7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new section of law not to be
8181 codified in the Oklahoma Statutes reads as follows:
8282 This act shall be known and m ay be cited as the “Ava Miller
8383 Act”.
8484 SECTION 2. AMENDATORY 47 O.S. 2021, Section 1132.1, as
8585 amended by Section 1 47, Chapter 282, O.S.L. 2022 (47 O.S. Supp.
8686 2023, Section 1132.1), is amended to read as follows:
8787 Section 1132.1. A. There is levied and there shall be paid t o

141141 subsection (c) of Section 1210.34 of Title 70 of the Oklahoma
142142 Statutes. Said Such fee shall accrue and shall be collectible upon
143143 each vehicle under the same circumstances and shall be payable in
144144 the same manner and times as apply to vehicle licenses and
145145 registrations under the provisions of the Oklahoma Vehicle License
146146 and Registration Act; provided, said such fee shall be paid in full
147147 for the then current year at the time any vehicle is first
148148 registered in a calendar year.
149149 B. Two-thirds (2/3) of the monies collected pursuant to this
150150 section shall be transferred by Service Oklahoma each month to the
151151 State Treasurer for deposit in the General Revenue Fund. For the
152152 fiscal year beginning July 1, 1999, of the remaining one-third (1/3)
153153 of the monies collected pursuant to this section each fiscal year,
154154 the first Four Hundred Thousand Dollars ($400,000.00) shall be
155155 transferred by Service Oklahoma to the State Treasurer for deposit
156156 in the Motor Vehicle Driver Education Revolving Fund created in
157157 Section 1132.2 of this title and any amount in excess of Four
158158 Hundred Thousand Dollars ($400,000.00) shall be transferred by
159159 Service Oklahoma to the State Treasurer for deposit in the Gene ral
160160 Revenue Fund. For the fiscal year beginning July 1, 2000, and for
161161 each fiscal year thereafter, of the remaining one-third (1/3) of the
162162 monies collected pursuant to this section each fiscal year, the
163163 first Nine Hundred Thousand Dollars ($900,000.00) One Million Five
164164 Hundred Thousand Dollars ($1,500 ,000.00) shall be transferred by

222222 C. The collection and payment of said such fee shall be a
223223 prerequisite to license or registration of any vehicle, except for
224224 those licensed pursuant to subsection (c) of Section 1210.34 of
225225 Title 70 of the Oklahoma Statutes.
226226 SECTION 3. AMENDATORY 47 O.S. 2021, Section 1132.2, is
227227 amended to read as follows:
228228 Section 1132.2. There is hereby created in the State Treasury a
229229 revolving fund for the State Board of Education Service Oklahoma to
230230 be designated the “Motor Vehicle Driver Education Revolving Fund ”.
231231 The fund shall be a continuing fund, not subject to fiscal year
232232 limitations, and shall consist of all monies apportioned to the fund
233233 pursuant to the provisions of Section 1132.1 of this title. All
234234 monies accruing to the credit of the fund are hereby appropriated
235235 and may be budgeted and expended by the State Board of Education
236236 Service Oklahoma to assist in defraying the cost of motor vehicle
237237 driver education for any person under the age of eighteen (18) years
238238 who receives in-person driver education from a driver education
239239 instructor certified by Service Oklahoma pursuant to Section 6-105.2

291291 of this title. For any person under the age of eighteen (18) years
292292 who receives in-person driver education from a commercial driver
293293 training course, the cost of the driver education shall be defrayed
294294 by One Hundred Dollars ($100.00). Service Oklahoma shall promulgate
295295 rules to allow driver education instructors to submit relevant
296296 student information to prove completion of a driver education course
297297 in order to receive funds to transfer to the student. Priority in
298298 such process shall be given to requests made by certified driver
299299 instructors employed or working on behalf of public schools .
300300 Expenditures from the fund shall be made upon warrants issu ed by the
301301 State Treasurer against claims filed as prescribed by law with the
302302 Director of the Office of Management and Enterprise Services for
303303 approval and payment.
304304 SECTION 4. This act shall become effective November 1, 2024.
