39121 BE IT ENACTED BY THE PEOPLE OF THE STATE OF O KLAHOMA:

41122 SECTION 1. NEW LAW A new section of law to be codified
42123 in the Oklahoma Statutes as Section 1 -522.1 of Title 63, unless
43124 there is created a duplication in numberin g, reads as follows:

45125 A. “Expedited partner therapy” means to prescribe, administer,
46126 dispense, or otherwise provide antimicrobial drugs to a sexual
47-

49127 partner of a patient clinically diagnosed by a health care provider
50128 as infected with a sexually transmitted infection without a physical
51129 examination of such sexual partne r, shall not apply to any sexually
52130 transmitted infection that could be chronic or require multiple

55132 B. 1. Subject to limitations provid ed by law or rule including
56133 but not limited to laws or rules governing scope of practice,

58161 services, a health care provider who clinically diagnos ed a patient
59162 with a sexually transmitted in fection may provide expedited partner
60163 therapy if, in the professional judgment of the health care
61164 provider, the patient’s sexual partner is unl ikely or unable to
62165 present for examination, testing, and treatment.

64166 2. A health care provider who provides exped ited partner
65167 therapy shall provide coun seling to the patient, including
66168 distributing written material s developed and provided by the State
67169 Department of Health to be given by the patient to the patient’s
68170 sexual partner.

70171 3. A health care provider shall use expedited partner therapy
71172 only for a patient’s sexual partner who may have been exposed to a
72173 sexually transmitted infection and who is able to be contacted and
73174 identified by the patient.

75175 C. 1. No health care provider or pharmacist shall be liable
76176 for civil damages resulting from any act or o mission in good-faith
77177 compliance with the provisions of this s ection, including civil
78178 damages for refusing to provide expedited partner therapy, other
79179 than an act or omission constituting gross negligence or willful o r
80180 wanton misconduct.

82181 2. No health care provider or pharmacist shall be subject to
83182 disciplinary action by the provider’s or pharmacist’s licens ing
84183 board on the basis of an act or omission in good -faith compliance

96217 health care provider for an examination;

100220 history of allergy to the drug or the ph armaceutical class of drug
101221 should not take the drug and should immediately contact a health
102222 care provider for examination;

104223 3. Information about the treatm ent and prevention of sexually
105224 transmitted infections;

107225 4. The requirement of sexual abstinence until a period of time

120261 sexual partner’s own sexual partners of the risk of sexually
121262 transmitted infections and the importance of prompt examination and
122263 treatment by a health care provider; and

125265 Commissioner of Health.

127266 E. The State Commissioner of He alth, the State Board of Medical
128267 Licensure and Supervision, the State Board of Osteopathic Examiners,
129268 the Oklahoma Board of Nursing, and the State Board of Pharmacy may
130269 promulgate rules as necessary to implement th is section.

140274 (a) The term "sexually transmitted infection (STI)" means
141275 syphilis, gonorrhea, chlamydia, human immunode ficiency virus
142276 (HIV)/acquired immune deficiency syndrome (AIDS), and any other
143277 disease which may be transmitted f rom any person to any other person
144278 through or by means of any form of sexual contact.

146279 (b) The term "infected person" means any individual, eith er
147280 sex, who may be carrying the organism or is afflicted with any STI.

149281 (c) The term "dealer" means any person who may handle, for
150282 sale, any medicinal remedies or supposed remedies for an STI, and

153311 otherwise, any sexually transmitted infection (STI), and the agents,
154312 clerks and employees.

156313 (d) The term "physician" shall include reputab le physicians who
157314 have complied with all t he requirements of law regulating the
158315 practice of their respective schools of medicine, and duly licensed
159316 by such law to practice medicine in their respective schools, or
160317 surgery, or both, and no other person "health care provider" means
161318 an allopathic physician, osteopathic physician, physician assistant,
162319 or Advanced Practice Registered Nurse licensed in this state a nd
163320 authorized to prescribe drugs .

165321 SECTION 3. AMENDATORY 63 O.S. 2021, Section 1-518, is
166322 amended to read as follows :

168323 Section 1-518. It shall be unlawful for any person, being an
169324 infected person, to refuse, fail , or neglect to report such fact to,
170325 and submit to examin ation and treatment by, a physician health care
171326 provider.

173327 SECTION 4. AMENDATORY 63 O.S. 2021, Section 1-522, is
174328 amended to read as follows:

176329 Section 1-522. It Except as provided in Section 1 of this act,
177330 it shall be unlawful for a ny dealer to treat or offer to treat any
178331 infected person, or to se ll, furnish or give to any infected person ,

184361 with such dealer a proper prescription for such medicine , issued and
185362 signed by a physician, which prescription shall be by the dealer
186363 kept on file for a period of one (1 ) year from the date of the
187364 person receiving the same, and subject, at all reasonable hours, to
188365 the inspection of the State Commissioner of Hea lth or local health
189366 officer.

191367 SECTION 5. AMENDATORY 63 O.S. 2021, Section 1-532.1, is
192368 amended to read as follows:

194369 Section 1-532.1. Any person, regardless of age, has the
195370 capacity to consent to examination and treatment by a licensed
196371 physician health care provider for any sexually transmitted
197372 infection (STI).

199373 SECTION 6. REPEALER 63 O.S. 2021, Section 1 -521, is
200374 hereby repealed.
