3059 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3260 SECTION 1. AMENDATORY 27A O.S. 2021, Section 3 -4-101, is
3361 amended to read as follows:

3562 Section 3-4-101. A. This article shall be known and may be
3663 cited as the “Oklahoma Carbon Sequestration Enhancement Act ”.

3864 B. The Oklahoma Legisl ature finds that:

4065 1. Increasing levels of carbon dioxide and other gases in the
4166 atmosphere have led to growing interest in national and
4267 international forums for implementing measures to slow and reverse

4395 the buildup of such atmospheric constituents. These measures may
4496 include, but are not limited to, the establishment of systems of
4597 trading in carbon dioxide credits or adoption of practices,

4898 technologies, or other measures which decrease the concentration of
4999 carbon dioxide in the atmosphere and improve air quality;

51100 2. Carbon sequestration practices have great potential to
52101 increase carbon sequestration and help offset the impact of carbon
53102 dioxide emissions on carbon dioxide concentrations in the
54103 atmosphere; and
55-
56104 3. It is in the interest of the citizens of th is state that the
57105 Oklahoma Conservation Commission document and quantify carbon
58106 sequestration associated with terrestrial and agricultural carbon
59107 sequestration practices. The provisions of this act shall not
60108 include geologic carbon sequestration occurring in Underground
61109 Injection Control (UIC) Class II or Class VI projects.

63110 C. It is the intent of the Legislature that such efforts to
64111 document and quantify carbon sequestration associated with
65112 terrestrial and agricultural carbon sequestration practices will
66113 enhance the ability of the state ’s landowners, well owners and
67114 mineral owners to participate in any system of carbon dioxide
68115 emissions marketing or trading that may be developed in the future.

70116 D. For purposes of this act the Oklahoma Carbon Sequestration
71117 Enhancement Act, “carbon sequestration practices ” and “carbon
72118 capture and storage practices ” shall mean and include:

74146 1. Improved agricultu ral practices, including, but not limited
75147 to, decreasing soil tillage, planting and managing vegetation,
76148 growing agricultural crops, or managing any existing vegetated area;

78149 2. Improved natural resources conservation practices,
79150 including, but not limited to, vegetation, revegetation,
80151 forestation, afforestation , and reforestation on rangeland and other
81152 agricultural and nonagricultural lands;

83153 3. Practices involving the capture and sequestration or storage
84154 of carbon dioxide emissions through carbon dioxide i njection in
85155 producing oil or gas wells, abandoned oil or gas wells, or other
86156 wells;

88157 4. Other improved methods of ste wardship for the natural
89158 resources of Oklahoma this state; and

93159 5. 4. Other terrestrial and agricultural methods of
94160 sequestering, displacin g, or avoiding carbon dioxide emissions
95161 approved by the Oklahoma Conservation Commission.

97162 SECTION 2. AMENDATORY 27A O.S. 2021, Section 3 -4-102, is

100164 Section 3-4-102. The Oklahoma Conservation Commission shall:

102165 1. Encourage the production of educational and a dvisory
103166 materials regarding terrestrial and agricultural carbon
104167 sequestration and storage and the opportunities to participate in
105168 any a related system of carbon dioxide emissions trading or
106169 marketing that may be developed in the future; and

109198 quantify terrestrial and agricultural carbon sequestration and
110199 storage involved in terrestrial and agricultural carbon
111200 sequestration practices within th e state.

113201 SECTION 3. AMENDATORY 27A O.S. 2021, Section 3 -4-105, is
114202 amended to read as follow s:

116203 Section 3-4-105. A. The Oklahoma Conservation Commission is
117204 hereby authorized to establish and administer the terrestrial and
118205 agricultural carbon sequestration certification program. The
119206 purposes of the program are to provide a mechanism for creating and
120207 preserving carbon reserves in this state by encouraging voluntary
121208 practices that protect or improve natural resources, to enable
122209 Oklahomans to participate in market -based programs for natura l
123210 resource protection, to provide a mechanism for Oklahomans to
124211 benefit from the ecosystem services they provide, to verify carbon
125212 sequestration or storage associated with terrestrial and
126213 agricultural carbon sequestration practices, and to issue carbon
127214 sequestration certificates associated with terrestrial and
128215 agricultural carbon sequestration practices that the Commission
129216 determines qualify for such certificates.

131217 B. The Commission, in consultation wi th the Department of
132218 Environmental Quality and with the advice of the terrestrial and
133219 agricultural carbon sequestration stakeholder groups appointed by
220+the Commission, shall develop and promulgate rules as necessary to

137248 administer, implement , and enforce the provisions of this act
138249 Section 3-4-101 et seq. of this title , including, but not limited
139250 to, developing and impleme nting uniform standards and criteria for
140251 verifying carbon sequestration and storage associated with
141252 terrestrial and agricultural carbon sequestration practices and
142253 issuing carbon sequestration ce rtificates associated with approved
143254 terrestrial and agricultu ral carbon sequestration practices. In
144255 promulgating the rules, the Commission shall develop the program to
145256 be as consistent as possible wi th other governmental programs
146257 designed to create carbon reserves for the purpose of voluntarily
147258 reducing greenhouse gases or designed to certify terrestrial and
148259 agricultural carbon sequestration practices.

150260 C. In order for terrestrial and agricultural carbon
151261 sequestration to be verified and certified under thi s section, an
152262 applicant shall file an application with the Co mmission. Along with
153263 the application, the applicant shall submit a resource management
154264 plan, or a project plan as applicable, detailing ac tivities that
155265 will increase or maintain existing trapped carbon including, but not
156266 limited to, improved forest manage ment, alteration of or changes in
157267 silviculture practices, and growing of designated crops and any
158268 other such terrestrial and agricultural c arbon sequestration
159269 practices including, but not limited to, the capture and
160270 sequestration of carbon dioxide emission s through injection of
161271 carbon dioxide underground .

163299 D. The Commission shall require applicants to submit such
164300 information, forms, and repor ts as are necessary to properly and
165301 efficiently administer the program.

167302 E. Prior to granting a carbon sequestration certificate, the
168303 Commission shall adopt criteria associated with the approved
169304 terrestrial and agricultural carbon sequestration practice fo r which
170305 an application is submitted. In addition, the C ommission shall
171306 determine, based upon compliance with the sit e criteria, the volume
172307 or numerical amount of credits or offsets achievable by the specific
173308 terrestrial and agricultural carbon sequestration practice.

175309 F. Applications for a terrestrial and agricultural carbon
176310 sequestration certificate shall be approved o r denied in accordance
177311 with criteria promulgated by the Commission.

181312 G. The Commission is authorized to establish fees associated
182313 with the terrestrial and agricultural carbon sequestration
183314 certification program.

185315 SECTION 4. This act shall become effective November 1, 2024.
