19	49		the use of certain equipment by county commissioners;

27	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	56		SECTION 1. AMENDATORY 19 O.S. 2021, Section 16 5, as
30	57		amended by Section 1, Chapter 317, O.S.L. 2023 (19 O.S. Supp. 2023,
31	58		Section 165), is amended to read as follows:

33	59		Section 165. A. In lieu of rei mbursement for traveling
34	60		expenses within their county each county commissioner and sheriff
35	61		may receive a monthly travel allowance of up to One Thousand Dollars
36	62		($1,000.00). In lieu of the reimbursement for traveling expenses
37	63		authorized by law for each cou nty officer, each county assessor may
38	64		receive a monthly travel allowance of up to Nine Hundred Dollars
39	65		($900.00), and each county clerk, court clerk and county treasurer

40	93		may receive a monthly travel allowance of up to Eight Hundred
41	94		Dollars ($800.00). Each such county officer may be subject to the
42	95		penalty provided by Section 166 of this title for failure to a ttend
43	96		the meetings specified in that section.

47	97		B. Beginning in Fiscal Year 2028 and every fiscal year
48	98		thereafter, the monthly a mount of travel reimburs ement allowances
49	99		for county officers shall increase annually by two percent (2%).
50		-
51	100		C. All newly elected c ounty officials shall be reimbursed by
52	101		their respective counties for any approved training provided before
53	102		such official takes office. Such training e xpenses shall be
54	103		reimbursed in January when such official takes office.

56	104		D. The provisions of this sectio n and Sections 163 and 164 of
57	105		this title shall not prevent the emergency use of a county -owned
58	106		vehicle or county-owned or leased equipment by a county officer when
59	107		such county officer is acting on behalf of the county or when such
60	108		use is related to county business. As used in this subsection,
61	109		“emergency” means an unforeseen combination of circumstances or the
62	110		resulting state that calls for immediate act ion.

64	111		E. The provisions of this section and Sections 163 and 164 of
65	112		this title shall not prevent the use of county-owned or leased
66	113		equipment by a county commissioner. For the purposes of this
67	114		section, county-owned or leased equipment shall not include
68	115		automobiles or pick-up trucks. The provisions of this subsection
69	116		shall not be construed to authorize the us e of county-owned or

73	146		SECTION 2. It being immediatel y necessary for the preservation
74	147		of the public peace, health or safety, an emergency is hereby
75	148		declared to exist, by reason whereof this act shall take effect and
76	149		be in full force from and after its passage and approval.
