NO. 1391 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 ENGROSSED SENATE BILL NO. 1391 By: Rogers, Gollihare, Rader, Pemberton, Dossett, Coleman, and Bullard of the Senate and Hilbert, Marti, May, Fetgatter, and Sims of the House [ Oklahoma Water Resources Board - Revolving Fund – appropriation - codification - effective date - emergency ] BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 1085.7D of Title 82, unless there is created a duplication in numbering, reads as follows: A. There is hereby created in the State Treasury a revolving fund for the Oklahoma Water Resources Board to be designated the “Arkansas River Levee Improvement Revolving Fund ”. The fund shall be a continuing fund, not subject to fiscal year lim itations, and shall consist of all monies received by the Oklahoma Water Resources Board from legislative appropriations provided for the purpose of providing levee improvements and matching funds for levee projects along the Arkansas River. All monies accruing to the credit of the fund are hereby appropriated and may be budgeted and expended by the ENGR. S. B. Expenditures from the fund shall be made upon warrants issued by the State Treasu rer against claims filed as prescribed by law with the Director of the Office of Management and Enterprise Services for approval and payment. B. Notwithstanding any other provision of law, income and earnings on the fund shall accrue to the fund and may be used for the purposes provided for in this section. SECTION 2. There is hereby appropriated to the Oklahoma Water Resources Board from any monies not otherwise appropriated from the General Revenue Fund of the State Treasury for the fisc al year ending June 30, 2023, the sum of Fifty Million Dollars ($50,000,000.00) or so much thereof as may be necessary to perform the duties imposed upon the Board by law. SECTION 3. This act shall become effective July 1, 2024. SECTION 4. It being immediately necessary for the preservation of the public peace, health or safety, an emergency is hereby declared to exist, by reason whereof this act shall take effect and be in full force from and after its passage and approval .
