3059 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3260 SECTION 1. AMENDATORY 17 O.S. 2021, Section 802.2, as
3361 amended by Section 1, Chapter 27, O.S.L. 2022 (17 O.S. Supp. 2023,
3462 Section 802.2), is amended to read as follows:

3663 Section 802.2. A. There is hereby created the Oklahoma Low
3764 Carbon Energy Initiative, referred to in S ection 802.1 et seq. of
3865 this title as the Initiative, which shall serve as a strategic

71144 6. Attracting best-in-class researchers to Oklahoma in
72145 competency areas aligned with Oklahoma ’s natural resource base;

74146 7. Coordinating with the Oklahoma Department of Commerce to
75147 enhance venture capital investment in energy -related research and

78149 8. Promoting seed fun ding that can be leveraged against state,
79150 federal, and private -source funding to establish sufficient sta rtup

82152 B. The Initiative may receive assistance from any state agency
83153 or public entity to implement the provisions of the Oklahoma Energy
84154 Initiative Act including, but not limited to, administrative
85155 assistance, staffing or legal counsel and provi sion of office space
86156 or equipment as necessary. A ssistance agreements may be made by
87157 memorandums of understanding or as otherwise provided by law.

95161 Section 802.3. A. The Oklahoma Low Carbon Energy Initiative
96162 shall be administered and governed by the Oklahoma Low Carbon Energy
97163 Initiative Board, made up of representa tives of the contributing
98164 institutions and entitie s of the Initiative which shall include but
99165 not be limited to the University of Oklahoma, Oklahoma St ate
100166 University, and the University of Tulsa. Additional contributing
101167 members may be added at the discret ion of the Board, if they

105197 B. The Board shall consist of eleven (11) thirteen (13) members

109200 be the Secretary of Energy and Environment or a member otherwise
110201 appointed by the Governor;

112202 2. One member shall be the Vice President for Research from the
113203 University of Oklahoma or a member otherwise appointed by the
114204 President of the University of Oklahoma;

116205 3. One member shall be the Vice President for Research from
117206 Oklahoma State University or a member otherwise appointed by the
118207 President of Oklahoma Stat e University;

159262 C. 1. The Board shall establish an Energy Industry Advisory
160263 Council, appointed by the chair, for the purposes of providing
161264 industry expertise and knowledge, assisting the Board with annual
162265 report requirements, providing general recommendations, and other
163266 support as needed to advance the efforts of the Board.

165267 2. Members appointed to the Council shall serve at the pleasure
166268 of the chair of the Board.

168296 D. Board members shall serve for a term of four (4) years,
169297 which shall begin on January 1 of the first year of the appointment
170298 and end on December 31 of the fourth year. The re shall be no limit
171299 to the number of consecutive terms served. If a vacancy should
172300 occur during a membe r’s term, the appointing authority for the
173301 vacant position shall appoint a new member to fill the remainder of
174302 the unexpired term. Board members shall serve without compensation
175303 but may be eligible for necessary travel expenses pursuant to the
176304 State Travel Reimbursement Act.

180305 E. The Board shall be responsible for establishing procedures
181306 for the Initiative and operations of the Board and the Advisory
182307 Council. The rules may provide for protection from public
183308 disclosure of trade secrets and proprietary infor mation of any kind
184309 including, but not limited to, data, processes and technology, as
185310 the Board determines necessary.

187311 F. The Board shall undertake acti vities and commission
188312 programs, through the contributing institutions and entities, to
189313 achieve the purpose and satisfy the objectives of the Initiative as
190314 provided in the Oklahoma Energy Initiative Act. The Board shall
191315 have authority to distribute funding for such activities and
192316 programs. The Board may employ staff as it deems necessary.

194317 G. The Board, in consultation with the Advisory Council and any
195318 other party deemed necessary, shall prepare submit and publish
196319 electronically an annual, written report t o summarize the annual

197347 progress of the Initiative including summaries of its programs and
198348 their progress and outcomes. The report shall be made available to
199349 the public and shall be distributed electronically to the Governor,
200350 the President Pro Tempore of t he Senate, and the Speaker of the
201351 House of Representatives.

203352 H. The provisions of the Oklahoma Central Pu rchasing Act shall
204353 not apply to any project, activ ity or contract of the Initiative or
205354 the Board.

207355 I. No Board member or any person acting on behalf of the Board,
208356 Advisory Council, or Initiative executing any contracts, commitments
209357 or agreements issued by or on behalf of the Oklahoma Low Carbon
210358 Energy Initiative shall be personally liable for the contracts,
211359 commitments, or agreements or be subject to any personal liability
212360 or accountability by reason thereof. No director or any person
213361 acting on behalf of t he Board or Initiative shall be personally
214362 liable for damage or injury resulting from the performance of duties
215363 hereunder.

217364 SECTION 3. This act shall become effective November 1, 2024.
