4849 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4950 SECTION 1. AMENDATORY 12 O.S. 2021, Section 3234 , is
5051 amended to read as follows:
5152 Section 3234. A. IN GENERAL. A party may serve on any other
5253 party a request within the scope of Section 3226 of this title:
5354 1. To produce and permit the requesting party or its
5455 representative to inspect, copy, test or s ample the following items
5556 in the possession, custody or control of the responding party:
5657 a. any designated documents or ele ctronically stored
5758 information - including writings, drawings, graphs,
5859 charts, photographs, sound recordings, images and
5960 other data or data compilations – stored in any medium
6061 from which information can be obtained either directly

8890 party into a reasonably usable form, or
8991 b. any designated tangible things; or
9092 2. To permit entry onto d esignated land or other property
9193 possessed or controlled by the responding party so that the
9294 requesting party may inspect, measure, survey, photograph, test or
9395 sample the property or any designated obje ct or operation on it.
9496 B. PROCEDURE. 1. The request :
9597 a. shall describe with reasonable particularity each item
9698 or category of items to be inspected,
9799 b. shall specify a reasonable time, place and manner for
98100 the inspection and for performing the related acts,
99101 and
100102 c. may specify the form or forms in which ele ctronically
101103 stored information is to be produced.
102104 2. The number of requests to produce or permit inspection or
103105 copying shall not exceed thirty in number. If counsel for a party
104106 believes that more than thirty requests to produce or permit
105107 inspection or copying are necessary, counsel shall consult with
106108 opposing counsel promptly and attempt to reach a written stipulation
107109 as to a reasonable number of additional requests. Counsel are
108110 expected to comply with this requirement in good f aith. In the
109111 event a written stipulation cannot be agreed upon, the party seeki ng

136139 to submit such additional requests for production or inspection
137140 shall file a motion with the court :
138141 a. showing that counsel have conferred in good faith but
139142 sincere attempts to resolve the issue have been
140143 unavailing,
141144 b. showing reasons establishing good cau se for their use,
142145 and
143146 c. setting forth the proposed additional requests for
144147 production or inspection.
145148 3. a. The request may be served, without leave of court,
146149 upon any party after the filing of a pe tition. The
147150 party to whom the request is directed shall respond in
148151 writing within thirty (30) days after being served.
149152 The thirty-day response period shall not commence
150153 until an answer to the petition is filed. However,
151154 upon leave of court or otherwise agreed to in writing
152155 by the parties subject to Section 3229 of this title,
153156 the response to the request may be required prior to
154157 the filing of an answer to the pet ition.
155158 b. For each item or category, the response shall either
156159 state that inspection and relat ed activities will be
157160 permitted as requested or state wi th specificity the
158161 grounds for objecting to the request, including the
159162 reasons. The responding party may state that it will

187191 stored information instead of permitting inspection.
188192 The production shall be completed no later than the
189193 time for inspection specified in the request, or
190194 another reasonable time specified in the response.
191195 c. An objection shall state whether any responsive
192196 materials are being withh eld on the basis of that
193197 objection. An objection to par t of a request shall
194198 specify the part and permit inspection of the rest.
195199 d. The response may state an objection to a requested
196200 form for producing electronically stored information.
197201 If the responding party objects to a requested form,
198202 or if no form was specified in the request, the party
199203 shall state the form or forms it intends to use.
200204 e. Unless otherwise stip ulated or ordered by the court,
201205 these procedures apply to producing documents or
202206 electronically stored information:
203207 (1) a party shall produce document s as they are kept
204208 in the usual course of business or shall organiz e
205209 and label them to correspond to the categories in
206210 the request,
207211 (2) if a request does not specify a form for
208212 producing electronicall y stored information, a
209213 party shall produce it in a form or forms in

237242 reasonably usable form or forms, and
238243 (3) a party need not produce the same electronically
239244 stored information in more than one form.
240245 C. NONPARTIES. A nonparty may be compelled to produce
241246 documents and tangible things or to permit an inspection as provided
242247 in Section 2004.1 of this title.
243248 SECTION 2. This act shall become effective November 1, 2024.
