5571 BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:
56-SECTION 1. NEW LAW A new section of law to be codified
57-in the Oklahoma Statutes as Section 421.21 of Title 21, unless there
58-is created a duplication in numbering, reads as follows:
59-A. Contingent upon the availability of fu nds, the District
60-Attorneys Council shall develop and implement a five-year Domestic
61-Violence Forensic Exam Pilot Program. The purpose of the D omestic

99+SECTION 1. NEW LAW A new section of law to be codified
100+in the Oklahoma Statutes as Section 421.21 of Title 21, unless there

102+A. Contingent upon the availability of fu nds, the District
103+Attorneys Council shall develop and implement a five-year Domestic
104+Violence Forensic Exam Pilot Program. The purpose of the D omestic
88105 Violence Forensic Exam Pilot Program shall be to provide counties
89106 with qualified licensed health care professionals who shall conduct
90107 domestic violence forensic exams for victims of domestic violence
91108 assault. Counties with a population of more than one hundred
92109 thousand (100,000) according to the latest Federal Decennial Census
93110 may participate in the pilot program. In conjunction with the
94111 Domestic Violence Forensic Exam Pilot Prog ram, a Domestic Violence
95112 Examination Fund shall be established in each participating county
96113 for the purpose of providing to a victim of domestic violence
97114 assault, a forensic medical ex amination by a qualified licensed
98115 health care professional.
99116 B. As used in this section:
100117 1. "Domestic violence" means any act of physical harm or the
101118 threat of imminent physical harm which is committed by an adu lt,
102119 emancipated minor, or minor child thirte en (13) years of age or
103120 older against another adult, emancipated minor , or minor child who
104121 is currently or was previously an int imate partner or family or
105122 household member;
106-2. "Intimate partner" means:
107-a. current or former spouses,
108-b. persons who are in a dating relationship,
109-c. persons who are the biological parents of the same
110-child, regardless of marital status or whether they
111-have lived together at any time, and

150+2. "Intimate partner" means:
151+a. current or former spouses,
152+b. persons who are in a dating relationship,
153+c. persons who are the biological parents of the same
154+child, regardless of marital status or whether they
155+have lived together at any time, and
138156 d. persons who currently or formerly lived toge ther in an
139157 intimate way, primarily character ized by affectionate
140158 or sexual involvement. A sexual relationship may be
141159 an indicator that a person is an intimate partner, but
142160 is never a necessary condition;
143161 3. "Living in the same household " means:
144162 a. persons who regularly reside in the same single -
145163 dwelling unit,
146164 b. persons who resided in the same single -dwelling unit
147165 within the past year, or
148166 c. persons who have individual lease agreements whereby
149167 each person has his or her own private bedroom and
150168 shares common areas; and
151169 4. "Qualified licensed health care professional" means a
152170 physician, registered nurse, or other licensed health care
153171 professional qualified by completion of a forty-hour didactic
154172 domestic violence examiners course, as well as successful completion
155173 of clinical competence.
156-C. The Crime Victims Compensation Bo ard shall establish the
157-procedures for disbursement of the Domestic Violence Examination
158-Fund, but in no event s hall the Crime Victims Compensati on Board pay
159-an amount to exceed Two Hundred Dollars ($200.00) for a domestic
160-violence forensic exam. Such payments shall not exceed the amounts
161-specified by this subsection regardless of the amount of any

201+C. The Crime Victims Compensation Board shall establish the
202+procedures for disbursement of the Domestic Violence Examination
203+Fund, but in no event s hall the Crime Victims Compensati on Board pay
204+an amount to exceed Two Hundred Dollars ($200.00) for a domestic
205+violence forensic exam. Such payments shall not exceed the amounts
206+specified by this subsection regardless of the amount of any
188207 individual bills comprising the claim. Payments shall be made only
189208 upon claims signed by th e victim or guardian and qualified licensed
190209 health care professional.
191210 D. The District Attorneys Council is hereby authorized to
192211 transfer funds, as specified in the appropriations bill a nnually,
193212 from the Crime Victims Compensation Fund to t he Domestic Violence
194213 Examination Fund for the payment o f domestic violence forensic
195214 exams, pursuant to this section.
196215 E. The District Attorneys Council shall have the authority to
197216 make any contract, exe cute any document, or perform any act in order
198217 to carry out the Domest ic Violence Forensic Exam Pilot Program.
199218 F. Nothing in this section shall prevent the Legislature from
200219 appropriating funds to the Domestic Violence Examination Fund for
201220 the payment of domestic violence forensic examinations.
202221 SECTION 2. This act shall become effective November 1, 2024.
