2963 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3164 SECTION 1. AMENDATORY 19 O.S. 2021, Section 351.1, is
3265 amended to read as follows:

3466 Section 351.1 A. The board of county commissioners of each
3567 county may enter into agreements with any municipality for the
3668 furnishing of fire protection and emergency services, including, but
3769 not limited to, medical attention and wreck removal, by said

3897 municipality for all persons and property in areas outside the
3998 corporate limits of such municipality and to pay for such services a
4099 reasonable amount on a per run basis, or such other equitable basis
41100 as may be agreed upon, and to pay for such services from funds of
42101 the county general fund or the county highway fund. The board of
43102 county commissioners of each county may also enter into reciprocal
44103 agreements with other counties for such services. The board of
45104 county commissioners shall also have the authority to collect
46-charges for such services performed by a municipality or another ENR. H. B. NO. 4091 Page 2
105+charges for such services performed by a municipality or another
47106 county, pursuant to the provision of this section, from any person
48107 to whom such services are provided. Said funds shall be disbursed
49108 to the entities providing services.

51109 B. Should a disagreement over service areas arise between
52110 jurisdictions providing se rvices, with or without an agreement as
53-described in subsection A of this section, either entity may
54-petition for arbitration by the Fire Marshal's Commission to
55-determine boundary lines for the entities involved. In making a
56-determination, the Fire Marshal's Commission shall consider, but is
57-not limited to, the importance of a quick response time, the
58-financial burden on both t he service providers and the jurisdiction
59-receiving services, and the capabi lities of both jurisdictions to
60-render services.
