AS INTRODUCED 
 
An Act relating to health and dental insuran ce; 
defining term; requiring coverage of 
temporomandibular joint treatment; specif ying terms 
of coverage; prohibiting insurers from making certain 
coverage determinations; providing for codification; 
and providing an effective date . 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA : 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 6060.6a of Title 36, unless 
there is created a duplication in numb ering, reads as follows: 
A.  For the purposes of this section, “health benefit plan” 
means a health benefit plan as define d pursuant to Section 6060.4 of 
Title 36 of the Oklahoma Statutes . 
B.  Any health benefit plan or health plan which provides 
coverage for only dental care that is offered, issued, or renewed in 
this state on or afte r the effective date of this act shall pro vide 
coverage for diagnostic, ther apeutic, and surgical procedures 
related to the temporomandibular joint (TMJ) and associated 
musculature and neurological conditions.  The coverage provided in

this section shall be subject to the same annual deductibles, 
copayments, or coinsurance limits as established for all cover ed 
benefits under the respective plan. 
C.  1.  Insurers offering only dental coverage to an insured may 
limit benefits in such coverage to dental servic es related to 
treatment of temporomandibul ar joint disorders. 
2.  No insurer offering medical coverage only may define al l 
temporomandibular joint disorders as purely dental in nature, and no 
insurer offering dental coverage only may define all 
temporomandibular joint disorders as purely medical i n nature. 
SECTION 2.  This act shall become effective November 1, 20 24.
