37	65		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA:

39	66		SECTION 1. AMENDATORY 70 O.S. 2021, Section 4663, is
40	67		amended to read as fo llows:

42	68		Section 4663. A. On January 1, 1999, there shall be created
43	69		the Board of Trustees for Oklahoma State University/Tulsa which
44	70		shall consist of seven members who reside in Tulsa County or

45	98		contiguous counties and two members, one member of the Board of
46	99		Regents for the Oklahoma Agricultural and Mechanical Colleges (A&M

49	100		Board) who shall serve as vo ting, ex officio members, one of whom
50	101		who shall reside in the First Congressional District . The second
51	102		member from the A&M Board , and one member who shall be appointed by
52	103		the chair of the A&M Board. The member of the A&M Board and the
53	104		member appointed by the chair of the A&M Board shall serve as
54	105		voting, ex officio members. For purposes of serving on the Board of
55	106		Trustees, the members member of the A&M Board and the member
56	107		appointed by the chair of the A&M Board who are appointed to the
57	108		Board of Trustees shall not be subject to the dual office holding
58	109		restrictions in Section 6 of Title 51 of the Oklahoma Statutes. The
59	110		Governor shall appoint the other members o f the Board of Trustees
60	111		with the advice and consent of the Senate. The members shall be
61	112		appointed to numbered positions with staggered terms to expire as
62	113		provided in this section. Successors to the initial board members
63	114		shall serve seven-year terms that shall expire on June 30 of the
64	115		seventh year following appointment. Vacancies on the Board shall be
65	116		filled for the unexpired term by the Governor with the advice and
66	117		consent of the Senate. Four of the nine members on the initial
67	118		Board of Trustees shall be appointed by the Governor with the advice
68	119		and consent of the Senate from the members of the Board of Regents
69	120		of Rogers University who are residents of Tulsa and are serving on
70	121		the effective date of this act. The four members appointed from the

71	149		Board of Regents of Rogers University shall be appointed to the
72	150		positions numbered one through four. The r emaining three members
73	151		appointed by the Governor shall be appointed to positions five
74	152		through seven. The member of the A&M Board who resides in the First
75	153		Congressional District shall hold position number eight. The second
76	154		member appointed by the chair of the A&M Board shall hold position
77	155		number nine. The numbered positions and terms shall be as follows:

79	156		1. Position No. 1: The term of office of one member sh all
80	157		expire on the 30th day of June, 2000, and each seven (7) years
81	158		thereafter;

84	160		expire on the 30th day of June, 2001, and each seven (7) years

115	208		B. The Board of Trustees shall be a body corporate an d shall
116	209		adopt and use an official seal. The Board shall elect a chair,
117	210		vice-chair vice chair, and secretary annually, each of whom shall
118	211		serve for a term of one fiscal year and until a successor is elected
119	212		and qualified, and who shall perform such duties as the Board
120	213		directs. The Board shall adopt rules which it deems necessary for
121	214		the operation of the Boar d and the discharge of its duties and shall
122	215		cause the minutes of all meetings to be kept. The Bo ard shall
123	216		comply with the Oklahoma Open Meeting Act an d the Oklahoma Open
124	217		Records Act.

126	218		C. The Board of Trustees for Oklahoma State University/Tulsa
127	219		may be authorized by the A&M Board to supervise and manage the
128	220		campus of Oklahoma State University/Tulsa and perform other
129	221		functions as necessary. The Board of Trustees shall promulgate

130	249		rules and enact policies to govern the processes and procedures of
131	250		the Board. The policies of the Board of Regents of Rogers
132	251		University, including but not limited to policies on personnel and
133	252		student participation, that are in ef fect on the date that the Board
134	253		of Regents of Rogers University is dissolved shall be deemed adopted

137	254		by the Board of Trustees unless specifically amended or repealed by
138	255		the A&M Board. The A&M Board and the Board of Trustees shall
139	256		appoint a joint committee of at least two members from each board
140	257		and at least two members of the staff of each institution to dev elop
141	258		and propose mutually agreed upon rules and policies to formalize the
142	259		review and oversight pr ocedures and the relationships between the
143	260		A&M Board, the Board of Trustees, Oklahoma State University in
144	261		Stillwater, and Oklahoma State University/Tulsa. It is the intent
145	262		of the Legislature that in the interests of immediate responsiveness
146	263		to the needs of students, employees, and the business community that
147	264		the decision or approval process be expedited.

149	265		D. Subject to the oversight of the Board of Regents for the
150	266		Oklahoma Agricultural and Mechanical Colleges, the Board of Trustees
151	267		of Oklahoma State Univer sity/Tulsa shall set the compensation of the
152	268		president of Oklahoma State University/Tulsa. On or after January
153	269		1, 1999, the A&M Board may assign and delineate roles and
154	270		responsibilities for the Board of Trustees for Oklahoma State
155	271		University/Tulsa. Such responsibilities may include, but are not
156	272		limited to, student services, facility operations, student financial

158	301		University/Tulsa, and administrative operations as specified by the
159	302		A&M Board.

161	303		E. The Board of Trustees shall establish the usual and
162	304		customary accounts established by higher education institutions
163	305		within the Office of Management and Enter prise Services necessary to
164	306		carry out its duties.

166	307		F. Until July 1, 2001, during the transition and development of
167	308		Oklahoma State University/Tulsa, act ing on behalf of the Board of
168	309		Trustees for Oklahoma State University/Tulsa, Oklahoma State
169	310		University is authorized and directed to negotiate contracts with
170	311		institutions for courses and degree programs of study approved by
171	312		the Oklahoma State Regents for Hi gher Education, as necessary to
172	313		meet the higher education needs for the Tulsa metropolitan area.
173	314		The number of degree programs offered by Northeastern State
174	315		University and Langston University shall not be diminished or
175	316		duplicated.

177	317		G. The president of Okl ahoma State University/Tulsa shall be
178	318		selected by the Board of Regents for the Oklahoma Agricultural and

181	319		Mechanical Colleges after completion of a search process as set
182	320		forth in this subsection. The A& M Board shall appoint at least two
183	321		of its members, one of whom must reside in the First Congressional
184	322		District, and the Board of Trustees shall appoint at leas t two of

191	355		SECTION 2. This act shall become effective July 1, 20 24.

193	356		SECTION 3. It being immediately necessary for the preservation
194	357		of the public peace, health, or safety, an emergency is hereby
195	358		declared to exist, by reason whereof this act shall take effect and
196	359		be in full force from and after its passa ge and approval.
