AS INTRODUCED 
 
An Act relating to services for people with 
disabilities; amending 56 O.S. 2021, Section 604, 
which relates to the Family Support Progra m; 
modifying program eligibility criteria ; updating 
statutory language; providing an effective date; and 
declaring an emergency . 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY    56 O.S. 2021, Section 604, is 
amended to read as follows: 
Section 604. The Director of the Department of Human Services 
shall, within the constraints of fund ing appropriated to the 
Department, maintain a Family Support Program for children with 
severe developmental disabilities who reside in their family homes 
in accordance with the follow ing criteria: 
1.  The family member child resides with the family in this 
state in the family h ome; 
2.  The family resides in the State of Oklahoma; 
3. The gross adjusted income of t he family for the year 
immediately preceding the date of application for the as sistance did

not exceed Forty-five Thousand Dollars ($45,000.00) three hundred 
percent (300%) of the fede ral poverty level (FPL) g uidelines; 
4. 3.  The family is headed by a bio logical parent, adoptive 
parent, or legal guardian of the eligible family mem ber; provided, 
however, that if the eligi ble family member lives with an adoptive 
parent or parents who alread y receive adoption subsidy from any 
source on behalf of the applicant , the family cannot receive family 
support assistance authorized by this sectio n; and 
5. 4.  The family or family member does not receive Medicaid 
Home and Community-based Waiver Services. 
SECTION 2.  This act shall become effective July 1, 2024. 
SECTION 3.  It being immediately necessary for the prese rvation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its pas sage and approval.
