4039 An Act relating to higher education; amending 70 O.S.
4140 2021, Section 4104, which relates to degrees offered
4241 by private institutions; exempting from certain
4342 requirements religious d egrees issued by certain
4443 institutions; requiring religious degrees and
4544 associated documents to contain certain modifier;
4645 providing an effective date; and declaring an
4746 emergency.

5251 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5352 SECTION 1. AMENDATORY 70 O.S. 202 1, Section 4104, is
5453 amended to read as follows:
5554 Section 4104. A. A private educationa l institution shall grant
5655 only those degrees authorized by the Oklahoma State Regents for
5756 Higher Education unless approved otherwi se by a national or regional
5857 accrediting agency which is recognized by the Secretary of the
5958 United States Department of Education as a reliable authority as to
6059 the quality of education or training offered by institutions of
6160 higher education for the purpose s of the Higher Education Act of
6261 1965, as amended.
62+B. 1. This section shall not apply to religious degrees which

89-B. 1. This section shall not apply to religious degrees which
90-are used solely for religious purposes within a religious
9191 organization or any institution of higher education whose primary
9292 purpose is to provide religious training or theological education
9393 and which is exempt from taxation pursuant to the provisions of
9494 Section 501(c)(3) of the Internal Revenue Code, 26 U.S.C., Secti on
9595 501(c)(3).
9696 2. Each degree title offered pursuant to this subsection shall
9797 include a religious modifier. The relig ious modifier shall be
9898 placed on the degree, on the transcript, and wherever the title of
9999 the degree appears in official school documents or publications.
100100 SECTION 2. This act shall become effective Ju ly 1, 2024.
101101 SECTION 3. It being immediately necessary for the preservation
102102 of the public peace, health , or safety, an emergency is hereby
103103 declared to exist, by reason whereof this act shall take effect and
104104 be in full force from and after i ts passage and approval.
