude nt who has been
216216 provided services under an Individ ual Family Service Plan through
217217 the SoonerStart program and during transition was evaluated and
218218 determined to be eligible for school district services sha ll be
219219 exempt from the requirements of this paragraph but shall be required
220220 to meet all other eligibili ty requirements to participate as
221221 provided for in this section. A student who was in out -of-home
222222 placement with the Department of Human Services, who was adopted
223223 while in the permanent custody of the Depar tment of Human Services
224224 or, who was in out-of-home placement with the Office of Juvenile
225225 Affairs, or who has at least one incarcerated parent shall be exempt
226226 from the requirements of this paragraph but sh all be required to
227227 meet all other eligibility requir ements to participate as provided
228228 for in this section; and
229229 2. The parent or legal guardian has obtained acceptance for
230230 admission of the student to a private school that is eligible for
231231 the program as provided in subsection H of this section and has
232232 notified the State Department of Education of the request for a
233233 scholarship. Requests to participate in the program made after
234234 December 1 shall be granted, but funding for scholarships requested
235235 after December 1 shall not be available until the beginning of the
236236 next school year. The request shall be through a communication
237237 directly to the Department in a manner that creates a written or
238238 electronic record of the request and the date of receipt of the

290290 request. The Department shall notify the school district upon
291291 receipt of the request. For purposes of continuity of educational
292292 choice, the scholarship shal l remain in force until the student
293293 returns to a public school, graduates from high school or reaches
294294 the age of twenty-two (22), whichever occurs first. At an y time,
295295 the parent or legal guardian of the student may remove the student
296296 from the private scho ol and place the student in another private
297297 school that is eligible for the program as provided in subsectio n H
298298 of this section or place the student in a public school.
299299 C. A student shall be eligible for a scholarship if the parent
300300 or legal guardian of th e student made a request for a scholarship
301301 for the 2010-2011 school year and the student transferred to an
302302 eligible private school but was subsequently denied a scholarship
303303 because the student did not have an IEP or ISP in effect on October
304304 1, 2009, but did meet all other eligibility requirements as set
305305 forth in the Lindsey Nicole Henry Scholarships for Students with
306306 Disabilities Program Act.
307307 D. A student shall not be eligible for a Lindsey Nicole Henry
308308 Scholarship if the student is not having regular and direct contact
309309 with the private school teachers at the physical location of the
310310 private school.
311311 E. School districts shall notify the parent or legal guardian
312312 of a public school student with a disability or a student who has at
313313 least one incarcerated parent of all options available pursuant to

366366 availability of information about the program from the State
367367 Department of Education through the toll -free telephone number or
368368 website. The notification shall be provided with or included in the
369369 copy of the "Parents Rights in Special Education: Notice of
370370 Procedural Safeguards" document given to parents at least ann ually
371371 or as otherwise required by law.
372372 F. 1. Acceptance of a Lindsey Nicole Henry Scholarship shall
373373 have the same effect as a parental revocation of consen t to service
374374 pursuant to 20 U.S.C., Sections 1414(a)(1 )(D) and 1414(C) of the
375375 IDEA.
376376 2. Upon acceptance of a Lindsey Nicole Henry Scholarship, the
377377 parent or legal guardian shall assume full financial responsibility
378378 for the education of the student, includi ng but not limited to
379379 transportation to and from the p rivate school.
380380 G. If the parent or legal gua rdian requests a Lindsey Nicole
381381 Henry Scholarship and the student is accepted by the private school
382382 pending the availability of a space for the student, the parent or
383383 legal guardian of the student shall notify t he State Department of
384384 Education before enter ing the private school and before December 1
385385 in order to be eligible for the scholarship during the school year
386386 when a space becomes available for the studen t in the private
387387 school. If notification is made afte r December 1, payment of the
388388 scholarship shall not begin until the next school year.

440440 H. 1. To be eligible to participate in the Lindsey Nicole
441441 Henry Scholarships for Students with Disabilities Program , a private
442442 school shall notify the State Department o f Education of its intent
443443 to participate. The notice shall specify the grade levels and
444444 services that the private school has available for students with
445445 disabilities who are participating in the schola rship program. The
446446 State Department of Education shal l approve a private school as
447447 eligible to participate in the scholarship program upon
448448 determination that the private school:
449449 a. meets the accreditation requirements set by the State
450450 Board of Education o r another accrediting association
451451 approved by the Stat e Board of Education. The State
452452 Department of Education shall list on its website all
453453 accrediting associations approved by the Board,
454454 b. demonstrates fiscal soundness by having been in
455455 operation for one (1) school year or providing the
456456 State Department of Education with a statement by a
457457 certified public accountant confirming that the
458458 private school desiring to participate is insured and
459459 the owner or owners have sufficient capital or credit
460460 to operate the school for the upcoming year by serving
461461 the number of students anticipated with expected
462462 revenues from tuition and other sources that may be
463463 reasonably expected. In lieu of a statement, a surety

515515 bond or letter of credit for the amount equal to the
516516 scholarship funds for any quarter may be filed with
517517 the Department,
518518 c. complies with the antidiscriminat ion provisions of 42
519519 U.S.C., Section 2000d,
520520 d. meets state and local health and safety laws and
521521 codes,
522522 e. will be academically accountable to the parent or
523523 legal guardian for meeting the educational needs of
524524 the student,
525525 f. employs or contracts with teache rs who hold
526526 baccalaureate or higher degrees, or have at least
527527 three (3) years of teaching experience in public or
528528 private schools, or have special skills, kn owledge, or
529529 expertise that qualifies them to provide i nstruction
530530 in subjects taught,
531531 g. complies with all state laws relating to general
532532 regulation of private schools, and
533533 h. adheres to the tenets of its published disciplinary
534534 procedures prior to the expul sion of a scholarship
535535 student.
536536 2. Upon approval of a private school, the State Department of
537537 Education shall provide on its website all information and material
538538 submitted by the private school with its application.

591591 shall comply with the following:
592592 a. the parent or legal guardian shall select the private
593593 school from the schools approved for eligibility
594594 pursuant to subsection H of this section and apply for
595595 the admission of the child,
596596 b. the parent or legal guardian shall request the
597597 scholarship no later than December 1 of the school
598598 year during which the scholarship is requested,
599599 c. any student participating in the scholarship program
600600 shall attend throughout the school year, unless
601601 excused by the school for illness or other good cause,
602602 and shall comply fully with the code of conduct for
603603 the school,
604604 d. the parent or legal guardian shall fully comply with
605605 the parental involvement requirements of the private
606606 school, unless excused by the school for il lness or
607607 other good cause, and
608608 e. upon issuance of a s cholarship warrant, the parent or
609609 legal guardian to whom the warrant is made shall
610610 restrictively endorse the warrant to the private
611611 school for deposit into the account of the private
612612 school. The parent or legal guardian may not
613613 designate any entity or ind ividual associated with the

666666 or legal guardian to endorse a warrant. A parent or
667667 legal guardian who fails to comply with this
668668 subparagraph shall for feit the scholarship.
669669 2. A participant who fails to c omply with this subsection
670670 forfeits the scholarship.
671671 J. Provisions governing payment of a Lindsey Nicole Henry
672672 Scholarship shall be as follows:
673673 1. The State Department of Education shall calculate the total
674674 cost of all scholarships for all eligible stude nts in the state.
675675 The State Department of Ed ucation shall then reserve or retain from
676676 the total amount appropriated to the State Board of Education for
677677 State Aid purposes and any other revenue availabl e for allocation
678678 for State Aid purposes the total cost for all scholarship payments;
679679 2. The maximum scholarship granted for an eligible student with
680680 disabilities shall be a calculated amount equivalent to the total
681681 State Aid factors for the applicable sch ool year multiplied by the
682682 grade and disability weight s generated by that student for the
683683 applicable school year. The disability weights used in calculating
684684 the scholarship amount shall include all disability weights which
685685 correspond to the disabilities i ncluded in the multidisciplinary
686686 evaluation and eligib ility group summary for the student at the ti me
687687 the request for a scholarship is made by the parent or legal
688688 guardian. The maximum scholarship amount shall be calculated by the

740740 State Board of Education for each year the student is participating
741741 in the scholarship program;
742742 3. The amount of the schol arship shall be the amount calculated
743743 in paragraph 2 of this subsection or the amount of tuition and fees
744744 for the private school, whichever is less, minus up to two and one-
745745 half percent (2 1/2%) of the scholarsh ip amount which may be
746746 retained by the State Department of Education as a fee for
747747 administrative services rendered. The amount of any assessment fee
748748 required by the private school and the amount associ ated with
749749 providing services and therapies to address the disabilities of the
750750 student may be paid f rom the total amount of the scholarship. The
751751 amount of the scholarship shall be prorated to reflect the number of
752752 days remaining in the current school year, if the scholarship
753753 request is granted after the begin ning of the school year;
754754 4. The State Depart ment of Education shall notify the private
755755 school of the amount of the scholarship within ten (10) days after
756756 receiving the request for a scholarship, when t he total State Aid
757757 factors have been determined for th e current fiscal year. The
758758 initial payment shall be made after the Department verifies
759759 admission acceptance and enrollment. Quarterly payments shall be
760760 made upon verification of continued enrollment a nd attendance at the
761761 private school. Payment shall be made by the Department with an
762762 individual warrant made payable to the parent or legal guardian of
763763 the student and mailed by the Department to the private school that

815815 the parent or legal guardian choose s. The parent or legal guardian
816816 shall restrictively e ndorse the warrant to the private school for
817817 deposit into the account of the private school;
818818 5. The State Department of Education shall not be responsible
819819 for any additional costs associated with speci al education and
820820 related services incurred by the priv ate school for the student
821821 including the cost of teachers, equipment, material, and special
822822 costs associated with the special education class;
823823 6. The State Department of Education shall establish a tol l-
824824 free telephone number or website that provides paren ts or legal
825825 guardians and private schools wit h information about the program;
826826 7. The State Department of Education shall require an annual,
827827 notarized, sworn compliance statement by participating privat e
828828 schools certifying compliance with state laws and sh all retain all
829829 records received from a partic ipating private school. The State
830830 Department of Education shall post on its website the annual
831831 compliance statement for each participating private school; a nd
832832 8. The State Department of Education shall cross -check the list
833833 of participating scholarship st udents with the public school
834834 enrollments prior to each scholarship payment to avoid duplication.
835835 K. 1. The State Superintendent of Public Instruction shal l
836836 deny, suspend, or revoke the participation of a priv ate school in
837837 the scholarship program if it i s determined that the private school
838838 has failed to comply with the provisions of this section. However,

890890 in instances in which the noncompliance is correctab le within a
891891 reasonable amount of time and in which the health, safety, or
892892 welfare of the students i s not threatened, the Superintendent may
893893 issue a notice of noncompliance which shall provide the private
894894 school with a time frame within which to provide evi dence of
895895 compliance prior to taking action to suspend or revoke participation
896896 in the scholarship pr ogram.
897897 2. If the Superintendent intends to deny, suspend, or revoke
898898 the participation of a private school in the scholarship program,
899899 the Department shall n otify the private school of the proposed
900900 action in writing by certified mail and regular mail to th e private
901901 school's address of record with the Department. The Department
902902 shall also notify any parents or legal guardians of scholarship
903903 students attending the private school. The notification shall
904904 include the reasons for the proposed action and notice of the
905905 timelines and procedures set forth in this subsection.
906906 3. The private school that is adversely affected by the
907907 proposed action shall have fifteen (15 ) days from receipt of the
908908 notice of proposed action t o file with the Department a request for
909909 an administrative hearing proceeding pursuant to the Administrative
910910 Procedures Act.
911911 4. Upon receipt of a request for a hearing, the State Board of
912912 Education shall commence a hearing within sixty (60) days after the

965965 thirty (30) days after the hearing.
966966 5. The Board may immediately suspend payment of scholarship
967967 funds if it is determined that there is probable cause to believe
968968 that there is an imminent th reat to the health, safety, or welfare
969969 of the students or fraudulent activity on the part of the private
970970 school.
971971 L. A parent or legal guardian who applies for a Lindsey Nicole
972972 Henry Scholarship for a public school student who has at least one
973973 incarcerated parent shall, in support of the application, provide
974974 documentation verifying a parent is incarcerated and in the custody
975975 of the Department of Corrections, another out -of-state prison
976976 system, or the Federal Bureau of Prisons. The documentation shal l
977977 include, but not be limited to, the active Departm ent of Corrections
978978 inmate number for the incarcerated parent.
979979 M. No liability shall arise on the part of the state, the State
980980 Board of Education, the State Department of Education or a school
981981 district based on the award or use of any scholarship provided
982982 through the Lindsey Nicole Henry Scholarships for Students with
983983 Disabilities Program.
984984 M. N. The inclusion of private schools within options available
985985 to public school students in Oklahoma shall not expand the
986986 regulatory authority of the state or any schoo l district to impose
987987 any additional regulation of private schools beyond those reasonably

10411041 N. O. If the State Department of Education de termines that a
10421042 school district prior to the effective date of this act has failed
10431043 to comply with the provisions of the Lindsey Nicole Henry
10441044 Scholarships for Students with Disabilities Program Act and h as
10451045 failed to make full or partial scholarship payments for eligible
10461046 students, the Department shall have authority to reduce the amount
10471047 of State Aid allocated to the school district or require the school
10481048 district to make repayment to the Department of State Aid
10491049 allocations in an amount equal to the amount of s cholarship payments
10501050 the school district faile d to make. The Department shall make
10511051 payment to the parent or legal guardian in the amount the school
10521052 district failed to make in the manner as provided for in subsection
10531053 J of this section.
10541054 O. P. The State Department of Education shall annually prepare
10551055 and post on its website a report of Lindsey Nicole Henry
10561056 Scholarships for Students with Disabilities Program. The annual
10571057 report shall include, but not be limited to, the following
10581058 information:
10591059 1. The total number and amount of scholarships awarded and
10601060 reported for each participating private school;
10611061 2. The total number of scholarships denied;
