5140 An Act relating to school employees; amending 70 O.S.
5241 2021, Section 509.11, which relates to equal access

6352 BE IT ENACTED BY THE PEOP LE OF THE STATE OF OKLAHOMA:
6453 SECTION 1. AMENDATORY 70 O.S. 2021, Section 509.11, is
6554 amended to read as follows:
6655 Section 509.11. A. No school district, employee of a school
6756 district, or employee organization shall deny by any mea ns,
6857 including a collective bargaining agreement, a statewide
6958 professional educators ’ association equal access to employees of the
59+school district, to the same extent that access is granted to other
60+educators’ associations. For purposes of this section, ac cess shall
61+include, but is not limited to:
62+1. Setting up informational tables at in -service or other
63+similar teacher meetings;

97-school district, to the same extent that access is granted to other
98-educators’ associations. For purposes of this section , access shall
99-include, but is not limited to:
100-1. Setting up informational tables at in -service or other
101-similar teacher meetings;
10290 2. Speaking at in-service or other similar teacher meetings;
10391 3. Distributing information in school mail boxes or through the
10492 school e-mail system;
10593 4. Utilizing school district meeting rooms during nonworking
10694 hours;
10795 5. Representing employees in employment matters, when requested
10896 by the employee;
10997 6. Posting information on school district bulletin bo ards; and
11098 7. Utilizing school district printing services.
11199 B. Any association which utilizes school district facilities or
112100 services shall reimburse the district for any costs incurred by the
113101 district.
114102 C. A school district is prohibited from:
115-1. Requiring or coercing public employees to meet, communicate,
116-listen to, or otherwise interact with an employee organization or
117-other membership association;
103+1. Requiring or coercing school district employees to meet,
104+communicate, listen to, or otherwise interact with an employee
105+organization or statewide professional educators ’ association;
118106 2. Distributing communications or membership solicitations on
119-behalf of any employee organization or other membership association;

109+3. Permitting an employee organization or statewide
110+professional educators ’ association access to or use of the school
111+district’s meetings, events, facilities, communications systems,
112+computer systems, equipment, s upplies, or other resources on terms
