AS INTRODUCED 
 
An Act relating to juveniles; directing the Office of 
Juvenile Affairs to develop certain pay-for-
performance rate plan; directing the Office to 
reserve portion of certain funds for specified 
purpose; providing matching funds; directing certain 
quarterly payments; providing for establishment of 
certain quality metrics and benchmarks; requiring 
certain periodic reviews; stating certain 
requirements for quality metrics and benchmarks; 
requiring submission of certain an nual report; 
directing promulgation of ru les; providing for 
codification; providing an effecti ve date; and 
declaring an emergency . 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 2-7-306.1 of Title 10A, unless 
there is created a duplication in numbering, reads as follows: 
A.  The Office of Juvenile Affairs shall develop a pay-for-
performance rate plan for Youth Services Agencies and other 
contracted providers focused on improving youth outcomes and quality 
of life.

B.  The Office shall reserve a portion of funds paid to 
contracted providers for services to youth for the pay-for-
performance rate plan that contracted providers may earn for 
improvement or performance a chievement of youth-centered quality 
metrics. The funds withheld shall be matched with funds provided by 
the Office at a rate determined by the Board of Juvenile Affairs . 
C.  Pay-for-performance payments to contract ed providers may be 
earned quarterly and shall be based on the quality metrics 
established by the Board under subsection D of this section. 
D.  The Board shall establish quality metrics for the pay-for-
performance rate plan and benchmarks for satisfying the requirements 
of each quality metric. The Board shall periodically review and 
update the quality metrics and benchmarks as appropriate.  The Board 
shall ensure that quality metrics and benchmarks provide direct 
benefit to youth outcomes and address a need for quality 
improvement. 
E.  The Office shall electronically submit an annual report of 
the pay-for-performance rate plan to the President Pro Tempore of 
the Senate, the Speaker of the House of Representatives , and the 
Governor by December 31 of each year.  The report shall include, but 
not be limited to, an analysis of the previous fiscal year including 
incentive payments, ratings, and notable trends. 
F.  The Board shall promulgate rules to implement the provisions 
of this section.

SECTION 2.  This act shall become effective July 1, 2024. 
SECTION 3.  It being immediately necessary for the preservation 
of the public peace, health or safety, an eme rgency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its passage and approval.
