66	66	disabilities; amending 56 O.S. 2021, Section 604,
67	67	which relates to the Family Support Progra m;
68	68	modifying program eligibility criteria ; updating
69	69	statutory language; providing an effective date; and

75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 56 O.S. 2021, Section 604, is
77	77	amended to read as follows:
78	78	Section 604. The Director of the Department of Human Services
79	79	shall, within the constraints of fund ing appropriated to the
80	80	Department, maintain a Family Support Program for children with
81	81	severe developmental disabilities who reside in their family homes
82	82	in accordance with the follow ing criteria:
83	83	1. The family member child resides with the family in this
84	84	state in the family h ome;
85	85	2. The family resides in the State of Oklahoma;
86	86	3. The gross adjusted income of t he family for the year
87	87	immediately preceding the date of application for the as sistance did

139	139	not exceed Forty-five Thousand Dollars ($45,000.00) three hundred
140	140	percent (300%) of the fede ral poverty level (FPL) g uidelines;
141	141	4. 3. The family is headed by a bio logical parent, adoptive
142	142	parent, or legal guardian of the eligible family mem ber; provided,
143	143	however, that if the eligi ble family member lives with an adoptive
144	144	parent or parents who alread y receive adoption subsidy from any
145	145	source on behalf of the applicant , the family cannot receive family
146	146	support assistance authorized by this sectio n; and
147	147	5. 4. The family or family member does not receive Medicaid
148	148	Home and Community-based Waiver Services.
149	149	SECTION 2. This act shall become effective July 1, 2024.
150	150	SECTION 3. It being immediately necessary for the prese rvation
151	151	of the public peace, health or safety, an emergency is hereby
152	152	declared to exist, by reason whereof this act shall take effect and
153	153	be in full force from and after its pas sage and approval.
