102177 (CORE). EDGE and CORE shall collaborate to encourage economic
103178 stability in the state, to improve the economic competitiv eness of
104179 this state, and to implement the Oklahoma Department of Commerce ’s
105180 strategic plan.

112211 powers and duties granted to it by this act to perform an essential
113212 governmental function for matter s of public necessity for which
114213 public monies may be spent and property acquired. EDGE shall have
115214 duties pertaining to the ec onomic development of the state
116215 including, but not limited to:

118216 1. Being empowered to strategically drive opportunities for
119217 economic growth and diversification across the state;

121218 2. Collaborating with local, regional, and state entities;

123219 3. Coordinating the funding and investment activities of each
124220 element of the state ’s economic development efforts and marketing
125221 campaigns to achieve better results for the state ’s recruitment and
126222 retention of businesses; and

129224 investment in this state for public officials, businesses, and the

213362 Oklahoma Department of Commerce shall be appointed by the Governor
214363 with the advice and consent of the Senate. The Director Chief

217366 qualified. The salary of the Director Chief Executive Officer shall

245408 C. The Director Chief Executive Officer shall employ such
246409 persons as are necessary to implement the powers and duties of the
247410 Department. Because many of the powers and duties of the Department
248411 involve working closely with the private sector, certain employee
249412 positions of the Department shall be employed and compensated in a
250413 manner that compares equally to similar positions in the private
251414 sector and shall be exempt from the provisions of the Civil Service
252415 and Human Capital Modernization Act. All o ther employees and
253416 positions shall be subject to the provisions of the Civil Service
254417 and Human Capital Modernization Act. Provided, n othing in this
255418 section shall be construed to limit the authority of the Legislature
256419 to specify the status of positions otherwi se by law. Neither shall
257420 the Director Chief Executive Officer have the authority to
258421 circumvent, disregard or otherwise disobey specific provisions of
259422 law regarding positions in the Department.

298475 annual updates for the State of Oklahoma this state.

312511 goals or recommendations included in the plan ,; the maximum
313512 investment of capital in the economy of the state ,; and the

316514 3. The plan wherever possible shall make recommendations to
317515 encourage intergovernme ntal cooperation and public and private
318516 cooperation.

320517 4. The plan shall include an economic development strategy for
321518 the state that addresses target industries, site development, and
322519 workforce needs to meet the state goals.

324520 5. Copies of the plan and the annual updates shall be submitted
325521 electronically to the Oklahoma Advisory Committee on
326522 Intergovernmental Relations, the Gov ernor, the Speaker of the House
327523 of Representatives, the President Pro Tempore of the Senate and the
328524 chairmen of the standing committee s on economic development of the
329525 Senate and of the House of Representatives members of the
330526 Legislative Evaluation and Developm ent Committee, as created in
331527 Section 8 of this act, and be made available to the public on the
332528 Department’s website on the first day of each legislative session.

334555 5. 6. The Department shall develop and manage a complete
335556 economic information system whic h will support the five-year
336557 planning process, and which will make available complete and timely
337558 information on the state economy. Th e economic information system
338559 shall be operated by public or private Oklahoma universities or an
339560 Oklahoma enterprise capable o f providing such services in a cost -
340561 effective manner.

342562 B. The Chief Executive Officer of the Oklahoma Department of
343563 Commerce shall present the strategic plan to the Legislative
344564 Evaluation and Development Committee, as created in Section 8 of
345565 this act, for approval.

347566 C. The Department, in conjunction with the Oklahoma Development
348567 Finance Authority, is authorized to develop an infrastr ucture
349568 program which will enable political subdivisions of this state to
350569 finance public works projects in order to modify or i mprove existing
351570 public facilities for purposes of bringing said such facilities, and
352571 the operation thereof, into compliance with and maintaining

370612 throughout this state.

372613 SECTION 6. AMENDATORY 74 O.S. 2021, Section 5003.10, is

375615 Section 5003.10. The Oklahoma Department of Commerce shall have
376616 the authority to:

378617 1. Disseminate information concerning the industrial,
379618 commercial, governmental, educational, cultural, agricultural,
380619 business and other advantages and attractions of the state;

406664 6. Generally gather, compile and make available economic
407665 analyses and statistical information relating to business, trade,
408666 commerce, industry, transportation, communication, natural
409667 resources, population and other like subjects in this state, with
410668 authority to call upon other agencies, universities and colleges of
411669 the state for statistical data and results obtained by them, and to
412670 arrange and compile such economic analyses and statistical
413671 information in such a man ner as it deems advisable;

415672 7. Study such other scientific, industrial, financial and
416673 economic issues as, in the judgment of t he Department, shall be
417674 deemed of value to the people of the state;

419675 8. Support and assist the efforts of state, regional and local
420676 development organizations, industrial committees, chambers of

429710 9. Maintain a continuing evaluation of the sources available
430711 for the financing of the development or expansion of industrial,
431712 agricultural and commercial facilities in this state through both
432713 public and private agencies;

434714 10. Assist in obtaining financing for the develop ment and
435715 expansion of industrial, agricultural and commercial facilities in
436716 the state;

438717 11. Serve as the state ’s official liaison agency between
439718 persons interested in locating new economic enterprises in Oklahoma

442719 and state and local groups seeking new enterprises. In this
443720 respect, the Department shall aid communities in organizing for and
444721 obtaining new businesses and expandi ng existing businesses and shall
445722 process requests which reflect interest in locating economic

448724 12. Promote the sale and facilitate the marketing of Oklahoma
449725 products including agricultural and value -added products in the

452753 13. Encourage the location of foreign manufacturing plants and
453754 other industries in Oklahoma;

455755 14. Coordinate the international efforts of the various state
456756 agencies without violating the individual authority given those
457757 agencies by statute;

459758 15. Coordinate and serve as liaison to the private sector as
460759 needed;

462760 16. Establish, subject to an annual appropriation or private
463761 gifts, offices outside the state boundaries. The offices may be
464762 operated by the state or may be operated pursuant to contract wh ich
465763 shall not be subject to the competitive bid laws of the State of
466764 Oklahoma. The Department shall prepare an annual report concerning
467765 the activities of the offices and submit it to the Governor and the
468766 Legislature. The Director Chief Executive Offi cer of the Oklahoma
469767 Department of Commerce shall notify in writing the Governor, the
470768 President Pro Tempore of the Senate and the Speak er of the House of
471769 Representatives that the Department intends to establish a new
472770 office pursuant to this paragraph at least t hirty (30) days prior to
473771 the establishment of the new office or execution of a contract;

475772 17. Establish a system of not less than six geographic regions
476773 for promoting new or existing businesses, assisting in the expansion
477774 of small and medium sized manu facturers through a modernization
478775 program, creating new jobs, and assisting local businesses,

509852 Oklahoma Department of Commerce provides a written report to the
510853 Governor, the Speaker of the House of Representatives, and the
511854 President Pro Tempore of the Senate of the intent of the Director
512855 Chief Executive Officer to terminate the office. Termination of the
513856 office pursuant to this section shall not occur earlier than sixty
514857 (60) days following the date the report is filed as provided in this
515858 section. For purposes of this section, “termination” means a
516859 reduction in funding for an office or a change in representation.

518860 SECTION 8. NEW LAW A new section of law to be codified
519861 in the Oklahoma Statutes as Section 5090.1 of Title 74, unless there
520862 is created a duplication in numbering, reads as follow s:

522863 A. There is hereby created within the Legislature the
523864 Legislative Evaluation and Development Committee. The Legislative
524865 Evaluation and Development Committee shall review financing for
525866 individual incentive packages including, but not limited to,
526867 packages offering tax incentives, funds for economic development,
527868 and, when the annual investment exceeds Twenty Million Dollars

542906 B. The Legislative Evaluation and Develo pment Committee shall
543907 evaluate and propose economic projects provided by the Division on
544908 Economic Development, Growth, and Expansion within the Oklahoma
545909 Department of Commerce. The Committee shall consist of:

547910 1. Four members of the Senate to be appointed by the President
548911 Pro Tempore of the Senate, one of whom shall be from the minority
549912 party; and

551913 2. Four members of the House of th e Representatives to be
552914 appointed by the Speaker of the House of Representatives, one of
553915 whom shall be from the minority party .

555916 The President Pro Tempore of the Senate, or his or her designee,
556917 and the Speaker of the House of Representatives, or his or her
557918 designee, shall serve as co -chairs for the Committee.

559919 C. The quorum of the Committee shall consist of at least five
560920 members. Meetings of the Committee shall be governed by joint rules
561921 of the Legislature. Members of the Committee may receive
562922 reimbursement from the Legislative Service Bureau for actual and
563923 necessary expenses incurred in connection with their duties as
564924 members of the Committee in accordance with other provisions of law
565925 relating to travel reimbursement for members of the Legislature.
