7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 56 O.S. 2021, Section 604, is
7777 amended to read as follows:
7878 Section 604. The Director of the Department of Human Services
7979 shall, within the constraints of fund ing appropriated to the
8080 Department, maintain a Family Support Program for children with
8181 severe developmental disabilities who reside in their family homes
8282 in accordance with the follow ing criteria:
8383 1. The family member child resides with the family in this
8484 state in the family h ome;
8585 2. The family resides in the State of Oklahoma;
8686 3. The gross adjusted income of t he family for the year
8787 immediately preceding the date of application for the as sistance did

139139 not exceed Forty-five Thousand Dollars ($45,000.00) three hundred
140140 percent (300%) of the fede ral poverty level (FPL) g uidelines;
141141 4. 3. The family is headed by a bio logical parent, adoptive
142142 parent, or legal guardian of the eligible family mem ber; provided,
143143 however, that if the eligi ble family member lives with an adoptive
144144 parent or parents who alread y receive adoption subsidy from any
145145 source on behalf of the applicant , the family cannot receive family
146146 support assistance authorized by this sectio n; and
147147 5. 4. The family or family member does not receive Medicaid
148148 Home and Community-based Waiver Services.
149149 SECTION 2. This act shall become effective July 1, 2024.
150150 SECTION 3. It being immediately necessary for the prese rvation
151151 of the public peace, health or safety, an emergency is hereby
152152 declared to exist, by reason whereof this act shall take effect and
153153 be in full force from and after its pas sage and approval.
