5455 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
55-SECTION 1. NEW LAW A new sect ion of law not to be
56-codified in the Oklahoma Statutes reads as follows:
57-In recognition of the critical role social media plays in the
58-lives of minors and its imp act on their mental well-being, this
59-Legislature is committe d to safeguarding the youth from accessing

63+State of Oklahoma and who accesses or attempts to access a social
64+media platform while present in this state by acce ssing the social
65+media platform using an Oklahoma Internet protocol address or

86-platforms that have dem onstrated adverse effects on their mental
87-health due to the addictive elements found in social media and the
88-targeting of minors through the use of algorithms by social media
89-platforms. This Legislature's intent is not to censor content found
90-on social media platfor ms, but rather to prevent access by perso ns
91-who have not yet reached an age to handle the neg ative aspects of
92-social media. Much like our historical commitment to curbing the
93-use of addictive substances and behaviors among minors, such as laws
94-regulating the use of intoxicants and gambling, this Legislature now
95-takes proactive measures to address the emerging challenges posed b y
96-social media platforms.
97-SECTION 2. NEW LAW A new section of law to be codified
98-in the Oklahoma Statutes as Section 120 of Title 25, unless there is
99-created a duplication in numbering, reads as fol lows:
100-A. Nothing in this act shall be construed to limit the content
101-found on social media platforms or prohibit mino rs from posting
102-content on other platforms, digital or otherwise, that they legally
103-have access to.
104-B. As used in this act:
105-1. "Account holder" means an indiv idual who creates an account
106-or a profile to use a social media platform;
107-2. "Oklahoma user" means an individual who is a resident of the
108-State of Oklahoma and who accesses or a ttempts to access a social
109-media platform while present in this state by acce ssing the social
93+otherwise known or believed to be in this state while using the
94+social media platform;
95+3. "Commercial entity":
96+a. means a corporation, limited liability company,
97+partnership, limited partnership, sole proprie torship,
98+or other legally recognized entity , and
99+b. includes a third-party vendor;
100+4. "Digitized identification card" means a data file available
101+on a mobile device that has connec tivity to the Internet through a
102+state-approved application that allows th e mobile device to download
103+the data file from the Oklahoma Department of Public Safety that
104+contains all of the data elements visible on the face and back of a
105+driver license or identification card and displays the current
106+status of the driver license or identification card, including
107+valid, expired, cancel ed, suspended, revoked, active, or inactive;
108+5. "Minor" means an indiv idual under eighteen (18) years of
109+age;
110+6. "Reasonable age verification" means to confi rm that a person
111+seeking to access a so cial media platform is at least eighteen (18)
112+years of age;
113+7. a. "Social media company" means an online forum that a
114+company makes available for an account holder to:
115+(1) create a public profile, establish an ac count, or
116+register as a user for the primary p urpose of

137-otherwise known or believed to be in this state while using the
138-social media platform;
139-3. "Commercial entity":
140-a. means a corporation, limited liability company,
141-partnership, limited partnership, sole proprie torship,
142-or other legally recognized entity , and
143-b. includes a third-party vendor;
144-4. "Dark pattern" means a user inter face designed or
145-manipulated with the substantial effect of subverting or impairing
146-user autonomy, decision making, or choice and includes, but is not
147-limited to, any practice the Federal Trade Comm ission refers to as a
148-dark pattern;
149-5. "Digitized identification card" means a data file available
150-on a mobile device that has connec tivity to the Internet through a
151-state-approved application that allows th e mobile device to download
152-the data file from the Oklahoma Department of Public Safety that
153-contains all of the data elements visible on the face and back of a
154-driver license or identification card and displays the current
155-status of the driver license or identification card, including

155+subscribe unilaterally and whose platforms'
156+primary purpose is not social interaction,
157+(2) social media company that allows a user to
158+generate short video clips of dancing, voice
159+overs, or other acts of entertainment in which
160+the primary purpose is not educatio nal or
161+informative, does not meet the exclusion under
162+division (1) of subparagraph b of paragraph 7 of
163+this section,
164+(3) media company that exclusively offers interacting
165+gaming, virtual gaming, or an online service,
166+that allows the creation and uploading of content
167+for the purpose of interacting gaming,

185-7. "Personal information" means information that is linked or
186-reasonably linkable to an identified or identifiable minor,
187-including biometric information and unique identifiers to the minor;
188-8. "Reasonable age verification" means to confirm that a person
189-seeking to access a so cial media platform is at least eighteen (18)
190-years of age;
191-9. a. "Social media company" means an online forum , website,
192-or application that a company makes available for an
193-account holder to:
194-(1) create a public profile, establish an account, or
195-register as a user for the primary p urpose of
196-interacting socially with other profiles and
197-accounts,
198-(2) upload or create post s or content, which may
199-include, but is not limited to, user-generated
200-short video clips of dancing, voiceovers, or
201-other acts of entertainment in which the primary
202-purpose is not educatio nal or informative,
203-(3) view posts, activity, or content of other ac count
204-holders, and
205-(4) interact with other a ccount holders or users
206-including, without limitation, establishing
207-mutual connections through request and
208-acceptance.

204+of the company's revenue from operating a
205+social media platform, including games and
206+advertising, or
207+(5) company that provides career development
208+opportunities, including professional networking,
209+job skills, learning certifications, and job
210+posting and application services;
211+8. a. "Social media platform" means a public or semipublic
212+Internet-based service or application:
213+(1) that has users in Oklahoma, and
214+(2) (a) On which a substantial function of the
215+service or application is to connect users in
216+order to allow users to interact socially
217+with each other within the service or
218+application.

236-(1) media company that exclusively offers
237-subscription content in which users follow or
238-subscribe unilaterally and whose platform's
239-primary purpose is not social interaction,
240-(2) media company that exclusively offers interactive
241-gaming, virtual gaming, or an online service that
242-allows the creation and uploading of content for
243-the purpose of interacti ve gaming, entertainment,
244-or associated entertainment, and the
245-communication related to that content,
246-(3) an online service, website, or application whe re
247-the exclusive function is email or direct
248-messaging consisting of text, photographs,
249-pictures, images, or videos shared only between
250-the sender and the recipients, without displaying
251-or posting publicly or to other users not
252-specifically identified as the recipients by the
253-sender, and
254-(4) company that:
255-(a) offers cloud storage services, enterprise
256-cybersecurity services, educational dev ices,
257-or enterprise collaboration tools for

247+or direct messaging shall not be considered
248+to meet the criteria under subdivision (a)
249+of division (2) of this subparagraph on the
250+basis of that function alone.
251+b. Social media platform does not include an online
252+service, a website, or an appli cation if the
253+predominant or exclusive function is:
254+(1) email,
255+(2) direct messaging consisting of messages, photos,
256+or videos that are sent between devices by
257+electronic means if messages are:
258+(a) shared between the sender and the recipient
259+or recipients,
260+(b) only visible to the sender and the re cipient
261+or recipients, and
262+(c) are not posted publicly,
263+(3) a streaming service that:
264+(a) provides only licensed media in a continuous
265+flow from the service, website, or
266+application to the end user , and
267+(b) does not obtain a license to the media from

299-(3) that features infinite scrolling, which means

301-(a) continuously loading co ntent or content
302-that loads as the user scrolls down the
303-page without the need to open a separate
304-page, or
305-(b) seamless content, or the use of pages with
306-no visible or apparent end or page breaks ,
307-and
297+(4) news, sports, entertainment, or other content
298+that is preselected by the provider and not user -
299+generated, including without limitation if any
300+chat, comment, or interactive f unctionality that
301+is provided is incident al to, directly related
302+to, or dependent upon provision of the content,
303+(5) online shopping or e-commerce, if the interaction
304+with other users or account holders is generall y
305+limited to:
306+(a) the ability to post and comment on reviews,
307+(b) the ability to display lists or collections
308+of goods for sale or wish lists, and
309+(c) other functions that ar e focused on online
310+shopping or e-commerce rather than
311+interaction between users or account
312+holders,
313+(6) business-to-business software that is not
314+accessible to the general public,
315+(7) cloud storage,
316+(8) shared document collaboration,
317+(9) providing access to or interacting with data
318+visualization platforms, libraries, or hubs ,

338-b. A service or applicat ion that provides email or direct
339-messaging shall not be considered to meet the criteria
340-under division (4) of subparagraph a of this paragraph
341-on the basis of that function alone.
342-c. Social media platform does not include an online
343-service, a website, or an application if the
344-predominant or exclusive function is:
345-(1) email,
346-(2) direct messaging consisting of messages, photos,
347-or videos that are sent between devices by
348-electronic means if messages are:
349-(a) shared between the sender and the recipient
350-or recipients,
351-(b) only visible to the sender and the recipient
352-or recipients, and
353-(c) not posted publicly,
354-(3) a streaming service that:
355-(a) provides only licensed media in a continuous
356-flow from the service, website, or
357-application to the end user , and
346+(10) to permit comments on a digital news website, if
347+the news content is posted only by th e provider
348+of the digital news website,
349+(11) for the purpose of providing or obtaining
350+technical support for the social media company’s
351+social media platform, products, or services,
352+(12) academic or scholarly resear ch,
353+(13) other research:
354+(a) If:
355+(i) the majority of the content is posted
356+or created by the provider of the
357+online service, website, or
358+application, and
359+(ii) the ability to chat, comment, or
360+interact with other us ers is directly
361+related to the provider’s content,
362+(b) that is a classified adverti sing service
363+that only permits the sale of goods and
364+prohibits the solicitation of personal
365+services, or
366+(c) that is used by and under the direction of
367+an educational entity , including without
368+limitation a:
369+(i) learning management system,

400+c. Social media platform does not include a social media
401+platform that is controlled by a business enti ty that
402+has generated less than One Hundred Million Dollars
403+($100,000,000.00) in annual gross revenue; and
404+9. "User" means a person who has access to view all or some of
405+the posts and content on a social media platform but is not an
406+account holder.
407+SECTION 2. NEW LAW A n ew section of law to be codified
408+in the Oklahoma Statutes as Section 121 of Title 25, unless there is
409+created a duplication in numbering, reads as follows:
410+A. A social media company shall not permit an Oklahoma user who
411+is a minor under sixteen (16) years of age to be an account holder
412+on the social media company's social media platform.
413+B. A social media company shall not permit an Oklahoma user who
414+is a minor sixteen (16) years of age or older to be an account
415+holder on the social media company's social media platform unless
416+the minor has the express consent of a parent or legal guardian.
417+C. 1. A social media company shall verify the age of an
418+account holder.
419+2. If an account holder is a minor, the social media company
420+shall confirm that a minor has c onsent under subsection A of this

446-online service, website, or

448-(ii) the ability to chat, comment, or
449-interact with other users is directly
450-related to the provider ’s content,
451-(b) that is a classified adver tising service
452-that only permits the sale of goods and
453-prohibits the solicitatio n of personal
454-services, or
448+section to become a new account holder, at the time an Oklahoma user
449+opens the account.
450+D. 1. A social media company may use a third-party vendor to
451+perform reasonable age verification before allowing access to the
452+social media company's social media platform .
453+2. Reasonable age verification methods under paragraph 1 of
454+this subsection include providing:
455+a. a digitized identification card, including a digital
456+copy of a driver's li cense,
457+b. government-issued identification, or
458+c. any commercially reasonable age verification method.
459+SECTION 3. NEW LAW A new section of law to be codified
460+in the Oklahoma Statutes as Section 122 of Title 25, unless there is
461+created a duplication in numbering, reads as fo llows:
462+A. 1. A social media company tha t knowingly violates this act
463+is liable if the social media company fails to perform a reasonable
464+age verification.
465+2. If a social media company performs a reasonable age
466+verification, the social media company shal l not retain any
467+identifying information of the individual after access to the social
468+media platform has been granted.
469+B. The Attorney General may initiate an enforcement action
470+against social media companies tha t allegedly commit a violation of
471+this act.

483-limitation, a:
484-(i) learning management system,
485-(ii) student engagement program, and
486-(iii) subject-specific or skill-specific
487-program.
488-d. Social media platform does not include a social media
489-platform that is controlled by a b usiness entity that
490-has generated less than One Hundred Million Dollars
491-($100,000,000.00) in annual gross revenue;
492-11. "Substantial harm or privacy risk to mi nors" means the
493-processing of personal information in a manner that m ay result in
494-any reasonably foreseeable substantial ph ysical injury, economic
495-injury, or offensive intrusion into the privacy expectations of a
496-reasonable minor under the circumstances, including:
497-a. mental health disorders or associated behaviors,
498-including the promotion or exacerbation of self -harm,
499-suicide, eating disorders, and substance abuse
500-disorders,
501-b. patterns of use that indi cate or encourage addicti ve
502-behaviors,
503-c. physical violence, online bullying, and harassment,
504-and
499+C. A social media company that violate s this act is liable to
500+an individual for:
501+1. A penalty of Two Thousand Five Hundred Dollars ($2,500.00)
502+per violation, court costs, and reasonable attorney fees as ordered
503+by the court; or
504+2. Damages resulting from a minor accessing a social media
505+platform without their parent's or custodian's consent, including
506+court costs and reasonable attorney fees as ordered by the court.
507+D. This section does not:
508+1. Apply to a news or public interest broadcast, website vid eo,
509+report, or event;
510+2. Affect the rights of a news-gathering organization; or
511+3. Apply to cloud service providers.
512+E. An Internet service provider, or any of its affiliates or
513+subsidiaries, or search engines, shall not violate this act solely
514+by providing access, connection to or from a webs ite, or other
515+information or content on the Internet, or a facility, system, or
516+network that is not under that Internet service provider's control,
517+including transmission, downloading, intermediate storage, access
518+software, or other service that provides access or connectivity, to
519+the extent the Internet service provider is not responsible for the
520+creation of the content or the communication on a social media
521+platform.

534-12. "User" means a person w ho has access to view all or some of
535-the posts and content on a social media platform but is not an
536-account holder.
537-SECTION 3. NEW LAW A n ew section of law to be codified
538-in the Oklahoma Statutes as Section 121 of Title 25, unless there is
539-created a duplication in numbering, reads as follows:
540-A. A social media company shall not permit an Oklahoma user who
541-is a minor under sixteen (16) years of age to be an account holder
542-on a social media company's social media platform.
543-B. A social media company shall not permit an Oklahoma user who
544-is a minor sixteen (16) years of age or older to be an account
545-holder on the social media company's social media platform unless
546-the minor has the express consent of a parent or legal guardian.
547-C. 1. A social media company sh all verify the age of an
548-account holder.
549-2. If an account holder is a minor, the social media company
550-shall confirm that the minor has consent under subsection B of this
551-section to become a new account holder at the time the Oklahoma user
552-opens the account.

582-2. Reasonable age verification methods under paragraph 1 of

584-a. a digitized identification card, including a digital

586-b. government-issued identification,
587-c. any commercially reasonable age verification method,

589-d. confirmation from a platform from which social media
590-applications are downloaded that the platf orm has
591-verified the age and identity of th e user.
592549 SECTION 4. NEW LAW A new section of law to be codified

635-(2) the social media platform can demonstrate a
636-compelling reason that pro filing does not pose
637-substantial harm or is a privacy risk to minors;
638-3. Collect, sell, share, or retain any personal information
639-that is not necessary to provide an online service or feature with
640-which a minor is actively and know ingly engaged unless the online
641-platform can demonstra te a compelling reason that collecting,
642-selling, sharing, or retaining the personal informati on does not
643-pose substantial harm or is a privacy risk to minors ;
644-4. Use the personal information of a minor for any reason other
645-than the reason for which the perso nal information was colle cted
646-unless the online platform can demonstrate a compelling reason that
647-the use of the personal information does not pose substantial harm

681-6. Collect any precise geolocation data of a minor without
682-providing an obvious sign to the minor for the duration of the
683-collection that the precise geolocation data is being collected;
684-7. Use dark patterns to le ad or encourage minors to provide
685-personal information beyon d what personal information would
686-otherwise be reasonably expected to be provided for that online
687-service or feature, to forego privacy protections, or to take any
688-action that the online platform h as actual knowledge of o r willfully
689-disregards that may result in substantial harm or is a privacy risk
690-to minors; or
691-8. Use any personal informatio n collected to estimate the age
692-or age range for any other purpose or retain that personal
693-information longer th an necessary to estimate age. The age estimate
694-must be proportionate to the risks and data practice of an online
695-service or feature.
696-B. Violations of this section may be reported to the Office of
697-the Attorney General.
698-C. If the Attorney General determines that there has been a
699-violation of this section, the Attorney General shall send notice to
700-the social media platform.
701-D. The social media platform shall h ave a forty-five-day period
702-to cure the violation of this section.

733-is liable if the social media com pany fails to perform a reasonable

735-2. If a social media company performs a reasonable age
736-verification, the social media company shal l not retain any
737-identifying information of the individual after access to the social
738-media platform has been granted.
739-B. The Attorney General may initiate an enforcement action
740-against social media companies that allegedly commit a violation of
741-this act.
742-C. A social media company that violates this act is liable to
743-an individual for:
744-1. A penalty of Two Thousand Five Hundred Dollars ($2,500.00)
745-per violation, court costs, and reasona ble attorney fees as ordered
746-by the court; or
747-2. Damages resulting from a minor accessing a social media
748-platform without the consent of his or her parent or custodian,
749-including court costs and reasonable attorney fees as ordered by the
750-court.
751-D. This section does not:

782-E. No social media platform shall be liable under this a ct if,
783-after performing reasonable age verification , a minor manages access
784-to the platform through means of fraud including, but not limited
785-to, the use of fake identification by the minor or an individual
786-claiming to be the parent or legal guard ian of the minor.
787-F. An Internet service provider, or any o f its affiliates or
788-subsidiaries, or search engines will not violate this act solely
789-when providing access, connection to or from a webs ite, or other
790-information or content on the Internet, or a facility, syst em, or
791-network that is not under that Internet service provider's control,
792-including transmission, downloading, intermediate s torage, access
793-software, or other service that provides access or connectivity, to
794-the extent the Internet service provider is not responsible for the
795-creation of the content or the communication on a social media
796-platform.
797-SECTION 6. NEW LAW A new section of law to be codified

827553 any identifying information of an indiv idual after access to the
828554 social media platform has been granted.
829555 B. A commercial entity that is found to have knowingly retained
830556 identifying information of an individual after access to th e
831557 material is granted is liable to the individual for damages
832558 resulting from the retention of the identifying information,
833559 including court costs and reasonable attorney fees as ordered by the
834560 court.
835-SECTION 7. This act shall become effective July 1, 2024.
836-SECTION 8. It being immediately necessary for the preservation
837-of the public peace, health or safety, an emergency is hereby
838-declared to exist, by reason whereof this act shall take effect and
839-be in full force from and after its pa ssage and approval.
