34180 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

36181 SECTION 1. NEW LAW A new section of law to be codified
37182 in the Oklahoma Statutes as Section 6-401 of Title 70, unless there
38183 is created a duplication in numbering, r eads as follows:

40184 A. As used in this section:

42185 1. "Electronic or digital communication " includes, but is not
43186 limited to, emails, text messages, instant messages , direct
44187 messages, social media messages, messages sent through software

48216 2. "School personnel" means teachers, coaches, admin istrators,
49217 school bus drivers, or any other persons employed full-time or part-
50218 time by a public school or charter school.

52219 B. School personnel engaging in electronic or digital
53-communication with a n individual student shall include the student's
54-parent or guardian in any electronic or digital communication,
55-unless such communication is o n a school-approved platform and
56-related to school and academic communications .

221+guardian in any electronic or digital communication.
58222 C. Exceptions to the requirement in subsection B of this
59223 section may be made in case of an emergency, subject to subsequent
60224 notification to the parent or guardian. School personnel shall make
61225 reasonable efforts to use school-approved platforms, systems, or
62226 applications that allow automatic inclusion of parents or guardians
63227 in communications with students.

65228 D. Schools shall provide training , developed by the State
66229 Department of Education, for school personnel on the student
67230 communication requirements of this section.

69231 E. Any school personnel who is reported to be in violation of
70232 subsection B of this section shall be put on administrative leave
71233 while the school district inve stigates the incident and notifies the
72234 board of education. If the investigation finds that no misco nduct
73-occurred, the school personnel shall be reinstated and the incident
74-shall be noted in the school personnel's employee file. If the
75-investigation finds misconduct occurre d, the school personnel shall
76-be disciplined according to the school di strict board of education's
77-policy, up to and including termination of employment, and the
78-incident shall be reported to law enforcement pursuant to Section
79-1210.163 of Title 70 of the Oklahoma Statutes.

265+shall be reported to law enforcement pursuant to Section 1210.163 of
266+Title 70 of the Oklahoma Statutes.
81267 SECTION 2. This act shall become effective July 1, 2024.

83268 SECTION 3. It being immediately necessary for the preservation
84269 of the public peace, health or safety, an emergency is hereby
85270 declared to exist, by reason whereof thi s act shall take effect and
86271 be in full force from and after its passage and a pproval.
