8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. NEW LAW A new section of law to be codified
8585 in the Oklahoma Statutes as Section 1-201 of Title 70, unless there
8686 is created a duplication in numbering, reads as follows:
8787 A. The State Board of Education shall establish a one-year
8888 pilot program for the 2024-2025 school year to provide grants to
8989 public middle schools , junior high schools, and high schools to
9090 incentivize phone-free spaces for student learning.

142142 B. 1. A public school district seeking a grant to establish a
143143 phone-free space in a middle school , junior high school, or high
144144 school site shall apply to the State Board of Education in the
145145 manner and on a form prescribed by the Board.
146146 2. After reviewing the applications submitted, the Board shall
147147 select nine (9) grant recipients as follows:
148148 a. three school sites, which shall be middle schools,
149149 junior high schools, or high schools, that each have
150150 an average daily membership (ADM) of fewer than five
151151 hundred (500) students,
152152 b. three school sites, which shall be middle schools ,
153153 junior high schools, or high schools, that each have
154154 an ADM of five hundred (500) or more students but
155155 fewer than one thousand five hundred (1,500) students,
156156 and
157157 c. three school sites, which shall be middle schools,
158158 junior high schools, or high schools, that each have
159159 an ADM of one thousand five hundred (1,500) or more
160160 students.
161161 3. When selecting grant recipients pursuant to this subsection,
162162 the Board shall attempt to select a vari ety of schools which are
163163 broadly representative of schools in the state in terms of
164164 geographic locations and student populations.

216216 C. The grants awarded pursuant to this section shall be used to
217217 purchase devices or equipment in which students enrolled in a grant-
218218 recipient school site can store their cell phones during the school
219219 day. In conjunction with the Office of Management and Enterprise
220220 Services, the State Board of Education may negotiate and contract
221221 with a vendor to offer a state rate price to grant recipient school
222222 sites.
223223 D. School sites awarded grants pursuant to this section shall
224224 adopt a policy regarding emergen cy use of cell phones by students
225225 during the school day including, but not limited to, medical issues
226226 documented by a licensed medical professi onal.
227227 E. Upon completion of th e pilot program, grant recipient school
228228 sites shall electronically submit a report to the State Board of
229229 Education that includes the following information:
230230 1. An evaluation of the pilot program by recipient school site
231231 teachers and administrators, including their perception of whether
232232 the program had an impact on student engagement in the classroom;
233233 2. An evaluation of the pilot program by recipient school site
234234 students, including their perception of whether the program had an
235235 impact on their ability to be engaged and learn in the classroom;
236236 3. Academic performance data, dis aggregated by grade level, for
237237 students who are enrolled in recipient school sites over the three -
238238 year pilot program period; and
239239 4. Recommendations, if any, for expanded prog ram operations.

291291 F. By December 31, 2025, the State Board of Education shall
292292 compile the information submitted pursuant to subse ction E of this
293293 section and electronically submit a report to the Governor, the
294294 Speaker of the Oklahoma House of Representatives , and the President
295295 Pro Tempore of the Oklahoma State Senate.
296296 SECTION 2. This act shall become effective July 1, 2024.
297297 SECTION 3. It being immediately necessar y for the preservation
298298 of the public peace, health or safety, an emergency is hereby
299299 declared to exist, by reason whereof thi s act shall take effect and
300300 be in full force from and after its passage and approval.
