34	61		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

36	62		SECTION 1. NEW LAW A new section of law to be codified
37	63		in the Oklahoma Statutes as Section 501 of Title 3, unless there is
38	64		created a duplicatio n in numbering, reads as follows:

40	65		This act shall be known and may be cited as the “Oklahoma
41	66		Aircraft Engine Testing Development Grant Program ”.

49	97		A. There is hereby created, within the Oklahoma Department of
50	98		Aerospace and Aeronautics , the Oklahoma Aircraft Engine Testing
51	99		Development Grant Program to offer finan cial assistance by grant to
52	100		private or public entities for the purpose of expanding the aircraft
53	101		engine testing capabilities of this state and developing aircraft
54	102		engine testing infrastructure. Grant funding shall be administered
55	103		based on the potential fo r a specific project to enhanc e the
56	104		aviation and aerospace industry of this state. A grant under this
57	105		program shall be a one -time award.

59	106		B. Public, private, and nonprofit entities within this state
60	107		that have sufficient financial and management capacity t o complete
61	108		the requested project are eligible for funding under this program.
62	109		Applicants shall provide t he following information:

64	110		1. Airline or industry support as evidenced by a letter or
65	111		other communication directly from the entity stating its support for
66	112		the project;

68	113		2. The ability to provide a minimum of forty percent (40%)
69	114		matching funds for the proje ct; and

71	115		3. A proposal summary that shall include any background
72	116		information or history with aircraft engine testing and development,

76	146		C. A grant agreement shall be made between any awardee and the
77	147		Department. The grant agreement shall provide for the conditions of
78	148		disbursement, shall include a provisio n requiring the repayment of
79	149		awarded funds if the terms are not met, and shall include a
80	150		requirement for awardees to provide ongoing quarterly reports
81	151		detailing activity related to the project.

83	152		SECTION 3. NEW LAW A new section of la w to be codified
84	153		in the Oklahoma Statutes as Section 503 of Title 3, unless there is
85	154		created a duplicatio n in numbering, reads as follows:

87	155		There is hereby created in the State Treasury a revolving fund
88	156		for the Oklahoma Department of Aerospace and Aeronauti cs to be
89	157		designated the “Oklahoma Aircraft Engine Testing Development Grant
90	158		Program Revolving Fund ”. The fund shall be a continuing fund, not

93	159		subject to fiscal year limitations, and shall consist of all monies
94	160		received by the Department from all monies re ceived by any public or
95	161		private donations, contributions, and gifts received for the benefit
96	162		of the fund, and any amounts appropriated by the Legislature,
97	163		provided for the purpose of funding grants as provided in this act.
98	164		All monies accruing to the credi t of the fund are hereby
99	165		appropriated and may be budgeted and expended by the Department for
100	166		the purpose provided for in this act. Expenditures from the fund
101	167		shall be made upon warrants issued by the State Treasurer against

107	198		SECTION 5. It being immediately necessary for the preservation
108	199		of the public peace, health or sa fety, an emergency is hereby
109	200		declared to exist, by reason whereof this act shall take effect and
110	201		be in full force from and after its passage and approval.
