94 | 111 | Domestic Violence Forensic Exam Pilot Prog ram, a Domestic Violence | |
95 | 112 | Examination Fund shall be established in each participating county | |
96 | 113 | for the purpose of providing to a victim of domestic violence | |
97 | 114 | assault, a forensic medical ex amination by a qualified licensed | |
98 | 115 | health care professional. | |
99 | 116 | B. As used in this section: | |
100 | 117 | 1. "Domestic violence" means any act of physical harm or the | |
101 | 118 | threat of imminent physical harm which is committed by an adu lt, | |
102 | 119 | emancipated minor, or minor child thirte en (13) years of age or | |
103 | 120 | older against another adult, emancipated minor , or minor child who | |
104 | 121 | is currently or was previously an int imate partner or family or | |
105 | 122 | household member; | |
106 | - | 2. "Intimate partner" means: | |
107 | - | a. current or former spouses, | |
108 | - | b. persons who are in a dating relationship, | |
109 | - | c. persons who are the biological parents of the same | |
110 | - | child, regardless of marital status or whether they | |

146 | 164 | b. persons who resided in the same single -dwelling unit | |
147 | 165 | within the past year, or | |
148 | 166 | c. persons who have individual lease agreements whereby | |
149 | 167 | each person has his or her own private bedroom and | |
150 | 168 | shares common areas; and | |
151 | 169 | 4. "Qualified licensed health care professional" means a | |
152 | 170 | physician, registered nurse, or other licensed health care | |
153 | 171 | professional qualified by completion of a forty-hour didactic | |
154 | 172 | domestic violence examiners course, as well as successful completion | |
155 | 173 | of clinical competence. | |
156 | - | C. The Crime Victims Compensation Bo ard shall establish the | |
157 | - | procedures for disbursement of the Domestic Violence Examination | |
158 | - | Fund, but in no event s hall the Crime Victims Compensati on Board pay | |
159 | - | an amount to exceed Two Hundred Dollars ($200.00) for a domestic | |

196 | 215 | E. The District Attorneys Council shall have the authority to | |
197 | 216 | make any contract, exe cute any document, or perform any act in order | |
198 | 217 | to carry out the Domest ic Violence Forensic Exam Pilot Program. | |
199 | 218 | F. Nothing in this section shall prevent the Legislature from | |
200 | 219 | appropriating funds to the Domestic Violence Examination Fund for | |
201 | 220 | the payment of domestic violence forensic examinations. | |
202 | 221 | SECTION 2. This act shall become effective November 1, 2024. | |
