2755 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2956 SECTION 1. AMENDATORY 19 O.S. 2021, Section 16 5, as
3057 amended by Section 1, Chapter 317, O.S.L. 2023 (19 O.S. Supp. 2023,
3158 Section 165), is amended to read as follows:

3359 Section 165. A. In lieu of rei mbursement for traveling
3460 expenses within their county each county commissioner and sheriff
3561 may receive a monthly travel allowance of up to One Thousand Dollars
3662 ($1,000.00). In lieu of the reimbursement for traveling expenses
3763 authorized by law for each cou nty officer, each county assessor may
3864 receive a monthly travel allowance of up to Nine Hundred Dollars
3965 ($900.00), and each county clerk, court clerk and county treasurer

4093 may receive a monthly travel allowance of up to Eight Hundred
4194 Dollars ($800.00). Each such county officer may be subject to the
4295 penalty provided by Section 166 of this title for failure to a ttend
4396 the meetings specified in that section.

4797 B. Beginning in Fiscal Year 2028 and every fiscal year
4898 thereafter, the monthly a mount of travel reimburs ement allowances
4999 for county officers shall increase annually by two percent (2%).

51100 C. All newly elected c ounty officials shall be reimbursed by
52101 their respective counties for any approved training provided before
53102 such official takes office. Such training e xpenses shall be
54103 reimbursed in January when such official takes office.

56104 D. The provisions of this sectio n and Sections 163 and 164 of
57105 this title shall not prevent the emergency use of a county -owned
58106 vehicle or county-owned or leased equipment by a county officer when
59107 such county officer is acting on behalf of the county or when such
60108 use is related to county business. As used in this subsection,
61109 “emergency” means an unforeseen combination of circumstances or the
62110 resulting state that calls for immediate act ion.

64111 E. The provisions of this section and Sections 163 and 164 of
65112 this title shall not prevent the use of county-owned or leased
66113 equipment by a county commissioner. For the purposes of this
67114 section, county-owned or leased equipment shall not include
68115 automobiles or pick-up trucks. The provisions of this subsection
69116 shall not be construed to authorize the us e of county-owned or

73146 SECTION 2. It being immediatel y necessary for the preservation
74147 of the public peace, health or safety, an emergency is hereby
75148 declared to exist, by reason whereof this act shall take effect and
76149 be in full force from and after its passage and approval.
