52 | 50 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

53 | 51 | | SECTION 1. AMENDATORY 21 O.S. 2021, Section 1040.13b, is |
---|
54 | 52 | | amended to read as follows: |
---|
55 | 53 | | Section 1040.13b. A. As used in this section: |
---|
56 | 54 | | 1. “Image” includes a photograph, fi lm, videotape, digital |
---|
57 | 55 | | recording or other depiction or portrayal of an object, including a |
---|
58 | 56 | | human body; |
---|
59 | 57 | | 2. “Intimate parts” means the fully unclothed, partially |
---|
60 | 58 | | unclothed or transparently clothed genitals, pubic area or female |
---|
61 | 59 | | adult nipple; and |
---|
91 | 88 | | B. A person commits nonconsensual dissemination of private |
---|
92 | 89 | | sexual images when he or she: |
---|
93 | 90 | | 1. Intentionally disseminates an image of another person : |
---|
94 | 91 | | a. who is at least eighteen (18) years of age, |
---|
95 | 92 | | b. who is identifiable from the image itself or |
---|
96 | 93 | | information displayed in connection with the image, |
---|
97 | 94 | | and |
---|
98 | 95 | | c. who is engaged in a sexual act or whose intimate parts |
---|
99 | 96 | | are exposed, in whole or in part; |
---|
100 | 97 | | 2. Disseminates the image with the intent to harass , intimidate |
---|
101 | 98 | | or coerce the person, or under circumstances in which a reasonable |
---|
102 | 99 | | person would know or understand that dissemination of the image |
---|
103 | 100 | | would harass, intimidate or coerce the person; |
---|
104 | 101 | | 3. Obtains the image under circumstances in which a reasonable |
---|
105 | 102 | | person would know or understand that the image was to remain |
---|
106 | 103 | | private; and |
---|
107 | 104 | | 4. Knows or a reasonable person should have known that the |
---|
108 | 105 | | person in |
---|
109 | 106 | | 3. Disseminates the image has not consented to the |
---|
110 | 107 | | dissemination without the effective consent of the depicted p erson. |
---|
111 | 108 | | C. The provisions of this section shall not apply to the |
---|
112 | 109 | | intentional dissemination of an image of another identifiable person |
---|
142 | 138 | | 1. The dissemination is made for the purpose of a criminal |
---|
143 | 139 | | investigation that is otherwise lawful; |
---|
144 | 140 | | 2. The dissemination is for the purpose of, or in connection |
---|
145 | 141 | | with, the reporting of unlawful conduct; |
---|
146 | 142 | | 3. The images involve voluntary exposure in public or |
---|
147 | 143 | | commercial settings; or |
---|
148 | 144 | | 4. The dissemination s erves a lawful purpose. |
---|
149 | 145 | | D. Nothing in this section shall be construed to impose |
---|
150 | 146 | | liability upon the following entities solely as a result of content |
---|
151 | 147 | | or information provided by another person: |
---|
152 | 148 | | 1. An interactive computer service, as defined in 47 U.S.C., |
---|
153 | 149 | | Section 230(f)(2); |
---|
154 | 150 | | 2. A wireless service provider, as defined in Section 332(d) of |
---|
155 | 151 | | the Telecommunications Act of 1996, 47 U.S.C., Section 151 et seq., |
---|
156 | 152 | | Federal Communications Commission rules, and the Omnibus Budget |
---|
157 | 153 | | Reconciliation Act of 1993, Pub. L. No. 10 3-66; or |
---|
158 | 154 | | 3. A telecommunications network or broadband provider. |
---|
159 | 155 | | E. A person convicted under this section is subject to the |
---|
160 | 156 | | forfeiture provisions in Section 1040.54 of this title. |
---|
161 | 157 | | F. Any person who violates the provisions of subsection B of |
---|
162 | 158 | | this section shall, upon conviction, be guilty of a misdemeanor |
---|
163 | 159 | | punishable by imprisonment in a county jail for not more than one |
---|
193 | 188 | | G. Any person who violates or attempts to violate the |
---|
194 | 189 | | provisions of subsection B of this section and who gains or attempts |
---|
195 | 190 | | to gain financially any property or who gains or attempts to gain |
---|
196 | 191 | | anything of value as a result of the nonconsensual dissemination or |
---|
197 | 192 | | threatened dissemination of private sexual images shall , upon |
---|
198 | 193 | | conviction, be guilty of a felony punishable by imprisonment in the |
---|
199 | 194 | | custody of the Department of Corrections for not more than four (4) |
---|
200 | 195 | | five (5) years. A second or subsequent violation of this subsection |
---|
201 | 196 | | shall be a felony punishable by imprisonment in the custody of the |
---|
202 | 197 | | Department of Corrections for not more than ten (10) years and the |
---|
203 | 198 | | offender shall be required to register as a sex offender under the |
---|
204 | 199 | | Sex Offenders Registration Act. |
---|
205 | 200 | | H. The state shall not have the discret ion to file a |
---|
206 | 201 | | misdemeanor charge, pursuant to Section 234 of Title 22 of the |
---|
207 | 202 | | Oklahoma Statutes, for a violation pursuant to subsection G of this |
---|
208 | 203 | | section. |
---|
209 | 204 | | I. The court shall have the authority to order the defendant to |
---|
210 | 205 | | remove the disseminated image should the court find it is in the |
---|
211 | 206 | | power of the defendant to do so. |
---|
212 | 207 | | J. Nothing in this section shall prohibit the prosecution of a |
---|
213 | 208 | | person pursuant to the provisions of Section 1021.2, 1021.3, 1024.1, |
---|
214 | 209 | | 1024.2, or 1040.12a of this title or any other applicable stat ute. |
---|
