79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. NEW LAW A new section of law not to be
81	81	codified in the Oklahoma Statutes reads as follows:
82	82	This act shall be known and m ay be cited as the “Ava Miller
83	83	Act”.
84	84	SECTION 2. AMENDATORY 47 O.S. 2021, Section 1132.1, as
85	85	amended by Section 1 47, Chapter 282, O.S.L. 2022 (47 O.S. Supp.
86	86	2023, Section 1132.1), is amended to read as follows:
87	87	Section 1132.1. A. There is levied and there shall be paid t o
88	88	Service Oklahoma a fee of Three Dollars ($3.00) upon every vehicle
89	89	to be registered or licensed, except for those licensed pursuant to

141	141	subsection (c) of Section 1210.34 of Title 70 of the Oklahoma
142	142	Statutes. Said Such fee shall accrue and shall be collectible upon
143	143	each vehicle under the same circumstances and shall be payable in
144	144	the same manner and times as apply to vehicle licenses and
145	145	registrations under the provisions of the Oklahoma Vehicle License
146	146	and Registration Act; provided, said such fee shall be paid in full
147	147	for the then current year at the time any vehicle is first
148	148	registered in a calendar year.
149	149	B. Two-thirds (2/3) of the monies collected pursuant to this
150	150	section shall be transferred by Service Oklahoma each month to the
151	151	State Treasurer for deposit in the General Revenue Fund. For the
152	152	fiscal year beginning July 1, 1999, of the remaining one-third (1/3)
153	153	of the monies collected pursuant to this section each fiscal year,
154	154	the first Four Hundred Thousand Dollars ($400,000.00) shall be
155	155	transferred by Service Oklahoma to the State Treasurer for deposit
156	156	in the Motor Vehicle Driver Education Revolving Fund created in
157	157	Section 1132.2 of this title and any amount in excess of Four
158	158	Hundred Thousand Dollars ($400,000.00) shall be transferred by
159	159	Service Oklahoma to the State Treasurer for deposit in the Gene ral
160	160	Revenue Fund. For the fiscal year beginning July 1, 2000, and for
161	161	each fiscal year thereafter, of the remaining one-third (1/3) of the
162	162	monies collected pursuant to this section each fiscal year, the
163	163	first Nine Hundred Thousand Dollars ($900,000.00) One Million Five
164	164	Hundred Thousand Dollars ($1,500 ,000.00) shall be transferred by

222	222	C. The collection and payment of said such fee shall be a
223	223	prerequisite to license or registration of any vehicle, except for
224	224	those licensed pursuant to subsection (c) of Section 1210.34 of
225	225	Title 70 of the Oklahoma Statutes.
226	226	SECTION 3. AMENDATORY 47 O.S. 2021, Section 1132.2, is
227	227	amended to read as follows:
228	228	Section 1132.2. There is hereby created in the State Treasury a
229	229	revolving fund for the State Board of Education Service Oklahoma to
230	230	be designated the “Motor Vehicle Driver Education Revolving Fund ”.
231	231	The fund shall be a continuing fund, not subject to fiscal year
232	232	limitations, and shall consist of all monies apportioned to the fund
233	233	pursuant to the provisions of Section 1132.1 of this title. All
234	234	monies accruing to the credit of the fund are hereby appropriated
235	235	and may be budgeted and expended by the State Board of Education
236	236	Service Oklahoma to assist in defraying the cost of motor vehicle
237	237	driver education for any person under the age of eighteen (18) years
238	238	who receives in-person driver education from a driver education
239	239	instructor certified by Service Oklahoma pursuant to Section 6-105.2

292	292	who receives in-person driver education from a commercial driver
293	293	training course, the cost of the driver education shall be defrayed
294	294	by One Hundred Dollars ($100.00). Service Oklahoma shall promulgate
295	295	rules to allow driver education instructors to submit relevant
296	296	student information to prove completion of a driver education course
297	297	in order to receive funds to transfer to the student. Priority in
298	298	such process shall be given to requests made by certified driver
299	299	instructors employed or working on behalf of public schools .
300	300	Expenditures from the fund shall be made upon warrants issu ed by the
301	301	State Treasurer against claims filed as prescribed by law with the
302	302	Director of the Office of Management and Enterprise Services for
303	303	approval and payment.
304	304	SECTION 4. This act shall become effective November 1, 2024.
