67	67	temporomandibular joint treatment; specif ying terms
68	68	of coverage; prohibiting insurers from making certain

75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
76	76	SECTION 1. NEW LAW A new section of law to be codified
77	77	in the Oklahoma Statutes as Section 6060.6a of Title 36, unless
78	78	there is created a duplication in numb ering, reads as follows:
79	79	A. For the purposes of this section, “health benefit plan”
80	80	means a health benefit plan as define d pursuant to Section 6060.4 of
81	81	Title 36 of the Oklahoma Statutes .
82	82	B. Any health benefit plan or health plan which provides
83	83	coverage for only dental care that is offered, issued, or renewed in
84	84	this state on or afte r the effective date of this act shall pro vide
85	85	coverage for diagnostic, ther apeutic, and surgical procedures
86	86	related to the temporomandibular joint (TMJ) and associated
87	87	musculature and neurological conditions. The coverage provided in

139	139	this section shall be subject to the same annual deductibles,
140	140	copayments, or coinsurance limits as established for all cover ed
141	141	benefits under the respective plan.
142	142	C. 1. Insurers offering only dental coverage to an insured may
143	143	limit benefits in such coverage to dental servic es related to
144	144	treatment of temporomandibul ar joint disorders.
145	145	2. No insurer offering medical coverage only may define al l
146	146	temporomandibular joint disorders as purely dental in nature, and no
147	147	insurer offering dental coverage only may define all
148	148	temporomandibular joint disorders as purely medical i n nature.
149	149	SECTION 2. This act shall become effective November 1, 20 24.
