40	39		An Act relating to higher education; amending 70 O.S.
41	40		2021, Section 4104, which relates to degrees offered
42	41		by private institutions; exempting from certain
43	42		requirements religious d egrees issued by certain
44	43		institutions; requiring religious degrees and
45	44		associated documents to contain certain modifier;
46	45		providing an effective date; and declaring an
47	46		emergency.

52	51		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
53	52		SECTION 1. AMENDATORY 70 O.S. 202 1, Section 4104, is
54	53		amended to read as follows:
55	54		Section 4104. A. A private educationa l institution shall grant
56	55		only those degrees authorized by the Oklahoma State Regents for
57	56		Higher Education unless approved otherwi se by a national or regional
58	57		accrediting agency which is recognized by the Secretary of the
59	58		United States Department of Education as a reliable authority as to
60	59		the quality of education or training offered by institutions of
61	60		higher education for the purpose s of the Higher Education Act of
62	61		1965, as amended.
	62	+	B. 1. This section shall not apply to religious degrees which

89		-	B. 1. This section shall not apply to religious degrees which
90		-	are used solely for religious purposes within a religious
91	91		organization or any institution of higher education whose primary
92	92		purpose is to provide religious training or theological education
93	93		and which is exempt from taxation pursuant to the provisions of
94	94		Section 501(c)(3) of the Internal Revenue Code, 26 U.S.C., Secti on
95	95		501(c)(3).
96	96		2. Each degree title offered pursuant to this subsection shall
97	97		include a religious modifier. The relig ious modifier shall be
98	98		placed on the degree, on the transcript, and wherever the title of
99	99		the degree appears in official school documents or publications.
100	100		SECTION 2. This act shall become effective Ju ly 1, 2024.
101	101		SECTION 3. It being immediately necessary for the preservation
102	102		of the public peace, health , or safety, an emergency is hereby
103	103		declared to exist, by reason whereof this act shall take effect and
104	104		be in full force from and after i ts passage and approval.
