AS INTRODUCED 
 
An Act relating to driver education; amending 47 O.S. 
2021, Sections 1132.1, as amended by Section 147, 
Chapter 282, O.S.L. 2022, and 1132.2 (47 O.S. Supp. 
2023, Section 1132.1), which relate to registration 
fees; increasing fund limit to be transferred to the 
Motor Vehicle Driver Education Revolving Fund; 
changing controlling agency of the revolving fund; 
modifying conditions for access to the fund; updating 
statutory language; providing for noncodification; 
and providing an effective date . 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law not to be 
codified in the Oklahoma Statutes reads as follows: 
This act shall be known and m ay be cited as the “Ava Miller 
Act”. 
SECTION 2.    AMENDATORY     47 O.S. 2021, Section 1132.1, as 
amended by Section 1 47, Chapter 282, O.S.L. 2022 (47 O.S. Supp. 
2023, Section 1132.1), is amended to read as follows: 
Section 1132.1. A.  There is levied and there shall be paid t o 
Service Oklahoma a fee of Three Dollars ($3.00) upon every vehicle 
to be registered or licensed, except for those licensed pursuant to

subsection (c) of Section 1210.34 of Title 70 of the Oklahoma 
Statutes.  Said Such fee shall accrue and shall be collectible upon 
each vehicle under the same circumstances and shall be payable in 
the same manner and times as apply to vehicle licenses and 
registrations under the provisions of the Oklahoma Vehicle License 
and Registration Act; provided, said such fee shall be paid in full 
for the then current year at the time any vehicle is first 
registered in a calendar year. 
B.  Two-thirds (2/3) of the monies collected pursuant to this 
section shall be transferred by Service Oklahoma each month to the 
State Treasurer for deposit in the General Revenue Fund.  For the 
fiscal year beginning July 1, 1999, of the remaining one-third (1/3) 
of the monies collected pursuant to this section each fiscal year, 
the first Four Hundred Thousand Dollars ($400,000.00) shall be 
transferred by Service Oklahoma to the State Treasurer for deposit 
in the Motor Vehicle Driver Education Revolving Fund created in 
Section 1132.2 of this title and any amount in excess of Four 
Hundred Thousand Dollars ($400,000.00) shall be transferred by 
Service Oklahoma to the State Treasurer for deposit in the Gene ral 
Revenue Fund. For the fiscal year beginning July 1, 2000, and for 
each fiscal year thereafter, of the remaining one-third (1/3) of the 
monies collected pursuant to this section each fiscal year, the 
first Nine Hundred Thousand Dollars ($900,000.00) One Million Five 
Hundred Thousand Dollars ($1,500 ,000.00) shall be transferred by

Service Oklahoma to the State Treasurer for deposit in the Motor 
Vehicle Driver Education Revolving F und created in Section 1132.2 of 
this title and any amount in excess of Nine Hundred Thousand Dollars 
($900,000.00) One Million Five Hundred Thousand Dollars 
($1,500,000.00) shall be transferred by Service Oklahoma to the 
State Treasurer for deposit in the General Revenue Fund. 
C.  The collection and payment of said such fee shall be a 
prerequisite to license or registration of any vehicle, except for 
those licensed pursuant to subsection (c) of Section 1210.34 of 
Title 70 of the Oklahoma Statutes. 
SECTION 3.    AMENDATORY     47 O.S. 2021, Section 1132.2, is 
amended to read as follows: 
Section 1132.2. There is hereby created in the State Treasury a 
revolving fund for the State Board of Education Service Oklahoma to 
be designated the “Motor Vehicle Driver Education Revolving Fund ”. 
The fund shall be a continuing fund, not subject to fiscal year 
limitations, and shall consist of all monies apportioned to the fund 
pursuant to the provisions of Section 1132.1 of this title. All 
monies accruing to the credit of the fund are hereby appropriated 
and may be budgeted and expended by the State Board of Education 
Service Oklahoma to assist in defraying the cost of motor vehicle 
driver education for any person under the age of eighteen (18) years 
who receives in-person driver education from a driver education 
instructor certified by Service Oklahoma pursuant to Section 6-105.2

of this title.  For any person under the age of eighteen (18) years 
who receives in-person driver education from a commercial driver 
training course, the cost of the driver education shall be defrayed 
by One Hundred Dollars ($100.00).  Service Oklahoma shall promulgate 
rules to allow driver education instructors to submit relevant 
student information to prove completion of a driver education course 
in order to receive funds to transfer to the student.  Priority in 
such process shall be given to requests made by certified driver 
instructors employed or working on behalf of public schools .  
Expenditures from the fund shall be made upon warrants issu ed by the 
State Treasurer against claims filed as prescribed by law with the 
Director of the Office of Management and Enterprise Services for 
approval and payment. 
SECTION 4.  This act shall become effective November 1, 2024.
